THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis [1], and in particular to article 6 thereof,

vu la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l’acquis de Schengen [1], et en particulier son article 6 de cette décision,

Whereas:

considérant ce qui suit:

(1) The United Kingdom has expressed its intention to commence implementation of the following parts of the Schengen acquis: Judicial cooperation, Drugs cooperation, Article 26 and Article 27 of the Schengen Convention, and Police cooperation.

(1) Le Royaume-Uni a fait part de son intention de commencer à mettre en œuvre les parties ci après de l'acquis de Schengen: coopération judiciaire, coopération en matière de drogue, articles 26 et 27 de la convention Schengen, et coopération policière.

(2) The United Kingdom indicated to be ready to apply all provisions of the Schengen acquis referred to in Article 1 of Decision 2000/365/EC with the exception of those concerning the Schengen Information System.

(2) Le Royaume-Uni a indiqué qu'il était disposé à appliquer toutes les dispositions de l'acquis de Schengen visées à l'article premier de la décision 2000/365/CE du Conseil, à l'exception de celles concernant le système d'information Schengen.

(3) The United Kingdom will continue to prepare for the implementation of the relevant provisions of the Schengen Information System and for data protection.

(3) Le Royaume-Uni continuera de se préparer à la mise en œuvre des dispositions pertinentes du système d'information Schengen et de celles relatives à la protection des données.

(4) A questionnaire was forwarded to the United Kingdom, whose replies were recorded and a subsequent verification and evaluation visit was made to the United Kingdom in accordance with the procedures applicable in the area of police cooperation.

(4) Après l'envoi d'un questionnaire au Royaume-Uni, dont les réponses ont été enregistrées, une visite de vérification et d'évaluation a été effectuée au Royaume-Uni conformément aux procédures applicables dans le domaine de la coopération policière.

(5) As regards the application of the Schengen acquis relating to the abovementioned areas, the questionnaire and the visit demonstrated that the requirements relating to legislation, manpower levels, training, infrastructure and material resources have been satisfied.

(5) En ce qui concerne l'application de l'acquis de Schengen relatif aux domaines susmentionnés, le questionnaire et la visite ont démontré qu'il a été satisfait aux exigences relatives à la législation, aux effectifs, à la formation, aux infrastructures et aux ressources matérielles.

(6) The preconditions for the implementation by the United Kingdom of those provisions of the Schengen acquis as listed in Article 1(a)(i), (b), (c)(i) and (d)(i) of Decision 2000/365/EC have been fulfilled, allowing these provisions and their later developments to be put into effect for the United Kingdom.

(6) Les conditions préalables à la mise en œuvre par le Royaume-Uni de Grande-Bretagne des dispositions de l'acquis de Schengen énumérées à l'article 1er, point a), à l'article 1er, point b), à l'article 1er, point c), et à l'article 1er, point d), de la décision 2000/365/CE, ont été réunies, ce qui permet ainsi auxdites dispositions ainsi qu'à leur développement ultérieur d'être mis en œuvre au Royaume-Uni.

(7) Decision 2000/365/EC defines, in its Article 5(2), which provisions of the Schengen acquis are applicable to Gibraltar.

(7) La décision 2000/365/CE précise, à son article 5, paragraphe 2, quelles sont les dispositions de l'acquis de Schengen qui s'appliquent à Gibraltar.

(8) An Agreement has been concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway on the establishment of rights and obligations between Ireland and the United Kingdom of Great Britain and Northern Ireland, on the one hand, and the Republic of Iceland and the Kingdom of Norway, on the other, in areas of the Schengen acquis which apply to these States [2]. On the basis of Article 2 of that Agreement, the Mixed Committee, established pursuant to Article 3 of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis [3], has been consulted, in accordance with Article 4 thereof, about the preparation of this Decision,

(8) Un accord a été conclu par le Conseil de l'Union européenne, la République d'Islande et le Royaume de Norvège sur l'établissement des droits et obligations entre l'Irlande et le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord, d'une part, et la République d'Islande et le Royaume de Norvège, d'autre part, dans les domaines de l'acquis de Schengen qui s'appliquent à ces États [2]. Sur la base de l'article 2 de cet accord, le comité mixte institué en vertu de l'article 3 de l'accord conclu par le Conseil de l'Union européenne et la République d'Islande et le Royaume de Norvège sur l'association de ces deux États à la mise en œuvre, à l'application et au développement de l'acquis de Schengen [3] a été consulté sur l'élaboration de la présente décision, conformément à l'article 4 dudit accord,

HAS DECIDED AS FOLLOWS:

Article 1

The provisions referred to in Article 1(a)(i), (b), (c)(i) and (d) (i) of Decision 2000/365/EC shall be put into effect for the United Kingdom as from 1 January 2005.

Les dispositions visées à l'article 1er, point a), à l'article 1er, point b), à l'article 1er, point c), et à l'article 1er, point d), de la décision 2000/365/CE sont mises en œuvre au Royaume-Uni à compter du 1er janvier 2005.

The provisions referred to in Article 5(2) of Decision 2000/365/EC shall be put into effect for Gibraltar as from 1 January 2005.

Les dispositions visées à l'article 5, paragraphe 2, de la décision du 2000/365/CE du Conseil sont mises en œuvre à Gibraltar à compter du 1er janvier 2005.

The provisions of the acts constituting developments of the Schengen acquis adopted since Decision 2000/365/EC and listed in Annex I of this Decision shall be put into effect for the United Kingdom and for Gibraltar as from 1 January 2005.

Les dispositions des actes constituant des développements de l'acquis de Schengen adoptés depuis la décision 2000/365/CE et énumérés à l'annexe I de la présente décision sont mises en œuvre au Royaume-Uni et à Gibraltar à compter du 1er janvier 2005.

The provisions of the acts constituting developments of the Schengen acquis adopted since Decision 2000/365/EC and listed in Annex II of this Decision shall be put into effect for the United Kingdom as from 1 January 2005.

Les dispositions des actes constituant des développements de l'acquis de Schengen adoptés depuis la décision 2000/365/CE et énumérés à l'annexe II sont mises en œuvre au Royaume-Uni et à Gibraltar à compter du 1er janvier 2005.

Formal communications and transmission of decisions between the Gibraltar authorities, including the judicial authorities, and those of the Member States of the European Union (except the United Kingdom) for the purposes of this Decision shall be carried out in accordance with the procedure provided for in the arrangements relating to the Gibraltar authorities in the context of EU and EC instruments and related treaties (see Annex III to this Decision), concluded between Spain and the United Kingdom on 19 April 2000 and communicated to the Member States and the institutions of the European Union.

Les communications officielles et la transmission de décisions entre les autorités de Gibraltar, y compris les autorités judiciaires, et celles des États membres de l'Union européenne (excepté le Royaume-Uni) aux fins de la présente décision s'effectueront conformément à la procédure prévue dans les arrangements concernant les autorités de Gibraltar dans le contexte des instruments de l'Union européenne et de la Communauté et des traités connexes (cf. Annexe III de la présente décision), conclus entre l'Espagne et le Royaume-Uni le 19 avril 2000 et notifiés aux États membres et aux institutions de l'Union.

This Decision shall take effect on the day following that of its publication in the Official Journal of the European Union.

La présente décision prend effet le jour suivant celui de sa publication au Journal officiel de l'Union européenne.
