COMMISSION DIRECTIVE of 9 June 1980 determining the symbol that may accompany materials and articles intended to come into contact with foodstuffs (80/590/EEC)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

millega määratakse kindlaks toiduainetega kokkupuutumiseks ettenähtud materjalide ja toodete eristusmärk

Having regard to Council Directive 76/893/EEC of 23 November 1976 on the approximation of the laws of the Member States relating to materials and articles intended to come into contact with foodstuffs (1), and in particular the last indent of Article 7 (1) (a) thereof,

Whereas the last indent of Article 7 (1) (a) of Directive 76/893/EEC provides for the determination of a symbol that may accompany materials and articles instead of the particulars "for food use" or a specific indication as to the use of such materials and articles;

EUROOPA ÜHENDUSTE KOMISJON,

Whereas such symbol must be easy to understand ; whereas in addition it must be possible to reproduce it on materials and articles or on other media under the best possible technical conditions;

võttes arvesse Euroopa Majandusühenduse asutamislepingut,

Whereas the symbol reproduced in the Annex hereto meets these criteria;

võttes arvesse nõukogu 23. novembri 1976. aasta direktiivi 76/893/EMÜ toiduainetega kokkupuutumiseks ettenähtud materjale ja tooteid käsitlevate liikmesriikide õigusaktide ühtlustamise kohta, [1] eelkõige selle artikli 7 lõike 1 punkti a viimast taanet,

Whereas the measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Foodstuffs,

ning arvestades, et:

HAS ADOPTED THIS DIRECTIVE:

direktiivi 76/893/EMÜ artikli 7 lõike 1 punkti a viimases taandes nähakse ette kasutusele võtta eristusmärk, mis võiks olla materjalide ja toodete juures märke "toiduainete jaoks" või muude selliste materjalide ja toodete kasutusele osutavate märgete asemel;

see eristusmärk peab olema kergesti mõistetav; lisaks peab teda olema võimalik materjalidel ja toodetel või muudel teabekandjatel parimatel tehnilistel tingimustel reprodutseerida;

Article 1

käesoleva direktiivi lisas esitatud eristusmärk vastab nendele kriteeriumidele;

The symbol referred to in the last indent of Article 7 (1) (a) of Directive 76/893/EEC shall be that reproduced in the Annex hereto.

käesolevas direktiivis ettenähtud meetmed on kooskõlas alalise toiduainekomitee arvamusega,

ON VASTU VÕTNUD KÄESOLEVA DIREKTIIVI:

Article 2

Artikkel 1

The Member States shall take the measures necessary to authorize with effect from 1 January 1981 the use of the symbol referred to in Article 1.

Direktiivi 76/893/EMÜ artikli 7 lõike 1 punkti a viimases taandes nimetatud eristusmärk on esitatud käesoleva direktiivi lisas.

Artikkel 2

Article 3

Liikmesriigid võtavad kõik vajalikud meetmed, et lubada artiklis 1 nimetatud eristusmärgi kasutamist alates 1. jaanuarist 1981.

This Directive is addressed to the Member States.

Artikkel 3

Käesolev direktiiv on adresseeritud liikmesriikidele.
