1. INTRODUCTION

This progress report describes the work carried out in the second semester of 2009, concerning the development of the second generation Schengen Information System (SIS II) and the migration from SIS 1+ to SIS II. It is presented to the Council and the European Parliament in accordance with Article 18 of Council Regulation (EC) No 1104/2008 and of Council Decision 2008/839/JHA on migration from the Schengen Information System (SIS 1+) to the SIS II. This report also constitutes a test status report.

Le présent rapport décrit les travaux réalisés durant le second semestre de 2009 concernant le développement du système d’information Schengen de deuxième génération (SIS II) et la migration du SIS 1+ vers le SIS II. Il est présenté au Conseil et au Parlement européen conformément à l’article 18 du règlement (CE) n° 1104/2008 du Conseil et de la décision 2008/839/JAI du Conseil relatifs à la migration du système d’information Schengen (SIS 1+) vers le système d’information Schengen deuxième génération (SIS II). This period was dominated by implementing the orientations provided in the Conclusions of the Justice and Home Affairs Council of 4-5 June and 30 November 2009 respectively.

La période considérée ici a été dominée par la mise en œuvre des orientations définies dans les conclusions du Conseil «Justice et affaires intérieures» des 4 et 5 juin 2009 et du 30 novembre 2009 respectivement.

The Council concluded, on 4-5 June, that the development of SIS II would continue on the basis of the current SIS II project by the main development contractor, and that an alternative technical solution to achieve SIS II (named "SIS 1+RE") would be retained as the contingency plan for a period necessary to back the project. The Council also agreed to two project milestones specifying the technical aspects of conditions and exit criteria which would have to be met in order to continue with the current SIS II project. The aim of these milestones would be to prove the stability, reliability and performance of the central SIS II and the proper functioning of vital core functionalities, such as data consistency and reliable message transfer, after significant and important development phases of the SIS II project. The related tests would start as soon as the Commission and the Member States had declared their readiness and the technical support function in Strasbourg (C.SIS) had confirmed that the SIS 1+ test tools were qualified and ready.

Les 4 et 5 juin, le Conseil a conclu que le développement du SIS II se poursuivrait sur la base de l’actuel projet SIS II, avec le principal prestataire chargé du développement, et qu'une solution technique de rechange pour réaliser le SIS II (appelée «SIS 1+ RE») serait conservée comme plan de secours pendant le temps nécessaire pour soutenir le projet. Il a également approuvé les deux étapes du projet précisant les aspects techniques des conditions et les critères de sortie qui devaient être remplis pour pouvoir poursuivre l'actuel projet SIS II. Ces deux étapes auraient pour objectif de démontrer la stabilité, la fiabilité et la performance du SIS II central, ainsi que le bon fonctionnement des fonctionnalités essentielles, telles que la cohérence des données et un transfert de messages fiable, après les phases de développement significatives et importantes du projet SIS II. Les essais prévus dans le cadre de ces étapes débuteraient dès que la Commission et les États membres se déclareraient prêts et que la fonction de support technique à Strasbourg (C.SIS) confirmerait que les outils d’essai du SIS 1+ répondent aux conditions requises et sont prêts.

The first milestone was scheduled to occur after the performance tests of the system, foreseen for the fourth quarter of 2009. However, the Council of 30 November concluded that the final deadline with regard to the accomplishment of the first milestone test would be 29 January 2010 at the latest. Subject to the outcome of the first milestone test, a two month period of reflection for the Council would commence on 30 January 2010, to assess the implications of the test.

La première étape était prévue après les essais de performance du système, fixés au quatrième trimestre 2009. Le Conseil a toutefois conclu, le 30 novembre, que le dernier report pour la réalisation des essais de la première étape serait fixé au 29 janvier 2010 au plus tard. En fonction des résultats de ces essais, le Conseil entamerait une période de réflexion de deux mois, débutant le 30 janvier 2010, pour apprécier les implications des essais.

