1. Introduction

1. INTRODUCTION

This progress report describes the work carried out in the first semester of 2010, concerning the development of the second generation Schengen Information System (SIS II) and preparations for migration from SIS 1+ to SIS II. It is presented to the Council and the European Parliament in accordance with Article 18 of Council Regulation (EC) No 1104/2008 and of Council Decision 2008/839/JHA on migration from the Schengen Information System (SIS 1+) to the SIS II. This report also constitutes a test status report.

Le présent rapport décrit les travaux réalisés durant le premier semestre de 2010 concernant le développement du système d’information Schengen de deuxième génération (SIS II) et les préparatifs de la migration du SIS 1+ vers le SIS II. Il est présenté au Conseil et au Parlement européen conformément à l’article 18 du règlement (CE) n° 1104/2008 du Conseil et de la décision 2008/839/JAI du Conseil relatifs à la migration du système d’information Schengen (SIS 1+) vers le système d’information Schengen deuxième génération (SIS II). Le présent rapport décrit également l’état d’avancement des essais.

A key element of this period was the running of the first project milestone test as foreseen in the Conclusions of the Justice and Home Affairs (JHA) Council of 4-5 June 2009.

A subsequent JHA Council of 30 November 2009 concluded that the final deadline with regard to the accomplishment of the first milestone test would be 29 January 2010, at the latest.

Le Conseil JAI du 30 novembre 2009 avait conclu que le dernier report pour la réalisation des essais relatifs à la première étape serait fixé au 29 janvier 2010 au plus tard.

The Commission, in close cooperation with the Member States, put in place the necessary elements to implement these Council Conclusions.

En étroite collaboration avec les États membres, la Commission a mis en place les éléments nécessaires pour se conformer aux conclusions du Conseil.

Accordingly, during this period, work was carried out in three major areas:

2.2. The first milestone test

The first run of the milestone test took place between 21 and 24 January 2010, pursuant to testing conditions and technical parameters that were discussed and agreed with the Member States in advance of the tests. Whilst the central system demonstrated relatively stable behaviour for the first 25 hours, significant issues were encountered during the remaining 47 hours. A comprehensive technical analysis of the test results was carried out by the Commission's Quality Assurance contractor, as well as by an external contractor mandated by the Member States. As stated in the June 2009 Council conclusions, the results of milestone tests must be assessed and validated by the Commission jointly with the Global Programme Management Board (GPMB) and the SIS II Task Force.

La première série des essais relatifs à la première étape s'est déroulée du 21 au 24 janvier 2010, conformément aux conditions et paramètres techniques qui avait été préalablement débattus et convenus avec les États membres. Si le système central a manifesté un comportement relativement stable pendant les 25 premières heures, de sérieux problèmes se sont posés durant les 47 heures restantes. Le prestataire chargé de l’assurance qualité engagé par la Commission a effectué une analyse technique exhaustive des résultats des essais, de même qu'un contractant externe mandaté par les États membres. Comme indiqué dans les conclusions du Conseil de juin 2009, les résultats des essais relatifs aux différentes étapes doivent être évalués et validés par la Commission, en collaboration avec le Conseil de gestion du programme global (CGPG) et la task-force SIS II.

Following in-depth technical analysis, assessment and validation of the results, the test was found to be inconclusive by a large majority of Member States' technical experts in the GPMB and SIS II Task Force. The Commission followed that advice and a test re-run was launched in accordance with the Council Conclusions of June 2009, whereby, "any test declared as inconclusive will be repeated until it fails or passes".

À la suite de cette analyse technique minutieuse, de l'évaluation et de la validation des résultats, ces essais ont été jugés non probants par une grande majorité d'experts des États membres siégeant au CGPG et dans la task-force SIS II. La Commission a donc suivi leurs conseils et les essais ont été recommencés conformément aux conclusions du Conseil de juin 2009, selon lesquelles «[ t ] out essai déclaré non concluant sera recommencé jusqu'à ce qu'il échoue ou réussisse ».

