Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community [1], and in particular Article 15(1) thereof,

Whereas:

(1) Under Directive 2000/29/EC, plants of Vitis L., other than fruits, originating in third countries in principle are not to be introduced into the Community.

(2) Slovenia has requested a derogation to permit imports of plants of Vitis L., other than fruits, from Croatia or the former Yugoslav Republic of Macedonia for a limited period of time in order to enable specialised nurseries to multiply these plants in the Community before re-exporting them to Croatia or the former Yugoslav Republic of Macedonia.

(2) La Slovénie a sollicité une dérogation de manière à pouvoir autoriser l’importation de végétaux de Vitis L., à l’exception des fruits, en provenance de Croatie ou de l’ancienne République yougoslave de Macédoine pour une période limitée, afin de permettre aux pépinières spécialisées de multiplier ces végétaux dans la Communauté avant de les réexporter vers la Croatie ou l’ancienne République yougoslave de Macédoine.

(3) The Commission considers that there is no risk of spreading harmful organisms to plants or plant products provided that plants of Vitis L., other than fruits originating in Croatia or the former Yugoslav Republic of Macedonia are subject to the specific conditions laid down in this Decision.

(3) La Commission considère qu’il n’y a aucun risque de propagation d’organismes nuisibles pour les végétaux ou les produits végétaux si les végétaux de Vitis L., à l’exception des fruits, originaires de Croatie ou de l’ancienne République yougoslave de Macédoine, sont soumis aux conditions spécifiques fixées dans la présente décision.

(4) Member States should therefore for a limited period be authorised to permit the introduction into their territory of such plants subject to specific conditions.

(4) Il y a lieu en conséquence d’autoriser les États membres, pendant une période limitée, à permettre l’introduction sur leur territoire de tels végétaux sous réserve de conditions spécifiques.

(5) That authorisation should be terminated if it is established that the specific conditions laid down in this Decision are not sufficient to prevent the introduction of harmful organisms into the Community or have not been complied with.

(5) L’autorisation prendra fin s’il est établi que les conditions spécifiques énoncées dans la présente décision ne sont pas suffisantes pour prévenir l’introduction d’organismes nuisibles dans la Communauté ou qu’elles n’ont pas été respectées.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plant Health,

HAS ADOPTED THIS DECISION:

Article 1

Article premier

By way of derogation from Article 4(1) of Directive 2000/29/EC with regard to point 15 of Part A of Annex III to that Directive, Member States shall be authorised to permit the introduction into their territory of plants of Vitis L., other than fruits, intended for grafting in the Community and originating in Croatia or the former Yugoslav Republic of Macedonia (hereinafter referred to as the plants).

Par dérogation à l’article 4, paragraphe 1, de la directive 2000/29/CE en ce qui concerne l’annexe III, partie A, point 15, de ladite directive, les États membres sont autorisés à permettre l’introduction sur leur territoire de végétaux de Vitis L., à l’exception des fruits, destinés au greffage dans la Communauté et originaires de Croatie ou de l’ancienne République yougoslave de Macédoine (ci-après "les végétaux").

In order to qualify for that derogation, the plants shall be subject, in addition to the requirements laid down in Annexes I and II to Directive 2000/29/EC, to the conditions provided for in the Annex to this Decision.

Pour pouvoir bénéficier de la dérogation, les végétaux doivent remplir, outre les exigences fixées dans les annexes I et II de la directive 2000/29/CE, les conditions définies à l’annexe de la présente décision.

In order to qualify for that derogation, the plants shall be introduced into the Community, in the following periods:

Pour pouvoir bénéficier de la dérogation, les végétaux doivent être introduits dans la Communauté pendant les périodes suivantes:

(a) between 1 January 2008 and 30 April 2008;

a) entre le 1er janvier 2008 et le 30 avril 2008;

(b) between 1 January 2009 and 30 April 2009;

b) entre le 1er janvier 2009 et le 30 avril 2009;

c) entre le 1er janvier 2010 et le 30 avril 2010.

