THE COUNCIL OF THE EUROPEAN COMMUNITIES,

LE CONSEIL DES COMMUNAUTÉS EUROPÉENNES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 227 (2) thereof;
|
vu le traité instituant la Communauté économique européenne, et notamment son article 227 paragraphe 2,

Having regard to the proposal from the Commission;
|
vu la proposition de la Commission,
|
|
Whereas the second subparagraph of Article 227 (2) provides that the Council shall determine the conditions under which the provisions of the Treaty other than those contained in the first subparagraph of paragraph 2 of that Article, and in particular the provisions of Articles 48 and 49 of the Treaty, are to apply to the French overseas departments;
|
considérant qu'en vertu de l'article 227 paragraphe 2 deuxième alinéa, il appartient au Conseil de déterminer les conditions d'application aux départements français d'outre-mer des dispositions du traité qui ne sont pas énumérées au paragraphe 2 premier alinéa de cet article, et notamment de celles des articles 48 et 49 du traité;

Whereas freedom of movement for workers is likely to promote the economic and social development of those departments;
|
considérant que la libre circulation des travailleurs est de nature à favoriser le développement économique et social de ces départements,
|

HAS DECIDED AS FOLLOWS:

Articles 48 and 49 of the Treaty establishing the European Economic Community and the measures taken in implementation of those Articles shall apply to the French overseas departments.
|
Les articles 48 et 49 du traité instituant la Communauté économique européenne, ainsi que les dispositions prises en application de ces articles s'appliquent aux départements français d'outre-mer.

This Decision shall be published in the Official Journal of the European Communities, under "Legislation I". It shall enter into force on the twentieth day following its publication.

La présente décision est publiée au Journal officiel des Communautés européennes, partie «Législation I». Elle entre en vigueur le vingtième jour suivant celui de sa publication.