The Commission, in close cooperation with the Member States, put in place the necessary elements to follow the direction set in the Council Conclusions. Accordingly work was directed along three major tracks:

Technical preparations were initiated for the first of the two milestone tests, with a view to verifying whether the system is based on solid foundations. The technical preparations aimed, in particular, to ensure that all prior conditions for carrying out this test had been met (conformity of national systems that would participate in the test, generation of test data, validation of test tools, adjustments to the settings of the central system and setting up the detailed test descriptions). By the end of 2009 eleven Member States had achieved a state of compliance and the SIS 1+ test tools were qualified and ready.

Les préparatifs techniques des essais de la première des deux étapes ont débuté, afin de vérifier la solidité des fondements du système. Ils visaient en particulier à s'assurer que toutes les conditions préalables à la réalisation de ces essais étaient réunies (conformité des systèmes nationaux participant aux essais, production de données d'essai, validation des outils d'essai, ajustements des réglages du système central et élaboration de descriptions précises des essais). À la fin de l'année 2009, onze États membres avaient atteint l'état de conformité demandé et les outils d'essai du SIS 1+ répondaient aux conditions requises et étaient prêts.

The Council in June also invited the Commission to ensure that the milestones would be part of the deliverables under the contract for the current SIS II project and to reach an understanding with its contractors that non-compliance with these milestones would constitute resolutive conditions with regard to the existing contracts. The respective contract amendment for the first milestone was signed between the parties on 13 October. This amendment notably incorporated a provision stating that the Commission would be entitled to terminate the contract, as of right, with immediate effect if the first milestone test for SIS II were deemed by the Council not to have been passed.

En juin, le Conseil a également invité la Commission à veiller à ce que les étapes fassent partie des résultats à atteindre dans le cadre du contrat relatif à l'actuel projet SIS II et à s'entendre avec ses contractants sur le fait que le non-respect de ces étapes constituerait une condition résolutoire pour les contrats existants. Le 13 octobre, les parties ont signé l'avenant au contrat relatif à la première étape. Cet avenant a notamment introduit une clause stipulant que la Commission pourrait résilier le contrat, de plein droit et avec effet immédiat, si le Conseil devait estimer que les essais du SIS II prévus dans le cadre de la première étape ont échoué.

In order to prepare the ground for a possible switch to an alternative technical scenario for implementing the SIS II functionalities, should one of the milestones be judged to have failed, exploratory negotiations with the French authorities were commenced.
|
Afin de préparer la voie à un éventuel recours à un scénario technique de rechange pour la mise en œuvre des fonctionnalités du SIS II, dans l'hypothèse où l'une des étapes serait jugée non concluante, des négociations exploratoires ont été entamées avec les autorités françaises.

A key element of any delegation to France would concern the adoption of the legislative proposals to amend the migration instruments (proposal for a Regulation [1] and a forthcoming proposal to incorporate aspects previously covered by the third pillar decision - see section 2.5.1.).
|
Toute délégation à la France impliquerait d'adopter les propositions législatives modifiant les instruments relatifs à la migration (la proposition de règlement[1] et une proposition à venir visant à incorporer les aspects précédemment couverts par la décision relevant du troisième pilier – voir le point 2.5.1.).

The comprehensive architecture review performed by a specialist IT consultant between March and April 2009 led to a broad consensus amongst SIS II experts on the absence of major flaws in the SIS II architecture. However, in terms of design and implementation, a number of recommendations were made to improve certain aspects of the system, such as performance, software scalability and ease of maintenance. The business message architecture was identified as being over-engineered and capable of simplification. The analysis and repair period, highlighted in the previous report, identified a number of areas for improvement in the system.

À la suite de l'examen détaillé de l'architecture du SIS II effectué par un consultant en informatique en mars et avril 2009, les experts du SIS II ont, dans leur majorité, estimé que cette architecture ne présentait aucune faille majeure. Cependant, en ce qui concerne la conception et la mise en œuvre, plusieurs recommandations ont été formulées pour améliorer certains aspects du système, tels que la performance, l’extensibilité du logiciel et la facilité de maintenance. L’architecture de la messagerie opérationnelle a été jugée trop complexe et susceptible d'être simplifiée. La période d'analyse et de réparation, examinée dans le rapport précédent, a permis de recenser plusieurs domaines dans lesquels le système est perfectible.

