THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 342 thereof,

Whereas:

considérant ce qui suit:

(1) Council Regulation (EC) No 920/2005 of 13 June 2005 amending Regulation No 1 of 15 April 1958 determining the languages to be used by the European Economic Community and Regulation No 1 of 15 April 1958 determining the languages to be used by the European Atomic Energy Community and introducing temporary derogation measures from those Regulations [1] accorded Irish the status of official language and working language of the institutions of the European Union.

(1) Le règlement (CE) no 920/2005 du Conseil du 13 juin 2005 modifiant le règlement no 1 du 15 avril 1958 portant fixation du régime linguistique de la Communauté économique européenne et le règlement no 1 du 15 avril 1958 portant fixation du régime linguistique de la Communauté européenne de l'énergie atomique et introduisant des mesures dérogatoires temporaires à ces règlements [1] a accordé à l'irlandais le statut de langue officielle et de langue de travail des institutions de l'Union.

(2) Regulation (EC) No 920/2005 provides that, for practical reasons and on a transitional basis, the institutions of the Union are not to be bound by the obligation to draft and translate all acts, including judgments of the Court of Justice, in the Irish language, with the exception of Regulations adopted jointly by the European Parliament and the Council. It is for the Council to determine, not later than 4 years from the date of application of Regulation (EC) No 920/2005 and at 5-yearly intervals thereafter, whether to put an end to this derogation.

(2) Le règlement (CE) no 920/2005 prévoit que, pour des raisons pratiques et à titre transitoire, les institutions de l'Union ne sont pas liées par l'obligation de rédiger ou de traduire en irlandais tous les actes, y compris les jugements de la Cour de justice, à l'exception des règlements adoptés conjointement par le Parlement européen et le Conseil. Il appartient au Conseil de déterminer, dans un délai de quatre ans à compter de la date d'application du règlement (CE) no 920/2005 et tous les cinq ans par la suite, s'il convient ou non de mettre un terme à cette dérogation.

(3) The institutions of the Union will continue to take steps to improve public access to information in Irish on the activities of the Union. Nevertheless, there are still difficulties in recruiting a sufficient number of Irish-language translators, legal/linguistic experts, interpreters and assistants. It is therefore necessary to extend the derogation provided for in the first paragraph of Article 2 of Regulation (EC) No 920/2005 for a period of 5 years from 1 January 2012,

(3) Les institutions de l'Union continueront à prendre des initiatives visant à améliorer l'accès des citoyens à des informations en irlandais sur les activités de l'Union. Des difficultés à recruter, en nombre suffisant, des traducteurs, des juristes-linguistes, des interprètes et des assistants de langue irlandaise persistent néanmoins. Il convient, par conséquent, d'étendre pour une période de cinq ans, à partir du 1er janvier 2012, la dérogation prévue à l'article 2, premier alinéa, du règlement (CE) no 920/2005,

HAS ADOPTED THIS REGULATION:

Article 1

Article premier

The derogation provided for in the first paragraph of Article 2 of Regulation (EC) No 920/2005 is hereby extended for a period of 5 years from 1 January 2012.

La dérogation visée à l'article 2, premier alinéa, du règlement (CE) no 920/2005 est prorogée d'une période de cinq ans à compter du 1er janvier 2012.

This Article shall not apply to Regulations adopted jointly by the European Parliament and the Council.

Le présent article ne s'applique pas aux règlements adoptés conjointement par le Parlement européen et le Conseil.

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.

Le présent règlement entre en vigueur le jour de sa publication au Journal officiel de l'Union européenne.

It shall apply from 1 January 2012.

Il est applicable à partir du 1er janvier 2012.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
