THE COMMISSION OF THE EUROPEAN COMMUNITIES,

EUROOPA ÜHENDUSTE KOMISJON,

Having regard to the Treaty establishing the European Community,

võttes arvesse Euroopa Ühenduse asutamislepingut,

Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant-protection on the market [1], and in particular Article 6(3) thereof,

võttes arvesse nõukogu 15. juuli 1991. aasta direktiivi 91/414/EMÜ taimekaitsevahendite turuleviimise kohta, [1] eriti selle artikli 6 lõiget 3,

Whereas:

ning arvestades järgmist:

(1) Directive 91/414/EEC provides for the development of a Community list of active substances authorised for incorporation in plant protection products.

(1) Direktiiviga 91/414/EMÜ on ette nähtud taimekaitsevahendite kasutamiseks lubatud toimeainete ühenduse loetelu täiendamine.

(2) A dossier for the active substance chlorantraniliprole was submitted by DuPont International Operations Sarl to the authorities of Ireland on 2 February 2007 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For heptamaloxyglucan a dossier was submitted by ELICITYL to the authorities of France on 9 May 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For spirotetramat a dossier was submitted by Bayer CropScience AG to the authorities of Austria on 9 October 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC. For Helicoverpa armigera nucleopolyhedrovirus a dossier was submitted by Andermatt Biocontrol GmbH to the authorities of Estonia on 7 August 2006 with an application to obtain its inclusion in Annex I to Directive 91/414/EEC.

(2) DuPont International Operations Sarl. on 2. veebruaril 2007 esitanud Iirimaa ametiasutustele toimiku toimeaine kloorantraniliprooli kohta koos taotlusega lisada kõnealune toimeaine direktiivi 91/414/EMÜ I lisasse. ELICITYL on 9. mail 2006 esitanud Prantsusmaa ametiasutustele toimiku toimeaine heptamaloksüloglükaani kohta koos taotlusega lisada kõnealune toimeaine direktiivi 91/414/EMÜ I lisasse. Bayer CropScience AG on 9. oktoobril 2006 esitanud Austria ametiasutustele toimiku toimeaine spirotetramaadi kohta koos taotlusega lisada kõnealune toimeaine direktiivi 91/414/EMÜ I lisasse. Andermatt Biocontrol GmbH on 7. augustil 2006 esitanud Eesti ametiasutustele toimiku Helicoverpa armigera nukleopolühedroviiruse kohta koos taotlusega lisada kõnealune toimeaine direktiivi 91/414/EMÜ I lisasse.

(3) The authorities of Ireland, France, Austria and Estonia have indicated to the Commission that, on preliminary examination, the dossiers for the active substances concerned appear to satisfy the data and information requirements set out in Annex II to Directive 91/414/EEC. The dossiers submitted appear also to satisfy the data and information requirements set out in Annex III to Directive 91/414/EEC in respect of one plant protection product containing the active substance concerned. In accordance with Article 6(2) of Directive 91/414/EEC, the dossiers were subsequently forwarded by the applicant to the Commission and other Member States, and were referred to the Standing Committee on the Food Chain and Animal Health.

(3) Iirimaa, Prantsusmaa, Austria ja Eesti ametiasutused on teatanud komisjonile, et esialgse läbivaatuse põhjal vastavad asjaomaste toimeainete kohta esitatud toimikud direktiivi 91/414/EMÜ II lisas esitatud andme- ja teabealastele nõuetele. Näib, et esitatud toimikud vastavad ka direktiivi 91/414/EMÜ III lisas sätestatud andme- ja teabealastele nõuetele ühe asjaomast toimeainet sisaldava taimekaitsevahendi puhul. Taotlejad on seejärel vastavalt direktiivi 91/414/EMÜ artikli 6 lõikele 2 edastanud asjaomased toimikud komisjonile ja teistele liikmesriikidele, samuti toiduahela ja loomatervishoiu alalisele komiteele.

(4) By this Decision it should be formally confirmed at Community level that the dossiers are considered as satisfying in principle the data and information requirements set out in Annex II and, for at least one plant protection product containing the active substance concerned, the requirements set out in Annex III to Directive 91/414/EEC.

(4) Käesoleva otsusega tuleks ühenduse tasandil ametlikult kinnitada, et kõnealuseid toimikuid käsitatakse direktiivi 91/414/EMÜ II lisas ja vähemalt ühe asjaomast toimeainet sisaldava taimekaitsevahendi puhul III lisas sätestatud andme- ja teabealastele nõuetele põhimõtteliselt vastavaina.

(5) This Decision should not prejudice the right of the Commission to request the applicant to submit further data or information in order to clarify certain points in the dossier.

(5) Käesoleva otsusega ei tohiks piirata komisjoni õigust nõuda taotlejalt täiendavate andmete või teabe esitamist teatavate toimiku punktide selgitamiseks.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,

HAS ADOPTED THIS DECISION:

ON VASTU VÕTNUD KÄESOLEVA OTSUSE:

Article 1

Artikkel 1

Without prejudice to Article 6(4) of Directive 91/414/EEC, the dossiers concerning the active substances identified in the Annex to this Decision, which were submitted to the Commission and the Member States with a view to obtaining the inclusion of those substances in Annex I to that Directive, satisfy in principle the data and information requirements set out in Annex II to that Directive.

Ilma et see piiraks direktiivi 91/414/EMÜ artikli 6 lõike 4 kohaldamist, vastavad käesoleva otsuse lisas nimetatud toimeainete kohta esitatud toimikud, mis on komisjonile ja liikmesriikidele esitatud kõnealuste ainete kandmiseks nimetatud direktiivi I lisasse, põhimõtteliselt kõnealuse direktiivi II lisas sätestatud andmete ja teabega seotud nõuetele.

The dossiers also satisfy the data and information requirements set out in Annex III to that Directive in respect of one plant protection product containing the active substance, taking into account the uses proposed.

Samuti vastavad kõnealused toimikud ühte asjaomast toimeainet sisaldava taimekaitsevahendi puhul, arvestades toimeaine kavandatud kasutusviise, kõnealuse direktiivi III lisas sätestatud andme- ja teabealastele nõuetele.

Artikkel 2

The rapporteur Member States shall pursue the detailed examination for the dossiers referred to in Article 1 and shall communicate to the Commission the conclusions of their examination accompanied by a recommendation on the inclusion or non-inclusion in Annex I to Directive 91/414/EEC of the active substances referred to in Article 1 and any conditions for those inclusions as soon as possible and at the latest within a period of one year from the date of publication of this Decision in the Official Journal of the European Union.

Referentliikmesriik jätkab artiklis 1 osutatud asjaomaste toimikute üksikasjalikku läbivaatamist ning esitab selle läbivaatamise tulemused ja soovitused artiklis 1 osutatud toimeainete direktiivi 91/414/EMÜ I lisasse kandmise või kandmata jätmise kohta ning sellega seotud tingimused komisjonile nii kiiresti kui võimalik ja hiljemalt aasta jooksul alates käesoleva otsuse avaldamisest Euroopa Liidu Teatajas.