Article 2

1. Member States which make use of the derogation provided for in Article 1 shall provide the Commission and the other Member States with:

(a) the information on the quantities of plants imported pursuant to this Decision; and

a) les informations concernant les quantités de végétaux importées au titre de la présente décision; ainsi que

(b) a detailed technical report on the official inspections referred to in point 6 of the Annex.

That information and that report shall be provided as regards introductions covered by Article 1(a) by 15 November 2008 at the latest, as regards introductions covered by Article 1(b) by 15 November 2009 at the latest, and as regards introductions covered by Article 1(c) by 15 November 2010 at the latest.

Ces informations et ce rapport doivent être fournis le 15 novembre 2008 au plus tard pour les introductions visées au point a) de l’article 1er, le 15 novembre 2009 au plus tard pour les introductions visées au point b) de l’article 1er, et le 15 novembre 2010 au plus tard pour les introductions visées au point c) de l’article 1er.

2. Any Member State in which the plants are subsequently grafted after their introduction into its territory shall also provide the Commission and the other Member States with a detailed technical report of the official inspections and testing referred to in point 8(b) of the Annex.

2. Tout État membre dans lequel les végétaux sont greffés après leur introduction sur son territoire transmet également à la Commission et aux autres États membres un rapport technique détaillé des inspections et tests officiels visés au point 8 b) de l’annexe.

That report shall be provided as regards introductions covered by Article 1(a) by 15 November 2008 at the latest, as regards introductions covered by Article 1(b) by 15 November 2009 at the latest, and as regards introductions covered by Article 1(c) by 15 November 2010 at the latest.

Ce rapport doit être fourni le 15 novembre 2008 au plus tard pour les introductions visées au point a) de l’article 1er, le 15 novembre 2009 au plus tard pour les introductions visées au point b) de l’article 1er, et le 15 novembre 2010 au plus tard pour les introductions visées au point c) de l’article 1er.

Article 3

Member States shall immediately notify the Commission and the other Member States of all consignments introduced into their territory pursuant to this Decision, which were subsequently found not to comply with this Decision.

Les États membres notifient immédiatement à la Commission et aux autres États membres tous les cas de lots introduits sur leur territoire au titre de la présente décision qui, par la suite, se sont révélés non conformes aux conditions qui y sont énoncées.

This Decision is addressed to the Member States.

SPECIFIC CONDITIONS APPLYING TO PLANTS OF VITIS L., OTHER THAN FRUITS, ORIGINATING IN CROATIA OR THE FORMER YUGOSLAV REPUBLIC OF MACEDONIA BENEFITING FROM THE DEROGATION PROVIDED FOR IN ARTICLE 1

CONDITIONS SPÉCIFIQUES S’APPLIQUANT AUX VÉGÉTAUX DE VITIS L., À L’EXCEPTION DES FRUITS, ORIGINAIRES DE CROATIE OU DE L’ANCIENNE RÉPUBLIQUE YOUGOSLAVE DE MACÉDOINE, BÉNÉFICIANT DE LA DÉROGATION PRÉVUE À L’ARTICLE 1er

1. The plants shall be propagating material in the form of dormant buds of the varieties Babić, Borgonja, Dišeča belina, Graševina, Grk, Hrvatica, Kraljevina, Malvasija dubrovačka, Malvazija (syn. Malvazija istarska bijela), Maraština, Muškat momjanski (syn. Muškat istarski), Muškat ruža porečki, Plavac mali, Plavac veliki, Plavka (syn. Plavina), Pošip, Škrlet, Teran, Trnjak,, Vugava or Žlahtina, in case of introduction from Croatia, or Aleksandriski muškat, Alikant buse, Belan, Belo zimsko, Beogradska bessemena, Demir kapija, Grenaš crn, Kadarka, Krainski bojadiser, Kratošija, Moldavija, Ohridsko crno, Plavec mal, Plovdina, Prokupec, R’kaciteli, Semijon, Smederevka, Stanušina, Sultanina, Temjanika, Teran, Vranec, Župljanka or Žilavka, in case of introduction from the former Yugoslav Republic of Macedonia, that shall be:

