Having regard to the Treaty establishing the European Community, and in particular Article 100a thereof,

Whereas rules for harmonization in the field of additives should not affect the application of provisions of Member States existing on 1 January 1992, which prohibit the use of certain additives in certain specific foodstuffs which are considered as traditional and are produced on their territory, provided that those provisions do not cover a whole series of foodstuffs including foodstuffs which do not come under this Directive but regarding which Community provisions provide for authorization of additives;

considérant que les règles d'harmonisation en matière d'additifs ne devraient pas remettre en cause l'application des dispositions des États membres en vigueur au 1er janvier 1992 qui interdisent l'emploi de certains additifs dans certaines denrées alimentaires spécifiques considérées comme traditionnelles et fabriquées sur leur territoire, pour autant que ces dispositions ne couvrent pas un ensemble de denrées alimentaires comprenant des denrées qui ne relèvent pas du présent dispositif et pour lesquelles les dispositions communautaires prévoient une autorisation d'additifs;

Whereas these products could be distinguished by an appropriate labelling;

considérant que ces produits pourraient être distingués au moyen d'un étiquetage approprié;

Whereas the free circulation of foodstuffs conforming with directives concerning additives should not be affected;

considérant que la libre circulation des produits conformes aux dispositions des directives concernant les additifs ne doit pas être entravée;

Whereas the freedom of establishment, the production and sale on the territory of each Member State of foodstuffs conforming with Directives concerning additives should not be affected,

considérant que les dispositions envisagées ne doivent pas porter atteinte à la liberté pour quiconque de s'établir sur le territoire de tout État membre et de produire et de vendre des produits conformes aux directives concernant les additifs,

HAVE ADOPTED THIS DIRECTIVE:

ONT ARRÊTÉ LA PRÉSENTE DIRECTIVE:

Article 1

Article premier

The following Article 3a shall be inserted in Directive 89/107/EEC (4):

'Article 3a

«Article 3 bis

1. By way of derogation from Article 3 (2) (a) and (b), the Council shall, acting on a proposal from the Commission pursuant to the procedure laid down in Article 100a of the Treaty, authorize the Member States to maintain the prohibition on the use of certain additives in the production of certain foodstuffs considered as traditional provided that:

Par dérogation aux dispositions de l'article 3 paragraphe 2 points a) et b), le Conseil, statuant sur proposition de la Commission selon la procédure prévue à l'article 100 A du traité, autorise les États membres à maintenir l'interdiction frappant l'utilisation de certains additifs dans la production de certaines denrées alimentaires spécifiques considérées comme traditionnelles, à condition que:

- this prohibition existed on 1 January 1992,

- cette interdiction existe déjà depuis le 1er janvier 1992,

- the Member States concerned authorize on their territory the production and sale of all foodstuffs not considered as traditional which conform to the rules provided for in Article 3.

- les États membres concernés autorisent la production et la vente, sur leur territoire, de toutes les denrées alimentaires non considérées comme traditionnelles et conformes aux dispositions de l'article 3.

2. Without prejudice to Regulations (EEC) No 2081/92 (1) and (EEC) No 2082/92 (2), before 1 July 1994, Member States shall communicate to the list of foodstuffs which they consider as traditional, giving their reasons in detail, together with the relevant legislative provisions prohibiting the use of certain additives in such foodstuffs.

2. Sans préjudice des règlements (CEE) n° 2081/92 (1) et (CEE) n° 2082/92 (2), avant le 1er juillet 1994, les États membres communiquent à la Commission la liste des denrées alimentaires qu'ils considèrent comme traditionnelles, en indiquant de manière détaillée les motifs de leur choix, ainsi que les dispositions législatives correspondantes interdisant l'emploi de certains additifs dans ces denrées alimentaires.

Before 1 April 1995, the Commission shall submit a proposal to the Council on the criteria to be applied for deciding whether or not a product is traditional and on the national prohibitions which may be maintained in conformity with these criteria.

Avant le 1er avril 1995, la Commission soumet au Conseil une proposition concernant les critères à appliquer pour décider qu'un produit est traditionnel ou non, ainsi que les interdictions nationales qui peuvent être maintenues conformément à ces critères.

The Council shall act on the proposal before 1 April 1996.

Le Conseil statue avant le 1er avril 1996.

3. Until such time as the Council has ruled on paragraph 2, Member States may maintain any prohibitions which have been communicated to the Commission pursuant to the first subparagraph of paragraph 2, provided that they comply with the general conditions laid down in paragraph 1.

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive.

Les États membres mettent en vigueur les dispositions législatives, réglementaires et administratives nécessaires pour se conformer à la présente directive.

They shall inform the Commission thereof.

Ils en informent immédiatement la Commission.

When Member States adopt these measures, they shall contain a reference to this Directive or shall be accompanied by such reference when they are officially published. The methods of making such reference shall be laid down by the Member States.

Lorsque les États membres adoptent ces dispositions, celles-ci contiennent une référence à la présente directive ou sont accompagnées d'une telle référence lors de leur publication officielle. Les modalités de cette référence sont arrêtées par les États membres.

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.

La présente directive entre en vigueur le jour de sa publication au Journal officiel des Communautés européennes.

This Directive is addressed to the Member States.