The re-run of the milestone test took place between 2 and 5 March 2010. A majority of Member States (13 out of 16 in the relevant expert bodies) concluded that the re-run test was "passed". To put this substantial test into context, within the 72 hours of the test, 860 180 transactions involving the creation, update or deletion (C.U.D.) of an alert were processed, each within the service level agreement time of three minutes. Out of the 26 844 897 queries sent during the 72 hour load test 26 834 528 (99.96%) were answered by the central system within the service level agreement time of one second (the majority of the remaining queries were answered in less than three seconds). All messages (C.U.D. and queries) received were correctly acknowledged by the central system. Over the test period the central system demonstrated that it handled an average of 100 standard queries per second and 3.3 C.U.D. transactions per second. The Commission noted throughout the first milestone period that the overall atmosphere of cooperation with Member States' experts in the framework of the GPMB during the milestone test was very fruitful.

Les essais de l'étape ont été reproduits entre le 2 et le 5 mars 2010. Une majorité d'États membres (13 sur 16 dans les groupes d'experts concernés) a conclu que les essais recommencés étaient «réussis». Pour mettre ces importants essais en situation, durant les 72 heures qu'ils ont duré, 860 180 opérations impliquant la création, l'actualisation ou la suppression (C.A.S.) d'un signalement ont été traitées, chacune en moins de trois minutes conformément à l'accord sur les niveaux de service. Sur les 26 844 897 requêtes envoyées pendant les 72 heures qu'a duré cette épreuve de charge, 26 834 528 (soit 99,96 %) ont reçu une réponse du système central dans le temps imparti par l'accord, soit une seconde (la majorité des autres requêtes obtenant une réponse en moins de trois secondes). Tous les messages (C.A.S. et requêtes) reçus ont été correctement reconnus par le système central. Durant la période des essais, le système central a ainsi démontré qu'il pouvait traiter en moyenne 100 requêtes standard par seconde et 3,3 opérations de C.A.S. par seconde. La Commission a constaté tout au long de la première étape que le climat général de coopération avec les experts des États membres dans le cadre du CGPG était très productif au cours des essais.

In addition to the declaration of the successful outcome of the first milestone test, the Commission provided further input for Council deliberations by adopting, on 12 April 2010, a report on the financial and contractual aspects of developing the second generation Schengen Information System (SIS II) [1].

Outre la déclaration de réussite des essais définis pour la première étape, la Commission a contribué aux débats du Conseil en adoptant, le 12 avril 2010, un rapport (en anglais uniquement) sur les aspects financiers et contractuels du développement du système d'information Schengen de deuxième génération (SIS II)[1].

Accordingly, the JHA Council on 23 April 2010 decided that the development of SIS II will continue on the basis of the current SIS II project and invited the Commission to present a comprehensive global schedule for the entry into operation of SIS II to the Council at its meeting on 3-4 June 2010. This will have to be confirmed as a binding global schedule preferably by the end of July 2010 and at the latest at the Council meeting on 7-8 October 2010.

En conséquence, le Conseil JAI a décidé, le 23 avril 2010, que le développement du SIS II se poursuivrait sur la base de l'actuel projet SIS II et a invité la Commission à lui présenter un calendrier global détaillé pour la mise en service du système lors de sa réunion des 3 et 4 juin 2010. Le caractère contraignant du calendrier devait être confirmé, de préférence avant la fin du mois de juillet 2010 ainsi qu'à la dernière réunion du Conseil des 7 et 8 octobre 2010.

The Commission presented to the JHA Council on 3-4 June 2010 a high-level schedule for the entry into operation of SIS II which is due to be confirmed in the October JHA Council. This schedule sets a target date of the first quarter of 2013 for entry into operations.

Au Conseil JAI des 3 et 4 juin 2010, la Commission a présenté un calendrier à haut niveau pour la mise en service du SIS II, qui devrait être confirmé lors du Conseil JAI d'octobre. Ce calendrier fixe au premier trimestre 2013 l'échéance pour la mise en service.

The European Parliament was also regularly and transparently informed on the progress towards and results of the first milestone test.

Par ailleurs, le Parlement européen a été informé de façon régulière et transparente sur les progrès accomplis et les résultats des essais relatifs à la première étape.

2.3. Preparations for an alternative technical solution

2.3. Préparatifs d'une solution technique de rechange

In order to prepare the ground for a possible switch to an alternative technical scenario for implementing the SIS II functionalities, should one of the milestones be judged to have failed, bilateral discussions took place between the Commission and France with a view to a possible delegation agreement for implementing the alternative option for developing SIS II (SIS 1+RE).