(a) intended to be grafted in the Community at the premises referred to in point 7, onto rootstocks produced in the Community;

a) destinés à être greffés dans la Communauté, dans les lieux visés au point 7, sur des porte-greffes produits dans la Communauté;

(b) harvested in stock nurseries, which are officially registered in Croatia or the former Yugoslav Republic of Macedonia. Member States making use of this derogation shall make the lists of the registered nurseries available to the Commission and to the other Member States, at the latest by 31 December of the year preceding the introduction of the plants into the Community. These lists shall include the name of the variety, the number of rows planted with this variety, the number of plants per row for each of these nurseries, as far as they are deemed suitable for dispatch to the Community in 2008, 2009 or 2010 under the conditions laid down in this Decision;

b) récoltés dans des pépinières officiellement enregistrées en Croatie ou dans l’ancienne République yougoslave de Macédoine. Les États membres faisant usage de cette dérogation mettent les listes des pépinières enregistrées à la disposition de la Commission et des autres États membres, au plus tard le 31 décembre de l’année précédant l’introduction des plantes dans la Communauté. Ces listes comportent le nom de la variété, le nombre de rangées plantées dans cette variété, le nombre de plants par rangée pour chacune de ces pépinières, dans la mesure où ces plants sont considérés comme prêts à être expédiés vers la Communauté en 2008, en 2009 ou en 2010, dans le respect des conditions définies dans la présente décision;

(c) properly packed and the packaging made recognisable with a marking, enabling the identification of the registered nursery and the variety.

2. The plants shall be accompanied by a phytosanitary certificate issued in Croatia or the former Yugoslav Republic of Macedonia in accordance with Article 13(1) of Directive 2000/29/EC, on the basis of the examination laid down therein, confirming, in particular, freedom from the following harmful organisms:

Les végétaux sont accompagnés d’un certificat phytosanitaire délivré en Croatie ou dans l’ancienne République yougoslave de Macédoine, conformément à l’article 13, paragraphe 1, de la directive 2000/29/CE, sur la base des résultats de l’examen qui y est prescrit, et certifiant notamment que les végétaux sont indemnes des organismes nuisibles suivants:

Daktulosphaira vitifoliae (Fitch)

Xylophilus ampelinus (Panagopoulos) Willems et al.

Grapevine Flavescence dorée

Xylella fastidiosa (Well et Raju)

Trechispora brinkmannii (Bresad.) Rogers

Tobacco ringspot virus

Tomato ringspot virus

Blueberry leaf mottle virus

Peach rosette mosaic virus

The certificate shall state under "Additional Declaration", the indication "This consignment meets the conditions laid down in Decision 2007/847/EC".

Le certificat porte, sous la rubrique "Déclaration supplémentaire", la mention "Le présent lot est conforme aux conditions définies dans la décision 2007/847/CE".

3. The official plant protection organisation of Croatia or the former Yugoslav Republic of Macedonia shall ensure the identity and integrity of the plants from the time of harvesting as referred to in point 1(b) until they are exported to the Community.

3. L’organisation officielle de protection des végétaux de Croatie ou de l’ancienne République yougoslave de Macédoine garantit l’identité et l’intégrité des végétaux à compter du moment de la récolte visée au point 1 b) jusqu’à leur exportation vers la Communauté.

4. The plants shall be introduced through points of entry designated for the purpose by the Member State in which they are situated.

4. Les végétaux doivent être introduits par les points d’entrée indiqués à cette fin par l’État membre dans lequel ils sont situés.

Those points of entry and the name and address of the responsible official body referred to in Directive 2000/29/EC in charge of each point of entry shall be notified sufficiently in advance by the Member State making use of the derogation to the Commission and shall be made available on request to other Member States.

Ces points d’entrée ainsi que le nom et l’adresse de l’organisme officiel responsable, visé dans la directive 2000/29/CE, dont relève chaque point d’entrée, sont notifiés suffisamment à l’avance à la Commission par l’État membre faisant usage de la dérogation et sont mis, sur demande, à la disposition des autres États membres.

