COUNCIL DIRECTIVE 94/31/EC of 27 June 1994 amending Directive 91/689/EEC on hazardous waste

NEUVOSTON DIREKTIIVI 94/31/EY,

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 130s (1) thereof,

vaarallisista jätteistä annetun direktiivin 91/689/ETY muuttamisesta

Having regard to the proposal from the Commission (1),

EUROOPAN UNIONIN NEUVOSTO, joka

Having regard to the opinion of the Economic and Social Committee (2),

ottaa huomioon Euroopan yhteisön perustamissopimuksen ja erityisesti sen 130 s artiklan 1 kohdan,

Acting in accordance with the procedure laid down in Article 189 c of the Treaty,

ottaa huomioon komission ehdotuksen(1),

Whereas it has become apparent, through the work of the committee provided for in Article 18 of Council Directive 75/442/EEC (3) that it has not been possible, within the time limits fixed by Directive 91/689/EEC (4), to draw up a binding list of hazardous waste, but whereas the implementation of Directive 91/689/EEC depends on the Commission's establishing such a list;

ottaa huomioon talous- ja sosiaalikomitean lausunnon(2),

Whereas it is necessary to ensure the implementation of Directive 91/689/EEC within the shortest possible time;

toimii perustamissopimuksen 189 c artiklassa tarkoitetun menettelyn mukaisesti,

Whereas a Community list of hazardous waste must still be established in accordance with Article 1 (4) of Directive 91/689/EEC;

sekä katsoo, että

Whereas the repeal of Council Directive 78/319/EEC of 20 March 1978 on toxic and dangerous waste (5) must therefore be postponed,

direktiivin 75/442/ETY(3) 18 artiklalla perustetun komitean työskentelyn myötä on osoittautunut, ettei ole mahdollista laatia sitovaa luetteloa vaarallisista jätteistä direktiivissä 91/689/ETY(4) vahvistettuina määräaikoina, mutta direktiivin 91/689/ETY täytäntöönpano edellyttää kuitenkin, että komissio laatii tällaisen luettelon,

HAS ADOPTED THIS DIRECTIVE:

on tarpeen varmistaa direktiivin 91/689/ETY täytäntöönpano mahdollisimman pian,

on silti tarpeen laatia direktiivin 91/689/ETY 1 artiklan 4 kohdan mukaisesti yhteisön luettelo vaarallisista jätteistä, ja

Article 1

näin ollen on suotavaa lykätä myrkyllisistä ja vaarallisista jätteistä 20 päivänä maaliskuuta 1978 annetun neuvoston direktiivin 78/319/ETY(5) kumoamista,

Directive 91/689/EEC is hereby amended as follows:

ON ANTANUT TÄMÄN DIREKTIIVIN:

1. The following shall be substituted for Article 10 (1):

'Article 10

1. Member States shall bring into force the laws, regulations and administrative provisions necessary for them to comply with this Directive by 27 June 1995. They shall immediately inform the Commission thereof.'

1 artikla

2. The following shall be substituted for Article 11:

Muutetaan direktiivi 91/689/ETY seuraavasti.

'Annex 11

1) Korvataan 10 artiklan 1 kohta seuraavasti:

Directive 78/319/EEC shall be repealed with effect from 27 June 1995.'

"1 Jäsenvaltioiden on saatettava tämän direktiivin noudattamisen edellyttämät lait, asetukset ja hallinnolliset määräykset voimaan viimeistään 27 päivänä kesäkuuta 1995. Niiden on ilmoitettava tästä komissiolle viipymättä."

2) Korvataan 11 artikla seuraavasti:

Article 2

"11 artikla

This Directive is addressed to the Member States.

Kumotaan direktiivi 78/319/ETY 27 päivästä kesäkuuta 1995."