Afin de préparer le terrain pour un éventuel recours à un scénario technique de rechange pour la mise en œuvre des fonctionnalités du SIS II, dans l'hypothèse où l'une des étapes serait jugée non concluante, la Commission et la France ont eu des entretiens bilatéraux en vue de conclure un éventuel accord de délégation relatif à la mise en œuvre de la solution de rechange pour le développement du SIS II (SIS 1+RE).

The June 2009 and November 2009 Council Conclusions set out that in the event that the milestone tests demonstrate non-compliance with requirements, the Council would have two months to decide on the basis of a comprehensive financial and contractual information whether to invite the Commission to stop the current SIS II project and continue with the SIS II development on the basis of an alternative technical solution.

Les conclusions du Conseil adoptées en juin et en novembre 2009 prévoient qu'au cas où les essais montreraient que les exigences fixées dans le cadre des étapes ne sont pas respectées, le Conseil disposera de deux mois pour décider, sur la base d'informations financières et contractuelles détaillées, s'il invite la Commission à arrêter l'actuel projet SIS II et à poursuivre le développement du SIS II sur la base d'une solution technique de rechange.

The French administration highlighted that the contract negotiated for the replacement of obsolete components of the current SIS 1+ (and optionally extendable for SIS 1+RE) could not be used beyond September 2010. Hence, if not activated as a result of the first milestone test, no contingency plan would be available to back the second milestone test. This point was recorded in the JHA Council Conclusions of April 2010.

Le gouvernement français a souligné que le contrat négocié pour le remplacement des composants obsolètes de l'actuel SIS 1+ (et éventuellement reconductible pour le SIS 1+RE) ne pourrait pas être appliqué au-delà de septembre 2010. Ainsi donc, faute d'une activation par suite des essais concernant la première étape, il n'existera aucun plan de secours pour les essais de la deuxième étape. Ce point a été consigné dans les conclusions du Conseil JAI d'avril 2010.

A key element of any delegation to France concerned the adoption of the legislative proposals to amend the migration instruments providing the required legal flexibility for SIS II development by means of an alternative technical scenario. This was achieved on 3 June 2010 with the adoption of two Council Regulations, which entered into force on 25 June 2010 [2]. On this basis, there is ongoing will and commitment, from the Commission and France, to identify the necessary contractual arrangements to ensure a contingency scenario for the second milestone test.

L'un des éléments déterminants pour permettre une éventuelle délégation à la France était l'adoption des propositions législatives modifiant les instruments relatifs à la migration afin d'offrir la souplesse juridique requise pour le développement du SIS II grâce à un scénario technique de rechange. Cet objectif a été atteint le 3 juin 2010, date à laquelle ont été adoptés deux règlements du Conseil qui sont entrés en vigueur le 25 juin 2010[2]. Sur cette base, la Commission et la France sont résolues à définir les modalités contractuelles nécessaires à la mise en œuvre d'un scénario de secours pour les essais de la deuxième étape.

2.4. Preparations for entry into operation

2.4. Préparatifs de la mise en service

The refinement of requirements exercise focussed on fixing the requirements to avoid a background to the project of constantly evolving needs.

L'affinement des exigences a essentiellement consisté à fixer celles-ci afin d'éviter que le projet ne se déroule dans un contexte de besoins constamment renouvelés.

The key issue is system capacity. The original specifications anticipated the management of 15 million records, increasing over time to 22 million. Due to expansion in the number of Member States using the SIS and intensive use of the system by the competent authorities at national level, by January 2010 the existing system contained over 31 million alerts. The participants in a series of workshops agreed that the estimated size of SIS II at go-live is likely to be 52 million alerts. Accordingly, it was agreed that the system capacity at go-live should be 70 million alerts and that SIS II should be tested to a capacity of 100 million alerts, without the need for technical change.

Le problème principal réside dans la capacité du système. Les spécifications initiales prévoyaient la gestion de 15 millions d'enregistrements, voire de 22 millions au bout d'un certain temps. Du fait de l'accroissement du nombre des États membres utilisant le SIS et de son usage intensif par les autorités compétentes au niveau national, en janvier 2010, le système contenait plus de 31 millions de signalements. Les participants à une série d'ateliers se sont accordés sur le fait que le volume du SIS II lors de son lancement opérationnel atteindra probablement 52 millions de signalements. Par conséquent, il a été décidé que la capacité du système devrait s'établir à 70 millions de signalements lors de sa mise en service et que le SIS II devrait faire l'objet d'essais de capacité jusqu'à 100 millions de signalements, sans qu'il soit nécessaire d'y apporter des modifications techniques.

