Having regard to the Treaty establishing the European Community, and in particular Article 130s (1) thereof,
|

Acting in accordance with the procedure laid down in Article 189 c of the Treaty,

Whereas it has become apparent, through the work of the committee provided for in Article 18 of Council Directive 75/442/EEC (3) that it has not been possible, within the time limits fixed by Directive 91/689/EEC (4), to draw up a binding list of hazardous waste, but whereas the implementation of Directive 91/689/EEC depends on the Commission's establishing such a list;

considérant qu'il s'est révélé, d'après les travaux du comité prévu à l'article 18 de la directive 75/442/CEE (3), qu'il n'a pas été possible d'élaborer une liste contraignante de déchets dangereux dans les délais fixés par la directive 91/689/CEE (4), mais que la mise en oeuvre de la directive 91/689/CEE dépend de l'établissement par la Commission d'une telle liste;

Whereas it is necessary to ensure the implementation of Directive 91/689/EEC within the shortest possible time;
|
considérant qu'il est nécessaire d'assurer la mise en oeuvre de la directive 91/689/CEE dans un délai minimal;
|
|
Whereas a Community list of hazardous waste must still be established in accordance with Article 1 (4) of Directive 91/689/EEC;
|
considérant qu'il est toujours nécessaire d'établir une liste communautaire de déchets dangereux conformément à l'article 1er paragraphe 4 de ladite directive;
|
|
Whereas the repeal of Council Directive 78/319/EEC of 20 March 1978 on toxic and dangerous waste (5) must therefore be postponed,
|
considérant qu'il convient, en conséquence, de reporter l'abrogation de la directive 78/319/CEE du Conseil, du 20 mars 1978, relative aux déchets toxiques et dangereux (5),
|
|
HAS ADOPTED THIS DIRECTIVE:

Directive 91/689/EEC is hereby amended as follows:
|
La directive 91/689/CEE est modifiée comme suit.
|
|
1. The following shall be substituted for Article 10 (1):
|
1) À l'article 10, le paragraphe 1 est remplacé par le texte suivant:

'Article 10
|
« 1. Les États membres mettent en vigueur les dispositions législatives, réglementaires et administratives nécessaires pour se conformer à la présente directive avant le 27 juin 1995. Ils en informent immédiatement la Commission. »

1. Member States shall bring into force the laws, regulations and administrative provisions necessary for them to comply with this Directive by 27 June 1995. They shall immediately inform the Commission thereof.'
|
2) L'article 11 est remplacé par le texte suivant:

'Annex 11
|
La directive 78/319/CEE est abrogée avec effet au 27 juin 1995. »
|
|
Directive 78/319/EEC shall be repealed with effect from 27 June 1995.'
