Having regard to the Treaty establishing the European Economic Community, and in particular Articles 99 and 100 thereof;

Whereas the tax impediments at present hindering the dispatch from one Member State to another of small consignments of goods intended for private persons constitute an obstacle to the creation of an economic market with characteristics similar to those of a domestic market ; and whereas the elimination of such impediments is the corollory to freedom of movement and freedom of establishment for persons in the Community;

considérant que les entraves d'ordre fiscal gênant actuellement l'expédition, d'un État membre à l'autre, de petits envois de marchandises à destination de particuliers, font obstacle à la constitution d'un marché économique ayant des caractéristiques analogues à celles d'un marché intérieur ; que la suppression de ces entraves est le corollaire de la libre circulation et du libre établissement des personnes dans la Communauté;

Whereas such impediments should be reduced as far as possible in respect of small consignments from one private person to another in order to assist personal and family contacts between private persons in different Member States,
|
considérant que, afin de favoriser les rapports personnels et familiaux entre particuliers se trouvant dans des États membres différents, il convient de réduire dans toute la mesure du possible ces entraves en ce qui concerne les petits envois de particulier à particulier,

HAS ADOPTED THIS DIRECTIVE:

Article 1

|
1. Goods dispatched from a Member State in small consignments of a non-commercial character by a private person, wherever may be his permanent or usual residence or his principal place of business, intended for another private person in another Member State shall be allowed relief from turnover taxes and excise duties payable on importation.

Les marchandises expédiées d'un État membre comme petits envois dépourvus de tout caractère commercial, par un particulier quel que soit son domicile, sa résidence habituelle ou le centre de son activité professionnelle, à destination d'un autre particulier se trouvant dans un autre État membre, bénéficient à l'importation d'une franchise des taxes sur le chiffre d'affaires et des accises.

2. For the purpose of paragraph 1, small consignments of a non-commercial character mean consignments of goods which: (a) have been acquired in the Community subject to the taxation normally imposed in the domestic market in one of the Member States and without relief from turnover taxes and/or excise duties;
|
2. Au sens du paragraphe 1, on entend par petits envois dépourvus de tout caractère commercial, les envois contenant des marchandises répondant aux conditions suivantes: a) avoir été acquises dans la Communauté aux conditions générales d'imposition du marché intérieur d'un des États membres sans bénéficier d'aucun remboursement de taxes sur le chiffre d'affaires et/ou d'accises;

(b) are not intended for commercial use and appear from their nature and quantity to be intended solely for the personal or family use of the recipient;
|
b) ne pas être destinées à être remises dans le circuit commercial et apparaître, par leur nature et leur quantité, comme réservées à l'usage personnel ou familial du destinataire;
|
|
(c) are not sent against payment of any kind by the recipient ; and
|
c) ne pas être adressées contre paiement d'aucune sorte par le destinataire;
|
|
(d) do not have a total value exceeding 40 units of account for each consignment.

reduce the relief allowed for small consignments for products which are subject to the quantitative limits referred to in Article 4 (1) of Council Directive No 69/169/EEC (1) of 28 May 1969 on the harmonization of provisions laid down by law, regulation or administrative action relating to the relief from turnover taxes and excise duty collected on importation in international passenger traffic, as amended by Council Directive No 72/230/EEC (2), or to exclude those products from the benefit of the said relief.

faisant l'objet des limites quantitatives visées à l'article 4 paragraphe 1 de la directive 69/169/CEE du Conseil, du 28 mai 1969, concernant l'harmonisation des dispositions législatives, réglementaires et administratives relatives aux franchises des taxes sur le chiffre d'affaires et des accises perçues à l'importation dans le trafic international des voyageurs (1), modifiée par la directive 72/230/CEE (2), ou d'exclure ces produits du bénéfice de ladite franchise.

1. Member States shall put into operation the measures necessary to comply with this Directive not later than 1 April 1975.
|
1. Les États membres mettent en application, au plus tard le 1er avril 1975, les mesures nécessaires pour se conformer à la présente directive.
|
|
2. Each Member State shall inform the Commission of the measures it takes to apply this Directive. The Commission shall communicate this information to the other Member States.
|
2. Chaque État membre informe la Commission des dispositions qu'il prend pour l'application de la présente directive.
|
|
|
La Commission communique ces informations aux autres États membres.
|
|

This Directive is addressed to the Member States.
