amending Regulation (EEC) No 3508/92 establishing an integrated administration and control system for certain Community aid schemes as regards the deadlines for lodging applications for compensatory payments under the aid scheme for rice producers

Having regard to the Treaty establishing the European Community and in particular Article 37 thereof,

(1) Whereas Article 6 of Council Regulation (EC) No 3072/95 of 22 December 1995 on the common organisation of the market in rice(3) introduces compensatory payments to Community rice producers;

(1) considérant que l'article 6 du règlement (CE) n° 3072/95 du Conseil du 22 décembre 1995 portant organisation commune du marché du riz(3) établit un régime de paiement compensatoire aux producteurs de riz;

(2) Whereas Article 1(a) of Council Regulation (EEC) No 3508/92 of 27 November 1992 establishing an integrated administration and control system for certain Community aid schemes(4) stipulates that the system it introduces is to apply to the aid scheme for rice producers established by Article 6 of Regulation (EC) No 3072/95;

(2) considérant que l'article 1er, point a), du règlement (CEE) n° 3508/92 du Conseil du 27 novembre 1992 établissant un système intégré de gestion et de contrôle relatif à certains régimes d'aides communautaires(4), dispose que le régime qu'il institue s'applique au régime de soutien aux producteurs de riz établi par l'article 6 du règlement (CE) n° 3072/95;

(3) Whereas, in order to ensure that the integrated system is properly and permanently applied to the scheme of compensatory payments to rice producers, the deadlines for lodging applications and for certain amendments to applications in the producer Member States should be specified,

(3) considérant qu'il convient de spécifier, pour une bonne et permanente application du système intégré au régime de paiement compensatoire aux producteurs de riz, les dates limites de présentation des demandes ainsi que de certaines modifications de ces dernières dans les États membres producteurs,

HAS ADOPTED THIS REGULATION:

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

Article 1

Article premier

Article 6 of Regulation (EEC) No 3508/92 shall be amended as follows:

L'article 6 du règlement (CEE) n° 3508/92 est modifié comme suit:

(a) paragraph (2) shall be supplemented by the following subparagraph: "In the context of the compensatory payments to rice producers provided for in Article 6 of Regulation (EC) No 3072/95, the date fixed by the Member State may not be later than 31 May preceding the harvest in question and, in the case of Portugal and Spain, 30 June preceding the harvest.";

a) le paragraphe 2 est complété par l'alinéa suivant: "Dans le cadre du régime de paiement compensatoire aux producteurs de riz, prévu à l'article 6 du règlement (CE) n° 3072/95, la date fixée par l'État membre ne peut pas être postérieure au 31 mai qui précède la récolte en cause, et pour le Portugal et l'Espagne, cette date ne peut pas être postérieure au 30 juin précédant la récolte."

(b) in paragraph 4 the following subparagraph shall be added: "In the context of the compensatory payments to rice producers provided for in Article 6 of Regulation (EC) No 3072/95, certain amendments may be made to 'area' aid applications provided the competent authorities receive these not later than the dates fixed in the third subparagraph of paragraph 2 of this Article."

b) le paragraphe 4 est complété par l'alinéa suivant: "Dans le cadre du régime de paiement compensatoire aux producteurs de riz, prévu à l'article 6 du règlement (CE) n° 3072/95, certaines modifications peuvent être apportées à la demande d'aides 'surfaces' pour autant que les autorités compétentes les reçoivent au plus tard aux dates fixées au paragraphe 2, troisième alinéa, du présent article."

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Communities.

Le présent règlement entre en vigueur le troisième jour suivant celui de sa publication au Journal officiel des Communautés européennes.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
