Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2006/126/EC of the European Parliament and of the Council of 20 December 2006 on driving licences [1], and in particular Article 8 thereof,

võttes arvesse Euroopa Parlamendi ja nõukogu 20. detsembri 2006. aasta direktiivi 2006/126/EÜ juhilubade kohta, [1] eriti selle artiklit 8,

Whereas:

ning arvestades järgmist:

(1) Annex I to Directive 2006/126/EC sets out the model on the basis of which Member States are required to introduce national driving licences. With the entry into force of the Treaty of Lisbon on 1 December 2009, the reference to the Community on the driving licence should be replaced with a reference to the European Union. The model should also be updated to reflect the accession of Bulgaria and Romania to the European Union.

(1) Direktiivi 2006/126/EÜ I lisas on sätestatud mudel, mille põhjal võtavad liikmesriigid kasutusele riigisisese juhiloa. Seoses Lissaboni lepingu jõustumisega 1. detsembril 2009 tuleks viide ühenduse juhiloale asendada viitega Euroopa Liidu juhiloale. Mudelit tuleks ajakohastada ka Bulgaaria ja Rumeenia ühinemist Euroopa Liiduga silmas pidades.

(2) In accordance with Annex I of Directive 2006/126/EC the European Union model driving licence should indicate the category of vehicle the holder is entitled to drive

(2) Direktiivi 2006/126/EÜ I lisa kohaselt tuleks Euroopa Liidu juhiloamudelil esitada nende sõiduki(te) kategooria, mida loaomanikul on lubatud juhtida.

(3) It is necessary to update the European Union model driving licence in the light of the new categories of vehicles introduced by Directive 2006/126/EC. In particular driving licences for category AM (mopeds) and category A2 (motorcycles) have been introduced and will be applicable as from 19 January 2013. Therefore, the European Union model driving licence should be adjusted.

(3) Võttes arvesse direktiiviga 2006/126/EÜ kehtestatud uusi sõidukikategooriaid, on vaja ajakohastada Euroopa Liidu juhiloamudelit. Eelkõige on võetud kasutusele AM-kategooria (mopeedid) ja A2-kategooria (mootorrattad) juhiload, mis hakkavad kehtima alates 19. jaanuarist 2013. Euroopa Liidu juhiloamudelit tuleks seega kohandada.

(4) Directive 2006/126/EC should therefore be amended accordingly.

(4) Seepärast tuleks direktiivi 2006/126/EÜ vastavalt muuta.

(5) Member States are encouraged to draw up, for themselves and in the interests of the Union, their own table illustrating, as far as possible, the correlation between this Directive and the transposition measures, and to make them public.

(5) Liikmesriike julgustatakse koostama enda jaoks ja liidu huvides oma vastavustabelid, kus on võimalikult suures ulatuses välja toodud vastavus käesoleva direktiivi ja ülevõtmismeetmete vahel, ning tegema need üldsusele kättesaadavaks.

(6) The measures provided for in this Directive are in accordance with the opinion of the Committee on driving licences,

HAS ADOPTED THIS DIRECTIVE:

ON VASTU VÕTNUD KÄESOLEVA DIREKTIIVI:

Article 1

Annex I to Directive 2006/126/EC is amended as set out in the Annex.

Direktiivi 2006/126/EÜ I lisa muudetakse vastavalt käesoleva direktiivi lisale.

1. Member States shall adopt and publish, by 30 June 2012 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith inform the Commission thereof.

1. Liikmesriigid võtavad vastu ja avaldavad käesoleva direktiivi järgimiseks vajalikud õigus- ja haldusnormid hiljemalt 30. juuniks 2012. Liikmesriigid teatavad sellest viivitamata komisjonile.

They shall apply those provisions from 19 January 2013.

Nad kohaldavad neid norme alates 19. jaanuarist 2013.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Kui liikmesriigid need õigusnormid vastu võtavad, lisavad nad nendesse või nende normide ametliku avaldamise korral nende juurde viite käesolevale direktiivile. Sellise viitamise viisi näevad ette liikmesriigid.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Liikmesriigid edastavad komisjonile käesoleva direktiiviga reguleeritavas valdkonnas nende poolt vastuvõetavate põhiliste siseriiklike õigusnormide teksti.

Article 3

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Käesolev direktiiv jõustub kahekümnendal päeval pärast selle avaldamist Euroopa Liidu Teatajas.

Article 4

Artikkel 4

This Directive is addressed to the Member States.

Käesolev direktiiv on adresseeritud liikmesriikidele.

(1) the title is replaced by the following:

If a Member State wishes to make the entries in a national language other than one of the following languages: Bulgarian, Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovak, Slovenian, Spanish or Swedish, it shall draw up a bilingual version of the licence using one of the aforementioned languages, without prejudice to the other provisions of this Annex;";

Kui liikmesriik soovib teha kandeid riigikeeles, mis ei ole bulgaaria, eesti hispaania, hollandi, inglise, itaalia, kreeka, leedu, läti, malta, poola, portugali, prantsuse, rootsi, rumeenia, saksa, slovaki, sloveeni, soome, taani, tšehhi ega ungari keel, koostab ta juhiloa kahes keeles, kasutades üht eespool nimetatud keeltest, ilma et see piiraks muude käesoleva lisa sätete kohaldamist;"

- in point (c), the words "Community model licence" are replaced by the words "European Union model driving licence";

- alapunktis c asendatakse sõnad "Ühenduse juhiloamudelil" sõnadega "Euroopa Liidu juhiloamudelil".

(6) in point 4, the following point (c) is added:

6) Punkti 4 lisatakse alapunkt c:

"(c) Information contained in the front and reverse side of the card shall be legible with the eye, using a minimum character height of 5 points for items 9 to 12 on the reverse side.";