Where the introduction of the plants into the Community takes place in a Member State other than the Member State making use of the authorisation referred to in Article 1 (hereinafter referred to as the authorisation), the responsible official bodies of the Member State of introduction shall inform and cooperate with the responsible official bodies of the Member States making use of the authorisation to ensure that this Decision is complied with.

Lorsque l’introduction des végétaux dans la Communauté a lieu dans un État membre autre que l’État membre faisant usage de l’autorisation visée à l’article 1er, ci-après "l’autorisation", les organismes officiels compétents de l’État membre où a lieu cette introduction informent ceux des États membres faisant usage de l’autorisation et coopèrent avec eux pour veiller au respect de la présente décision.

5. Prior to introduction into the Community, the importer shall be officially informed of the conditions laid down in points 1 to 4; the said importer shall notify details of each introduction sufficiently in advance to the responsible official bodies in the Member State of introduction and that Member State, without delay, shall convey the details of the notification to the Commission, indicating:

Avant l’introduction dans la Communauté, l’importateur est informé officiellement des conditions énoncées aux points 1 à 4; il notifie les détails de chaque introduction suffisamment à l’avance aux organismes officiels compétents de l’État membre où les végétaux sont introduits, et ledit État membre transmet immédiatement les détails de la notification à la Commission, en indiquant:

(a) the type of material;

a) le type de matériel;

(b) the variety and the quantity;

b) la variété et la quantité;

c) la date d’introduction déclarée et la confirmation du point d’entrée;

(d) the names, addresses and the locations of the premises referred to in point 7 where the buds will be grafted and stored.

The importer shall inform the official bodies concerned of any changes to the above details as soon as they are known.

The Member State concerned shall inform the Commission of the above details, and details of any change to them without delay.

At least two weeks before the date of introduction the importer shall notify the responsible official body of the premises referred to in point 7 where the plants are to be grafted.

Au moins deux semaines avant la date d’introduction, l’importateur notifie à l’organisme officiel compétent les lieux, visés au point 7, où les végétaux doivent être greffés.

6. The inspections, including testing, as appropriate, required pursuant to Article 13 of Directive 2000/29/EC and in accordance with provisions laid down in the present Decision, shall be made by the responsible official bodies of the Member State making use of this authorisation, and where appropriate, in cooperation with the responsible official bodies of the Member State where the plants are to be stored.

6. Les inspections, y compris les tests le cas échéant, requises à l’article 13 de la directive 2000/29/CE et en application des dispositions de la présente décision sont effectuées par les organismes officiels compétents des États membres faisant usage de l’autorisation, au besoin avec le concours des organismes officiels compétents de l’État membre dans lequel les végétaux doivent être entreposés.

During those inspections, Member State(s) shall also inspect, and where appropriate, test for harmful organisms mentioned in point 2. Any finding of such harmful organisms shall immediately be notified to the Commission. Appropriate action shall be taken to destroy the harmful organisms and where appropriate the plants concerned.

Durant ces inspections, le ou les États membres contrôlent l’absence de tout autre organisme nuisible mentionné au point 2 et, au besoin, réalisent un test à cet effet. La présence de tout organisme de ce type est immédiatement notifiée à la Commission. Les mesures appropriées sont prises pour détruire lesdits organismes et, s’il y a lieu, les végétaux concernés.

7. The plants shall be grafted only at premises officially registered and approved for the purposes of this authorisation.

7. Les végétaux ne sont greffés qu’en des lieux officiellement déclarés et agréés aux fins de l’autorisation.

The person intending to graft the plants shall notify in advance the responsible official bodies of the Member State in which the premises are situated of the name and address of the owner of those premises.

La personne qui a l’intention de greffer les végétaux communique au préalable aux organismes officiels compétents de l’État membre dans lequel se trouvent les lieux le nom et l’adresse de leur propriétaire.

