DÉCISION DE LA COMMISSION du 11 juin 1992 fixant certaines règles visant à assurer la coordination entre organisations ou associations tenant ou créant les livres généalogiques pour les équidés enregistrés (92/354/CEE)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 90/427/EEC of 26 June 1990 on the zootechnical and genealogical conditions governing intra-Community trade in equidae (1), and in particular Article 4 (2) (e) thereof,

vu la directive 90/427/CEE du Conseil, du 26 juin 1990, relative aux conditions zootechniques et généalogiques régissant les échanges intracommunautaires d'équidés (1), et notamment son article 4 paragraphe 2 point e),

Whereas Decision 92/353/EEC (2) lays down the criteria for the approval or recognition of organizations and associations which maintain or establish stud-books for registered equidae; whereas that Decision provides that the authorities of the Member State concerned are responsible for approving or recognizing organizations or associations which maintain or establish stud-books;

considérant que, par la décision 92/353/CEE (2), la Commission a déterminé les critères d'agrément ou de reconnaissance des organisations et associations tenant ou créant des livres généalogiques pour les équidés enregistrés; que, selon cette décision, il appartient aux autorités de l'État membre concerné d'agréer ou de reconnaître les organisations ou associations tenant ou créant les livres généalogiques;

Whereas in this context, therefore, rules should be laid down to govern the relations between the organization or association which maintains the stud-book of the origin of the breed and an organization or association which maintains or establishes a stud-book or a section of a stud-book for that breed;

considérant que, dans ce cadre, il convient de prévoir notamment les règles régissant les relations entre l'organisation ou l'association tenant le livre généalogique d'origine de la race et une organisation ou association tenant ou créant un livre généalogique ou une section d'un livre généalogique de ladite race;

Whereas provisions should be made for a procedure enabling the competent authorities concerned to ensure, in special circumstances, coordination between two organizations or associations; whereas it is also important that all the information required for the adoption of the specific coordination rules pursuant to Article 4 (2) (e) of Directive 90/427/EEC be made available to the Commission;

considérant qu'il importe de prévoir une procédure permettant aux autorités compétentes concernées d'assurer dans des circonstances particulières la coordination entre deux organisations ou associations; que, en outre, il importe de permettre à la Commission de disposer de toutes les informations nécessaires à l'adoption des règles spécifiques de coordination au titre de l'article 4 paragraphe 2 point e) de la directive 90/427/CEE;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

considérant que les mesures prévues à la présente décision sont conformes à l'avis du comité zootechnique permanent,

HAS ADOPTED THIS DECISION:

Article 1

Article premier

The organization or association which maintains the stud-book of the origin of the breed must ensure close collaboration with the organization and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute.

L'organisation ou l'association tenant le livre généalogique d'origine de la race doit assurer une étroite collaboration avec les organisations et associations tenant des livres généalogiques ou des sections de livres généalogiques de la même race, en particulier pour prévenir tout différend.

1. Where the competent authority of a Member State considers that an approved or recognized organization or association in another Member State is not complying with the rules laid down in the relevant Community legislation, and particularly with the principles laid down by the organization or association which maintains the stud-book of the origin of the breed, it shall contact the competent authority of the other Member State concerned forthwith.

1. Lorsque l'autorité compétente d'un État membre estime qu'une organisation ou association agréée ou reconnue dans un autre État membre ne respecte pas les règles prévues par la législation communautaire en la matière, et notamment ne respecte pas les principes établis par l'organisation ou l'association tenant le livre généalogique d'origine de la race, elle entre sans délai en contact avec l'autorité compétente de cet autre État membre.

The latter shall take all the necessary measures and inform the competent authority of the first Member State of the type of checks carried out, the decisions taken and the reasons for those decisions.

Cette dernière prend toutes les mesures nécessaires et communique à l'autorité compétente du premier État membre la nature des contrôles effectués, des décisions prises et les motifs de ces décisions.

2. If the competent authorities of the first Member State considers these measures likely to be insufficient, it shall explore with the authority of the other Member State ways of remedying the situation, if necessary by visiting that Member State.

2. Si l'autorité compétente du premier État membre craint que ces mesures ne soient pas suffisantes, elle recherche avec l'autorité de l'État membre mis en cause les voies et moyens de remédier à la situation, le cas échéant par une visite sur place.

3. The competent authorities of the Member States shall inform the Commission of the solutions decided upon.

3. Les autorités compétentes des États membres informent la Commission des solutions retenues.

4. In the event that no solution is found within six months, at the request of one of the authorities of the Member States concerned or on its own initiative, the Commission may, in particular, send an inspection team in collaboration with the competent national authorities.

4. Dans l'hypothèse où aucune solution n'a pu être trouvée dans un délai de six mois, la Commission, à la demande d'une des autorités des États membres concernés ou de sa propre initiative, peut notamment envoyer sur place, en collaboration avec les autorités nationales compétentes, une mission d'inspection.
