THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

võttes arvesse nõukogu 23. juuli 1996 . aasta direktiivi 96/49/EÜ ohtlike kaupade raudteevedu käsitlevate liikmesriikide õigusaktide ühtlustamise kohta,(1) eriti selle artiklit 8,

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) Direktiivi 96/49/EÜ lisa sisaldab alates 1. juulist 2003 kohaldatavaid ohtlike kaupade rahvusvaheliste raudteevedude eeskirju (RID).

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) RIDi ajakohastatakse tavaliselt iga kahe aasta järel, viimane ajakohastamine kehtib alates 1. jaanuarist 2003 üleminekuperioodiga kuni 30. juunini 2003 .

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(3) Erandkorras ajakohastati RIDi uuesti ühe aasta pärast, nii et muudetud versioon jõustus 1. jaanuaril 2004 .

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

Article 1

The Annex to Directive 96/49/EC is replaced by the following:

Direktiivi 96/49/EÜ lisa asendatakse järgmisega:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

ĢAlates 1. jaanuarist 2004 kehtivad ohtlike kaupade rahvusvaheliste raudteevedude eeskirjad (RID), mis on esitatud rahvusvaheliste raudteevedude konventsiooni (COTIF) B liite I lisas, kusjuures mõisted Ģosalisriikģ ja Ģriigid või raudteedģ asendatakse mõistega Ģliikmesriikģ .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

1. Liikmesriigid jõustavad käesoleva direktiivi täitmiseks vajalikud õigusnormid hiljemalt 1. oktoobriks 2004 . Nad edastavad kõnealuste sätete teksti ning kõnealuste sätete ja käesoleva direktiivi vahelise vastavustabeli viivitamata komisjonile.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Kui liikmesriigid need normid vastu võtavad, lisavad nad nendesse või nende normide ametliku avaldamise korral nende juurde viite käesolevale direktiivile. Sellise viitamise viisi näevad ette liikmesriigid.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Liikmesriigid edastavad komisjonile käesoleva direktiiviga reguleeritavas valdkonnas nende vastuvõetud siseriiklike põhiliste õigusnormide teksti.

Article 3

Artikkel 3

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

Käesolev direktiiv jõustub kahekümnendal päeval pärast selle avaldamist Euroopa Liidu Teatajas .

Article 4

Artikkel 4

This Directive is addressed to the Member States.

Käesolev direktiiv on adresseeritud liikmesriikidele.