The implications of this significant deviation from the original specifications were discussed regarding acceptable, business-oriented levels of performance in relation to queries in the system and transactions which involve creating, updating or deleting alerts. Additionally, the ability of the central SIS II to handle this greater throughput was investigated and proposals made.

Les implications de cet écart substantiel par rapport aux spécifications d'origine ont été examinées sous l'angle de niveaux de performance acceptables et pragmatiques, par rapport aux requêtes introduites dans le système et aux opérations qui entraînent la création, l'actualisation ou la suppression de signalements. En outre, la capacité du SIS II à gérer ces débits plus importants a été sondée et des propositions ont été formulées.

Further discussions covered the priorities of end users upon switchover from the central unit to the back-up central unit should there be a major problem at the principal location housing the central SIS II. Again, the participants identified solutions set out in service level agreements.

D'autres discussions ont porté sur les priorités des utilisateurs finals en cas de basculement de l'unité centrale vers l'unité centrale de secours, dans l'hypothèse où un problème majeur surviendrait sur le site d'hébergement principal du SIS II. Ici aussi, les participants ont dégagé des solutions qui sont présentées dans les accords sur les niveaux de service.

As a result of the intensive work on requirements, on 26 May the SISVIS Committee was in a position to consider the updated system requirements and the outline of the global schedule for SIS II. The new proposed date of entry into operation of SIS II is the first quarter of 2013.

Ces travaux intensifs menés pour déterminer les exigences ont permis au comité SISVIS d'examiner, le 26 mai, la version actualisée des exigences du système et les grandes lignes du calendrier global pour le SIS II. L'entrée en service de ce dernier est désormais prévue au premier trimestre 2013.

The Commission informed the Council of the new schedule at the JHA Council on 3-4 June 2010. The global schedule formed a basis for the insertion of a new expiry date (31 March 2013) to the proposal for amending the legal instruments governing transfer from SIS 1 + to SIS II (“the migration instruments”). With respect to the budgetary estimate, the Commission declared at the Council that its intention was to maintain the cost within the budgetary envelope for SIS II approved for the current financial perspectives (2007-2013).

La Commission a informé le Conseil du nouveau calendrier lors du Conseil JAI des 3 et 4 juin 2010. Ce calendrier global a servi de référence pour l'insertion d'une nouvelle échéance (le 31 mars 2013) dans la proposition portant modification des instruments juridiques régissant le passage du SIS 1+ vers le SIS II («les instruments relatifs à la migration»). En ce qui concerne l'estimation budgétaire, la Commission a déclaré au Conseil qu'elle avait l'intention de maintenir les coûts sous le plafond de l'enveloppe octroyée au SIS II dans le cadre financier actuel (2007-2013).

The Commission shall achieve the remaining and final contractual coverage necessary to achieve entry into operation of the system.

La Commission entend finaliser les contrats encore nécessaires en vue de la mise en service du système.

It is important to note this process of refining the requirements did not modify the core obligations stemming directly from the SIS II legal instruments.

Il importe de souligner que le processus ayant permis d'affiner les exigences n'a pas modifié les obligations fondamentales qui résultent directement des instruments juridiques relatifs au SIS II.

2.5. Preparations for migration

2.5. Préparatifs de la migration

The Council Regulation [3] and Council Decision [4] governing migration from SIS 1+ to SIS II (the migration instruments) lay down the tasks and responsibilities of the Commission and the Member States for preparing this migration, including further development and testing of SIS II. As these legal instruments contained an expiry date of 30 June 2010, the Commission tabled proposals to amend them, chiefly with a view to extending the deadline for transferring data from SIS 1+ to SIS II. The outcome was the adoption, on 3 June 2010, of Council Regulation 541/2010 [5] amending Regulation (EC) no 1104/2008 on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II) and Council Regulation (EU) 542/2010 [6] amending Decision 2008/839/JHA on the same subject.