In parallel to the preparations for the first milestone test, the Commission, Member States' experts and contractors worked together on assessing the technical requirements for ultimately delivering the software version which would be used in a "live" system. This work was undertaken through studies, workshops, prototypes ("proofs of concept") and discussion in the Global Programme Management Board (GPMB) [2]. The latter structure was established by the Commission to ensure enhanced management and coordination of the SIS II project and related activities, including ensuring consistency between the development of central and national systems.
|
Parallèlement aux préparatifs des essais prévus dans le cadre de la première étape, la Commission, les experts des États membres et les prestataires ont évalué ensemble les exigences techniques que comporte la livraison finale de la version du logiciel qui serait utilisée dans un système opérationnel. Ces travaux ont consisté en des études, des ateliers, des prototypes («validations de concept») et des débats au sein du conseil de gestion globale du programme (CGGP)[2]. La Commission a institué ce conseil pour assurer une meilleure gestion et coordination du projet SIS II et des activités connexes, et notamment veiller à la cohérence du développement des systèmes centraux et nationaux.

The Commission, working with Member States and the main development contractor, commenced several initiatives, with a view to producing enhanced specifications for the system. Particular areas investigated in-depth were:

En collaboration avec les États membres et le principal prestataire chargé du développement, la Commission a lancé plusieurs initiatives afin d'améliorer les spécifications pour le système. Les domaines ayant fait l'objet d'un examen approfondi sont les suivants:

· Simplification of the way in which large volumes of data are "dumped" (for example when a Member State might need to recreate a copy of the central database at national level)
|

· Simplification of the data-consistency processes;

· Re-structuring of the message format;

· Rationalisation of the functions for creation, updating and deletion of records at the point where they would be entered into the central system so that the processes take place in parallel and therefore in a more time-effective manner;

- la rationalisation des fonctions permettant de créer, d'actualiser et d'effacer des données au point auquel elles seraient saisies dans le système central de manière à ce que les processus se déroulent parallèlement et, partant, plus rapidement;

· Harmonisation of the processes and procedures for handling different versions of the system.

In December 2009, the main development contractor delivered four draft whitepapers on the final four items in the above-mentioned list. Further discussions with Member States on certain non-functional requirements would be needed before this work could be finalised.

En décembre 2009, le principal prestataire chargé du développement a transmis quatre projets de livres blancs concernant les quatre derniers éléments de l'énumération ci-dessus. Des discussions supplémentaires avec les États membres au sujet de certaines exigences non fonctionnelles seront nécessaires avant de pouvoir finaliser ces travaux.

Additionally, developments in the use of the SIS by Member States have led to a situation where the number of alerts within the system has increased significantly. From the 22 million alerts originally foreseen, the latest estimates predict 73 million alerts in the foreseeable future. Having carried out an additional survey on volumetrics between June and September there would be a need for the Commission to continue to work with Member States' experts on this important evolution of requirements which must be accommodated in any technical solution.

Par ailleurs, l'évolution de l'utilisation du SIS par les États membres a entraîné une hausse sensible du nombre de signalements dans le système. Si le nombre de signalements prévus à l'origine s'établissait à 22 millions, les dernières estimations prévoient qu'il atteindra 73 millions dans un avenir prévisible. Compte tenu d'une étude supplémentaire sur le volume des transferts réalisée entre juin et septembre, il conviendrait que la Commission poursuive ses travaux avec les experts nationaux concernant cette évolution importante des exigences à remplir quelle que soit la solution technique retenue.

The Council Regulation [3] and Council Decision [4] governing migration to from SIS 1+ to SIS II (the migration instruments) lay down the tasks and responsibilities of the Commission and the Member States for preparing this migration, including further development and testing of SIS II. As the legal instruments currently in force contain an expiry date set for 30 June 2010, the Commission has tabled proposals to amend them, chiefly with a view to extending the deadline for transferring data from SIS 1+ to SIS II.