Where the place of grafting is situated in a Member State other than the Member State making use of the authorisation, the responsible official bodies of the Member State making use of the authorisation shall inform the responsible official bodies of the Member State where the plants are to be grafted of the names and addresses of the premises where the plants are to be grafted. Such information shall be given at the moment of the receipt of the advance notification from the importer as referred to in the fourth paragraph of point 5.

Lorsque le lieu du greffage est situé dans un État membre autre que celui faisant usage de l’autorisation, les organismes officiels compétents de l’État membre faisant usage de l’autorisation informent ceux de l’État membre dans lequel les végétaux doivent être greffés du nom et de l’adresse des lieux où les végétaux doivent être greffés. Ces informations sont transmises au moment de la réception de la notification préalable de l’importateur visée au point 5, quatrième alinéa.

8. At the premises referred to in point 7:

8. Dans les lieux visés au point 7:

(a) the plants which have been found free from the harmful organisms referred to in point 2 may then be used for grafting onto rootstock of Community origin. The grafted plants shall subsequently be kept under appropriate conditions in a suitable growing medium but shall not be planted or further grown in fields. The grafted plants shall remain at the premises for no more than 18 months before being exported to a destination outside the Community as referred to in point 9;

a) les végétaux déclarés indemnes des organismes nuisibles visés au point 2 peuvent alors être utilisés pour le greffage sur des porte-greffes d’origine communautaire. Les greffes-boutures sont ensuite conservées dans des conditions appropriées, dans un milieu de culture adapté, mais ne doivent pas être plantées ou poursuivre leur développement dans des champs. Les greffes-boutures restent dans les lieux pendant une période maximale de dix-huit mois avant leur exportation vers une destination extérieure à la Communauté visée au point 9;

(b) in the period following grafting the plants shall be visually inspected by the said responsible official bodies of the Member State in which they are grafted, at appropriate times, for the presence of harmful organisms or for signs or symptoms caused by any harmful organism; as a result of such visual inspection any harmful organism having caused such signs or symptoms shall be identified by an appropriate testing procedure;

b) les végétaux sont soumis, au cours de la période de végétation suivant le greffage, à une inspection visuelle par les organismes officiels compétents de l’État membre dans lequel ils sont greffés, à des moments opportuns, en vue de la détection d’organismes nuisibles ou de signes ou symptômes causés par un organisme nuisible; à la suite de cette inspection, tout organisme nuisible responsable de tels signes ou symptômes est identifié par des tests appropriés;

(c) any grafted plant which has not been found free, during the said inspections or testing referred to in points (a) and (b), from harmful organisms listed in point 2, or otherwise of quarantine concern, shall be immediately destroyed under the control of the said responsible official bodies.

c) toute greffe-bouture qui, au cours des inspections ou des tests visés aux points a) et b), n’a pas été déclarée indemne des organismes nuisibles énumérés au point 2 ou qui devrait faire l’objet d’une mise en quarantaine est immédiatement détruite sous le contrôle desdits organismes officiels compétents.

9. Any plant resulting from a successful grafting using the buds referred to in point 1 shall only be released as grafted plants for export to Croatia or to the former Yugoslav Republic of Macedonia. The responsible official bodies of a Member State making use of this authorisation shall ensure that any plant or part of the plant not so exported shall be officially destroyed. Records shall be kept of the amounts of successfully grafted plants, of officially destroyed plants and of plants subsequently re-exported to Croatia or to the former Yugoslav Republic of Macedonia. This information shall be made available to the Commission.

9. Tous les végétaux résultant d’une greffe réussie à partir des greffons visés au point 1 ne sont acheminés comme greffes-boutures que vers la Croatie ou l’ancienne République yougoslave de Macédoine. Les organismes officiels compétents d’un État membre faisant usage de l’autorisation garantissent la destruction officielle de la totalité des végétaux ou parties de végétaux n’ayant pas fait l’objet de cette exportation. Les quantités de greffes-boutures réussies, de végétaux officiellement détruits et de végétaux réexportés ensuite vers la Croatie ou l’ancienne République yougoslave de Macédoine sont consignées dans un registre. Ces informations sont mises à la disposition de la Commission.