Le règlement[3] et la décision[4] du Conseil régissant la migration du SIS 1+ vers le SIS II (les instruments relatifs à la migration) définissent les tâches et responsabilités de la Commission et des États membres dans les préparatifs de cette migration, y compris la poursuite du développement du SIS II et les essais de celui-ci. La date d'expiration de ces instruments juridiques étant fixée au 30 juin 2010, la Commission a présenté des propositions visant à modifier ces textes, essentiellement afin de prolonger le délai de transfert des données du SIS 1+ vers le SIS II. Cela a abouti à l'adoption, le 3 juin 2010, du règlement (UE) n° 541/2010[5] du Conseil modifiant le règlement (CE) n° 1104/2008 relatif à la migration du système d’information Schengen (SIS 1+) vers le système d’information Schengen de deuxième génération (SIS II) et du règlement (UE) n° 542/2010[6] du Conseil modifiant la décision 2008/839/JAI portant sur le même sujet.

Together, these Regulations, in line with the JHA Council Conclusions of 4-5 June 2009:

Conformément aux conclusions du Conseil JAI des 4 et 5 juin 2009, ces deux règlements:

· Give formal status to the GPMB;

- confèrent un statut officiel au CGPG;

· Provide legal flexibility for an alternative technical scenario;

- offrent la souplesse juridique nécessaire à un scénario technique de rechange;

· Set out that the migration instruments "shall expire on a date to be fixed by the Council…and in any case no later than on 31 March 2013 or on 31 December 2013 in case of a switchover to an alternative technical scenario…"

- prévoient que les instruments relatifs à la migration « expire[nt] à la date arrêtée par le Conseil , […] et en tout état de cause au plus tard le 31 décembre 2011 ou le 31 décembre 2013 en cas de passage à un scénario technique de rechange […] ».

The SIS II project includes the provision of a wide area communications network, meeting the requirements of availability, security, geographical coverage and level of service, to enable the national and central systems to communicate.

Le projet SIS II prévoit la mise à disposition d’un réseau étendu de communications satisfaisant aux exigences de disponibilité, de sécurité, de couverture géographique et de niveau de service, permettant à l’ensemble des systèmes nationaux et centraux de communiquer.

In late May, the Commission took a decision to temporarily suspend the back-up local national interfaces. These back-up sites are optional. Given the new draft project schedule, a financial saving could thus be made on network costs. Member States were informed about this step. The sites will be re-activated at a later stage, prior to go-live.

Fin mai, la Commission a décidé de suspendre temporairement les interfaces nationales locales de secours. Ces sites de secours sont facultatifs. Le nouveau projet de calendrier du projet a donc permis de faire des économies sur les coûts du réseau. Les États membres ont été informés de cette mesure. Les sites seront réactivés à un stade ultérieur, avant le lancement opérationnel.

During the period covered by this report the connections to the SIS II s-TESTA network were successfully established for Bulgaria on time and within budget.

Pendant la période visée par le présent rapport, les connexions au réseau s-TESTA du SIS II ont été établies pour la Bulgarie, dans le délai fixé et sans dépasser le budget alloué.

2.7. Operational management

2.7. Gestion opérationnelle

During the transitional phase between the entry into operations of SIS II and the setting up of the agency for long-term operational management of large-scale IT systems in the area of justice, freedom and security (including SIS II), the Commission will be responsible for operational management of SIS II.

Pendant la phase de transition entre la mise en service du SIS II et la création d’une agence chargée de la gestion à long terme des systèmes d’information à grande échelle dans le domaine de la justice, de la liberté et de la sécurité (y compris du SIS II), la Commission se chargera de la gestion opérationnelle du SIS II.

Preparations for a two year extension to the contract with the French authorities for infrastructure and offices are in their final stages [7]. In the framework of the service contract on recruitment and training, the French authorities have recruited staff to operate the systems developed by the Commission. One major priority is to complete negotiations with France on the contractual framework covering operational tasks during the transitional phase. A further priority is to seek agreement with France on delegation arrangements for continuing development on the basis of the SIS 1+RE solution, should this solution be required.

Les préparatifs de la reconduction pour deux ans du contrat passé avec les autorités françaises concernant l'infrastructure et les bureaux sont en voie d'achèvement[7]. Dans le cadre du contrat de services relatif au recrutement et à la formation, les autorités françaises ont engagé du personnel chargé de faire fonctionner les systèmes développés par la Commission. Une des principales priorités est de conclure les négociations avec la France au sujet de cadre contractuel qui s'appliquera aux tâches opérationnelles pendant la phase de transition. Une autre priorité consistera à dégager un accord avec la France concernant les modalités de la délégation pour la poursuite du développement sur la base de la solution SIS 1+RE, si celle-ci devait s'imposer.