Le règlement[3] et la décision[4] du Conseil régissant la migration du SIS 1+ vers le SIS II (les instruments relatifs à la migration) définissent les tâches et responsabilités de la Commission et des États membres dans les préparatifs de cette migration, y compris la poursuite du développement du SIS II et les essais de celui-ci. La date d'expiration des instruments juridiques en vigueur étant fixée au 30 juin 2010, la Commission a présenté des propositions visant à ces textes, essentiellement afin de prolonger le délai de transfert des données du SIS 1+ vers le SIS II.

Whilst negotiations continued on a legislative proposal for a Regulation [5], the proposal to amend the Council Decision under the former third pillar became obsolete upon the entry into force of the Lisbon Treaty. The Commission intends to introduce a proposal in the appropriate procedural form during 2010.

Tandis que les négociations se poursuivaient au sujet d'une proposition de règlement[5], la proposition qui visait à modifier la décision du Conseil relevant de l'ancien troisième pilier est devenue caduque à l'entrée en vigueur du traité de Lisbonne. Together, these proposals also aim to formally set up a coordinating body of technical experts for further management of the overall development of SIS II, as requested by the JHA Council of 4-5 June 2009, and to provide legal flexibility for an alternative technical scenario, in line with the Council's approach of retaining a contingency plan for the project.

Ces deux propositions ont également pour objet de créer officiellement un organe de coordination composé d'experts aux fins de la gestion ultérieure du développement global du SIS II, ainsi que le demandait le Conseil JAI des 4 et 5 juin 2009, et d'offrir la souplesse juridique nécessaire à un scénario technique de rechange, conformément à l'approche du Conseil consistant à conserver un plan de secours pour le projet.

The SIS II project includes the provision of a wide area communications network, meeting the requirements of availability, security, geographical coverage and level of service, to enable the national and central systems to communicate.

Le projet SIS II prévoit la fourniture d’un réseau étendu de communications satisfaisant aux exigences de disponibilité, de sécurité, de couverture géographique et de niveau de service, permettant à l’ensemble des systèmes nationaux et centraux de communiquer.

The staff of the European Data Protection Supervisor (EDPS) conducted an inspection at the SOC (network operation centre) in Bratislava. The inspection showed that from an overall perspective the situation is satisfactory. EDPS is likely to present some recommendations to further improve security at the SOC as well as to ensure better compliance with data protection provisions, for instance by declaring the use of video monitoring systems.
|
Des agents du Contrôleur européen de la protection des données (CEPD) ont effectué une inspection au SOC (centre opérationnel du réseau) de Bratislava, qui a révélé que la situation était satisfaisante d'un point de vue général. Le CEPD formulera vraisemblablement quelques recommandations pour améliorer encore la sécurité du SOC et assurer un meilleur respect des dispositions en matière de protection des données, par exemple en déclarant l'utilisation de systèmes de vidéosurveillance.

A workshop has been held with Member States on additional security safeguards to the system. Member States will be further consulted on this matter by questionnaire in order to identify any key actions that need to be considered.

Un atelier consacré à des dispositifs de sécurité complémentaires pour le système a été organisé avec les États membres. Ces derniers seront encore consultés sur cette question au moyen d'un questionnaire, afin de recenser toute mesure essentielle à envisager.

The training of the staff recruited in Strasbourg to operate the system has almost been completed. The Biometric Matching System "transition to operation" plan has started and the staff in Strasbourg are now practically ready to operate the Biometric Matching System.

La formation du personnel recruté à Strasbourg pour faire fonctionner le système est presque terminée. Le programme de «transition vers la mise en service» établi pour le système d’établissement de correspondances biométriques ( Biometric Matching System ) a démarré et le personnel de Strasbourg est pratiquement prêt à faire fonctionner ce dernier.

Negotiations are under way in the preparatory bodies of the Council and in the Parliament on the legal proposals for setting up an agency for the long-term operational management of large-scale IT systems in the area of justice, freedom and security, including SIS II.

Des négociations sont en cours au sein des instances préparatoires du Conseil et du Parlement au sujet des propositions législatives créant une agence chargée de la gestion opérationnelle à long terme des systèmes d'information à grande échelle dans le domaine de la justice, de la liberté et de la sécurité, parmi lesquels figure le SIS II.

