Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant-protection on the market [1], and in particular Article 6(3) thereof,

Whereas:

(1) Directive 91/414/EEC provides for the development of a Community list of active substances authorised for incorporation in plant protection products.
|
(1) La directive 91/414/CEE prévoit l’établissement d’une liste communautaire de substances actives dont l’incorporation est autorisée dans les produits phytopharmaceutiques.
|
|
(2) A dossier for the active substance chlorantraniliprole was submitted by DuPont International Operations Sarl to the authorities of Ireland on 2 February 2007 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For heptamaloxyglucan a dossier was submitted by ELICITYL to the authorities of France on 9 May 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For spirotetramat a dossier was submitted by Bayer CropScience AG to the authorities of Austria on 9 October 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For Helicoverpa armigera nucleopolyhedrovirus a dossier was submitted by Andermatt Biocontrol GmbH to the authorities of Estonia on 7 August 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC.

(2) DuPont International Operations Sarl a introduit, le 2 février 2007, un dossier concernant la substance active chlorantraniliprole auprès des autorités irlandaises, en vue d’obtenir son inscription à l’annexe I de la directive 91/414/CEE. Pour l’heptamaloxyglucan, ELICITYL a soumis un dossier aux autorités françaises le 9 mai 2006, en vue d’obtenir son inscription à l’annexe I de la directive 91/414/CEE. Pour le spirotetramat, Bayer CropScience AG a soumis un dossier aux autorités autrichiennes le 9 octobre 2006, en vue d’obtenir son inscription à l’annexe I de la directive 91/414/CEE. Pour le virus de la polyhédrose nucléaire Helicoverpa armigera, Andermatt Biocontrol GmbH a soumis un dossier aux autorités estoniennes le 7 août 2006, en vue d’obtenir son inscription à l’annexe I de la directive 91/414/CEE.

(3) The authorities of Ireland, France, Austria and Estonia have indicated to the Commission that, on preliminary examination, the dossiers for the active substances concerned appear to satisfy the data and information requirements set out in Annex II to Directive 91/414/EEC. The dossiers submitted appear also to satisfy the data and information requirements set out in Annex III to Directive 91/414/EEC in respect of one plant protection product containing the active substance concerned. In accordance with Article 6(2) of Directive 91/414/EEC, the dossiers were subsequently forwarded by the applicant to the Commission and other Member States, and were referred to the Standing Committee on the Food Chain and Animal Health.

(3) Les autorités irlandaises, françaises, autrichiennes et estoniennes ont informé la Commission qu’il ressort d’un premier examen que les dossiers relatifs aux substances actives concernées satisfont aux exigences en matière de données et d’informations prévues à l’annexe II de la directive 91/414/CEE. Les dossiers présentés semblent également satisfaire aux exigences en matière de données et d’informations, prévues à l’annexe III de la même directive, pour un produit phytopharmaceutique contenant la substance active concernée. Conformément aux dispositions de l’article 6, paragraphe 2, de la directive 91/414/CEE, les dossiers ont ensuite été transmis par le demandeur à la Commission et aux autres États membres, puis au comité permanent de la chaîne alimentaire et de la santé animale.

(4) By this Decision it should be formally confirmed at Community level that the dossiers are considered as satisfying in principle the data and information requirements set out in Annex II and, for at least one plant protection product containing the active substance concerned, the requirements set out in Annex III to Directive 91/414/EEC.
|
(4) La présente décision a pour objet de confirmer formellement, au niveau de la Communauté, que les dossiers sont considérés comme répondant en principe aux exigences en matière de données et d’informations prévues à l’annexe II de la directive 91/414/CEE et, pour au moins un produit phytopharmaceutique contenant la substance active concernée, aux exigences de l’annexe III de la même directive.

(5) This Decision should not prejudice the right of the Commission to request the applicant to submit further data or information in order to clarify certain points in the dossier.
|
(5) La présente décision est sans préjudice du droit de la Commission d’inviter le demandeur à transmettre des données ou des informations supplémentaires afin de clarifier certains points du dossier.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

Without prejudice to Article 6(4) of Directive 91/414/EEC, the dossiers concerning the active substances identified in the Annex to this Decision, which were submitted to the Commission and the Member States with a view to obtaining the inclusion of those substances in Annex I to that Directive, satisfy in principle the data and information requirements set out in Annex II to that Directive.

Sans préjudice de l’article 6, paragraphe 4, de la directive 91/414/CEE, les dossiers concernant les substances actives figurant à l’annexe de la présente décision, qui ont été transmis à la Commission et aux États membres en vue de l’inscription de ces substances à l’annexe I de ladite directive, satisfont en principe aux exigences en matière de données et d’informations prévues à l’annexe II de ladite directive.

The dossiers also satisfy the data and information requirements set out in Annex III to that Directive in respect of one plant protection product containing the active substance, taking into account the uses proposed.

Les dossiers satisfont également aux exigences en matière de données et d’informations prévues à l’annexe III de ladite directive en ce qui concerne un produit phytopharmaceutique contenant la substance active concernée, compte tenu des utilisations proposées.

The rapporteur Member States shall pursue the detailed examination for the dossiers referred to in Article 1 and shall communicate to the Commission the conclusions of their examination accompanied by a recommendation on the inclusion or non-inclusion in Annex I to Directive 91/414/EEC of the active substances referred to in Article 1 and any conditions for those inclusions as soon as possible and at the latest within a period of one year from the date of publication of this Decision in the Official Journal of the European Union.

Les États membres rapporteurs poursuivent l’examen détaillé des dossiers visés à l’article 1er et communiquent à la Commission les conclusions de leur examen, accompagnées d’une recommandation concernant l’inscription ou non des substances actives visées à l’article 1er à l’annexe I de la directive 91/414/CEE, ainsi que toute condition relative à ces inscriptions, le plus rapidement possible et au plus tard dans un délai d’un an à compter de la date de publication de la présente décision au Journal officiel de l’Union européenne.