The original proposals for a legislative package for establishing an IT agency [8] were replaced in March 2010 by a revised proposal [9] for a Regulation, taking account of changes introduced by the Lisbon Treaty. Negotiations on these proposals are ongoing in the preparatory bodies of the Council and in the European Parliament, with a view to their adoption by the end of 2010.

Le paquet initial de propositions législatives relatives à la création d'une agence[8] chargée des systèmes d'information a été remplacé en mars 2010 par une proposition[9] modifiée de règlement, qui tient compte des modifications introduites par le traité de Lisbonne. Les négociations relatives à cette proposition sont en cours dans les instances préparatoires du Conseil et au Parlement européen, son adoption devant intervenir avant la fin 2010.

Following points raised by some Member States, the Commission carried out a study on the question of access to unencrypted data, which can only take place within the secure environment of the network operating centre in Bratislava. Several scenarios were outlined on which Member States were consulted. The options included a second layer of encryption but also a set of additional organisational measures. There was no broad consensus within the Member States on the most suitable scenario. It was observed that the implementation of a second layer of encryption would be both costly and time consuming. Additionally it would be necessary to consider the possible impact on network stability and performance.

À la suite de questions soulevées par certains États membres, la Commission a effectué une étude sur l'accès aux données non cryptées, qui ne peut avoir lieu que dans l'environnement sécurisé du centre opérationnel du réseau à Bratislava. Plusieurs scénarios ont été ébauchés, sur lesquels les États membres ont été consultés. Parmi les options envisagées figuraient l'ajout d'une seconde couche de chiffrement, mais aussi l'adoption d'une série de mesures organisationnelles supplémentaires. Les États membres n'ont pu s'accorder sur le scénario le plus approprié. La solution de la seconde couche de chiffrement a été jugée onéreuse et trop longue à réaliser. Par ailleurs, il serait nécessaire d'évaluer son éventuel impact sur la stabilité et les performances du réseau.

The Commission organised two visits for Member States' experts to the network operating centre. The experts commented favourably on the internal organisation and security in the centre and made some recommendations. The Commission will carefully follow the implementation of those recommendations and arrange further consultation, if required.

La Commission a organisé deux visites d'experts nationaux au centre opérationnel du réseau. Les experts ont émis des avis favorables sur l'organisation interne et la sécurité du centre et ils ont formulé quelques recommandations. La Commission suivra de près la mise en œuvre de celles-ci et organisera d'autres consultations, en cas de besoin.

On 4 May 2010 the Commission adopted the SIS II Security Plan which will cover the security of SIS II during the transitional period, until the IT agency is established [10].

By the end of the reporting period the total budgetary commitments made by the Commission on the SIS II project, since 2002, amounted to € 93.987.003. The corresponding contracts include feasibility studies, the development of the central SIS II itself, support and quality assurance, the SIS II network, preparation for operational management in Strasbourg, security, biometrics preparations and communication.

À la fin de la période examinée dans le présent rapport, les engagements budgétaires effectués depuis 2002 par la Commission pour le projet SIS II se montaient au total à 93 987 003 EUR. Les contrats correspondants portent sur des études de faisabilité, le développement du SIS II central lui-même, les services d’appui et d’assurance qualité, le réseau SIS II, la préparation de la gestion opérationnelle à Strasbourg, la sécurité, les préparatifs en matière de biométrie, et la communication.

Of this amount, € 55.574.168 had actually been paid between 2002 and the end of June 2010. The main expenditure items were development (€ 26.500.816), the network (€ 16.012.711) and support and quality assurance (€ 7.192.480).

As agreement has been reached on Member States' final operational requirements for the system, the Commission is commencing negotiations with its main development contractor with a view to obtaining precise figures on costing for additional work required to complete the project and to achieving respective contractual coverage. This will enable a detailed budget covering the period until the entry into operations of the system to be presented to the JHA Council by October 2010 at the latest.

Un accord ayant été dégagé au sujet des exigences opérationnelles définitives des États membres pour le système, la Commission a entamé des négociations avec son principal prestataire chargé du développement, afin d'obtenir des chiffres précis sur le coût des travaux supplémentaires nécessaires à l'achèvement du projet, et de conclure les contrats correspondants. During the period covered by the present report penalties of € 390.000, imposed on the main development contractor for failure to accomplish the SIS II Operational System Tests in December 2008, have been offset against payments for other deliverables.