In addition to the network security issue mentioned in section 2.6 above, bilateral meetings between EDPS staff and the Commission services continued to take place on a regular basis to discuss security and data protection issues related to SIS II. On 1 December 2009, EDPS staff made a fact-finding visit to the central SIS II site in Strasbourg. The visit focussed on physical security.
|
Outre la question de la sécurité du réseau mentionnée au point 2.6 ci-dessus, des questions de sécurité et de protection des données touchant au SIS II ont été examinées au cours de réunions bilatérales entre le personnel du CEPD et les services de la Commission, organisées à intervalles réguliers. Le 1er décembre 2009, des agents du CEPD ont effectué une mission d'enquête, axée sur la sécurité matérielle, sur le site du SIS II central à Strasbourg.

By the end of the reporting period the total budgetary commitments made by the Commission on the SIS II project amounted to approximately € 81.6 million. The corresponding contracts include feasibility studies, the development of the central SIS II itself, support and quality assurance, the SIS II network, preparation for operational management in Strasbourg, security, biometrics preparations and communication.
|
À la fin de la période examinée dans le présent rapport, les engagements budgétaires réalisés par la Commission pour le projet SIS II se montaient au total à quelque 81,6 millions d'EUR. Les contrats correspondants portent sur des études de faisabilité, le développement du SIS II central lui-même, les services d’appui et d’assurance qualité, le réseau SIS II, la préparation de la gestion opérationnelle à Strasbourg, la sécurité, les préparatifs en matière de biométrie et la communication.

Of this amount, around € 50.2 million had actually been paid at the end of December 2009. The main expenditure items were development (€ 24.3 million), the network (€ 14.6 million) and support and quality assurance (€ 6.3 million).

De ce montant, environ 50,2 millions d'EUR avaient effectivement été versés à la fin du mois de décembre 2009. Les principaux postes de dépenses concernaient le développement (24,3 millions d'EUR), le réseau (14,6 millions d'EUR) et les services d’appui et d’assurance qualité (6,3 millions d'EUR).

In order to ensure optimal involvement of the Member States, as the project moved into a new phase, a global SIS II programme management approach was introduced in January 2009, as recognised by the Council on 26-27 February. The Council of 4-5 June invited the Commission to build upon the experience and lessons learned from this management structure and develop it further. These management changes have been consolidated in the legislative proposal for a Regulation to amend the migration instruments.
|
Pour assurer une participation optimale des États membres à un moment où le projet entamait une nouvelle étape, une méthode de gestion globale du programme SIS II a été introduite en janvier 2009, ainsi que le Conseil des 26 et 27 février l'a constaté. Le Conseil des 4 et 5 juin a invité la Commission à s’inspirer de l’expérience et des enseignements tirés de cette structure de gestion et à approfondir celle-ci. The GPMB met 22 times during the period covered by this report. This board has contributed in a positive way to programme management and has ensured increased Member States' involvement.

The Commission is assisted in the development of SIS II by the SISVIS Committee. There were five meetings of the SISVIS Committee on SIS II matters in the period July – December 2009.

In addition to regular SISVIS Committee meetings, working groups of the Committee and workshops, involving Member States' experts, are organised to discuss detailed technical issues. These meetings generally focus on issues arising from specific project deliverables:

– The "Test Advisory Group" (TAG), provides the SISVIS Committee with an opinion on issues related to the organisation, implementation and interpretation of tests. This group held 23 meetings in this reporting period;

A working group composed of the Member States' and users' national project managers (NPM) is organised within the framework of the SISVIS Committee. The purpose of these NPM meetings is to deal with detailed planning issues, risks and activities both at the central and national project levels. During this reporting period four NPM meetings have taken place.

Un groupe de travail composé des gestionnaires de projet nationaux des États membres et des utilisateurs a été instauré dans le cadre du comité SISVIS. The Commission takes part in the meetings of the preparatory bodies of the Council responsible for the Schengen Information System and each Council of Ministers session where SIS II is included on the agenda. On these occasions, the Commission presented oral reports on the state of play of the SIS II project, the associated risks and the envisaged next steps.