The partnership embodied in the GPMB has been one of the key features of this period. The status of the GPMB has now been formalised with the adoption on 3 June 2010 of the two Council Regulations on migration from the Schengen Information System (SIS 1+) to the second generation Schengen Information System (SIS II), which entered into force on 25 June 2010.

Ce conseil a désormais un statut officiel depuis l'adoption, le 3 juin 2010, de deux règlements du Conseil relatifs à la migration du système d’information Schengen (SIS 1+) vers le système d’information Schengen de deuxième génération (SIS II), qui sont entrés en vigueur le 25 juin 2010.

The informal formation of the GPMB met 21 times during the period covered by this report.

The Commission is assisted in the development of SIS II by the SISVIS Committee. There were five meetings of the SISVIS Committee on SIS II matters in the period January – June 2010.

In addition to regular SISVIS Committee meetings, working groups of the Committee and workshops, involving Member States' experts, are organised to discuss detailed technical issues. These meetings generally focus on issues arising from specific project deliverables:

· The "Test Advisory Group" (TAG), provides the SISVIS Committee with an opinion on issues related to the organisation, implementation and interpretation of tests. This group held seven meetings in this reporting period;

· The "Change Management Board" (CMB), provides advice on classification, qualification and the potential impact of correction of reported issues. This working group, which also reports to the SISVIS Committee, met six times during the reporting period;

· Two SIS II Migration Workshops were held during this period, to advise the SISVIS Committee and pursue activities on this critical topic.

A working group composed of the Member States' and users' national project managers (NPM) is organised within the framework of the SISVIS Committee. The purpose of these NPM meetings is to deal with detailed planning issues, risks and activities both at the central and national project levels. During this reporting period four NPM meetings have taken place.

Un groupe de travail composé des gestionnaires de projet nationaux des États membres et des utilisateurs a été instauré dans le cadre du comité SISVIS. Ses réunions portent sur les questions de planification, les risques et les activités, tant au niveau central qu’au niveau national. Ce groupe de travail s’est réuni quatre fois au cours de la période considérée.

The Commission takes part in the meetings of the preparatory bodies of the Council responsible for the Schengen Information System and each Council of Ministers session where SIS II is included on the agenda. On these occasions, the Commission presented oral reports on the state of play of the SIS II project, the associated risks and the envisaged next steps.

La Commission participe aux réunions des instances préparatoires du Conseil chargées du système d’information Schengen et à toutes les sessions du Conseil des ministres dont l'ordre du jour mentionne le SIS II. À ces occasions, elle présente oralement l’état d’avancement du projet SIS II, les risques qui y sont liés et les prochaines étapes envisagées.

The European Parliament followed developments closely throughout this period. It is also likely that the announcements by the Committee on Budgets "to hold funds allocated to the migration to the SIS II in reserve pending successful testing and a comprehensive audit" will be followed up during the 2011 budget procedure.

Tout au long de la période visée par le présent rapport, le Parlement européen a suivi de près les dernières évolutions. La recommandation faite par la commission des budgets « de verser à la réserve les crédits prévus pour la migration vers le SIS II en attendant que les tests soient concluants et que soit réalisé un audit complet » fera vraisemblablement l'objet d'un suivi durant la procédure budgétaire 2011.

The Commission continued to keep the European Parliament informed on the state of play on SIS II: bilateral meetings with MEPs regularly took place, a letter was sent by Commissioner Malmström to the Chairman of the LIBE Committee of the European Parliament (and to rapporteurs) following each JHA Council in the first semester of 2010. Presentations on the state of play of SIS II have been made in the LIBE Committee, notably on 10 May.

La Commission a continué à informer le Parlement européen de l'avancement du SIS II: des réunions bilatérales avec des députés européens ont régulièrement eu lieu, une lettre a été adressée par Mme Malmström, membre de la Commission, au président de la commission LIBE du Parlement européen (et aux rapporteurs) après chaque Conseil JAI pendant le premier semestre de 2010. L'état d'avancement du SIS II a fait l'objet de présentations à la commission LIBE, notamment le 10 mai.

Finally, the Commission responded to two Parliamentary questions relating to SIS II.

4. Priorities for the next reporting period

· Finalisation of negotiations with the main development contractor with a view to ensuring contractual coverage for the refined requirements;

· Preparation of a comprehensive global schedule and a detailed budget for the completion of the project (taking account of the above-mentioned contractual negotiations) by the October JHA Council at the latest;

- Élaboration d'un calendrier global complet et d'un budget détaillé pour l'achèvement du projet (eu égard aux négociations contractuelles susmentionnées) avant le Conseil JAI d'octobre au plus tard.

· Implementation of the final requirements for entry into operation agreed by the Member States;

- Mise en œuvre des exigences définitives approuvées par les États membres pour la mise en service.

· Development of the test campaign for the refined requirements;

- Élaboration de la campagne d'essais pour les exigences «affinées».

· Preparations for entry into operation;

· Continuation of work to prepare for operational management, including follow-up of negotiations on the IT agency package and internal preparations for the establishment of this agency.

5. Conclusions

During this reporting period there were a number of key points which moved the project in a positive direction. It was mainly the successful outcome to the first milestone test which allowed progress to be made in a number of fields, not least the confirmation, in the JHA Council on 23 April that the development of SIS II will continue on the basis of the current SIS II project. This was supported on 3 June by the adoption of the two Regulations amending the deadline for entry into operation. In addition, some long-standing issues such as the security of data passing through the network operations centre were moved forward. The visit to this centre succeeded in demonstrating to Member States' experts the extensive risk mitigation measures in place.

Pendant la période faisant l'objet du présent rapport, plusieurs éléments clés ont fait évoluer favorablement le projet. Ce sont essentiellement les résultats probants des essais définis pour la première étape qui ont permis des avancées dans plusieurs domaines, et en particulier la confirmation, au Conseil JAI du 23 avril, que le développement du SIS II se poursuivra sur la base du projet SIS II actuel. Cette décision a été confortée par l'adoption, le 3 juin, de deux règlements modifiant le délai de la mise en service. Par ailleurs, des questions anciennes, telles que la sécurité des données transitant par le centre opérationnel du réseau, ont progressé. La visite de ce centre a été l'occasion de montrer aux experts nationaux le large éventail de mesures mises en place pour atténuer les risques.

Furthermore, the Council invited the Commission, together with the Member States, to swiftly finalise the system requirements for the entry into operation of SIS II. This reporting period saw intensive, fruitful cooperation, within a constructive atmosphere, where experts from the Commission and Member States refined the requirements for the entry into operation. Much of the detailed discussion for this exercise took place in the Global Programme Management Board which was formalised within the above-mentioned Regulations.

En outre, le Conseil a invité la Commission et les États membres à arrêter rapidement les exigences relatives au système en vue de la mise en service de ce dernier. La période de référence du rapport a été marquée par une coopération intense et fructueuse, dans un climat constructif, qui a permis aux experts de la Commission et des États membres d'affiner les exigences pour la mise en service. The updating of the requirements is intended to make progress towards the entry into operation of SIS II, including the integration of the second milestone test into the set of tests defined to streamline the development of the SIS II project.

L'actualisation des exigences vise à progresser vers la mise en service du SIS II, et notamment l'intégration des essais de la deuxième étape dans la série d'essais définie pour rationaliser le développement du projet SIS II.

The JHA Council also requested a new global schedule and detailed budget estimate. At the June Council, the Commission pointed out that detailed negotiations with the main contractor would be pursued throughout the summer in order to seek to incorporate the refined requirements into the project contract. The outcome of this process can be expected for the JHA Council meeting in October 2010.

Le Conseil JAI a également demandé l'établissement d'un nouveau calendrier global et d'une estimation budgétaire détaillée. Au Conseil de juin, la Commission a souligné que des négociations approfondies avec le prestataire principal se poursuivraient pendant tout l'été pour tenter d'intégrer les exigences «affinées» dans le contrat relatif au projet. Les résultats de ce processus devraient être disponibles pour le Conseil JAI d'octobre 2010.

[7] Le SIS II central et les systèmes VIS se trouvent physiquement à Strasbourg tandis que le site de secours est installé à proximité de Salzbourg en Autriche. Conformément aux instruments juridiques relatifs au SIS II, avant la période visée dans le présent rapport, la Commission avait déjà conclu des contrats de services concernant les infrastructures, le recrutement et la formation, afin de déléguer aux autorités françaises les tâches relatives à la gestion opérationnelle.

[7] The central SIS II and VIS systems are physically located in Strasbourg with a back-up site close to Salzburg in Austria. In accordance with the SIS II legal instruments, prior to this reporting period, the Commission had already concluded service contracts on infrastructure, recruitment and training, with a view to delegating operational management tasks to the French authorities.