All important developments in the SIS II file have been communicated by a letter from Vice-President Barrot to the Chairman of the LIBE Committee and the key rapporteurs. During the period of this report four such letters were sent.

Members of the European Parliament were debriefed by Vice-President Barrot in person each time deliberations on SIS II were held at the Council meetings. Two JHA Council meetings discussed SIS II during this period.

Moreover, the Commission appeared at all Plenary and Committee meetings, to directly address SIS II-related matters: a total of four meetings plus the meeting of the Vice President with the coordinators of the political groups of the LIBE Committee.

The Commission also attended the Parliamentary session and took due note of the resolution of the European Parliament of 22 October 2009 on progress of Schengen Information System II and Visa Information System. The Vice-President followed this up with a letter to the chairman of the LIBE Committee.

4. Priorities for the next reporting period

During this period work was focussed on activities to follow up the orientations provided by the Conclusions of the Justice and Home Affairs Council in June and November 2009 respectively.

The Commission agreed with other stakeholders that the milestone tests requested by the Council in June would provide an indication as to the stability, reliability and performance of the central system. The outcome of these tests would constitute an important element in discussions on the future direction of SIS II.

La Commission a convenu avec les parties prenantes que les essais prévus dans le cadre des étapes, demandés par le Conseil en juin, fourniraient des indications sur la stabilité, la fiabilité et la performance du système central. Les résultats de ces essais constitueront un élément important des discussions relatives à l'orientation future du SIS II.

The Commission has worked in close partnership with the Member States to implement the above-mentioned conclusions and has kept the European Parliament informed of developments. In particular, the Commission has ensured that the legal, technical, organisational and contractual elements have been fully put in place to allow the main development contractor to run the first milestone test under positive conditions. In line with the orientations of the Council in June, the Commission integrated the first milestone into the main development contract.

La Commission a collaboré étroitement avec les États membres pour mettre en œuvre les conclusions susmentionnées et a tenu le Parlement européen informé des dernières évolutions. Elle a notamment veillé à ce que les volets juridiques, techniques, organisationnels et contractuels soient intégralement mis en place pour permettre au principal prestataire chargé du développement de procéder, dans de bonnes conditions, aux essais prévus pour la première étape. Conformément aux orientations définies en juin par le Conseil, la Commission a inclus la première étape dans le principal contrat de développement.

The Council, at its meeting on 30 November, set 29 January 2010 as a deadline for the accomplishment of the first milestone test. A sufficient number of Member States were able to demonstrate their compliance for taking part in this test.
|
Lors de sa session du 30 novembre, le Conseil a fixé au 29 janvier 2010 le délai d'achèvement des essais prévus dans le cadre de la première étape. Un nombre suffisant d'États membres ont pu démontrer la conformité requise pour prendre part à ces essais.

If the first milestone test proves unsuccessful, the Commission agreed that it would support the Council in its reflection process on the further direction of SIS II by providing, in written form, the necessary financial and budgetary information.

Si les essais de la première étape ne s'avèrent pas concluants, la Commission a accepté de contribuer au processus de réflexion du Conseil concernant l'orientation future du SIS II, en lui fournissant par écrit les informations financières et budgétaires nécessaires.

Exploratory negotiations with the French authorities were commenced for a possible decision by the Commission to discontinue the current SIS II project and proceed on the basis of an alternative technical scenario for implementing the SIS II functionalities, should one of the milestones be judged by the Council to have failed.

Des négociations exploratoires ont été entamées avec les autorités françaises pour anticiper une éventuelle décision de la Commission d'interrompre l'actuel projet SIS II et de poursuivre la mise en œuvre des fonctionnalités du SIS II sur la base d'un scénario technique de rechange, dans l'hypothèse où l'une des étapes serait jugée non concluante par le Conseil.

In addition, during the period covered by this report, the Commission organised the necessary work to allow extensive analysis, together with the experts of the Member States, of the technical specifications of SIS II, in order to be able to guide decisions for the future.
