THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

por la que se establecen los métodos comunitarios de toma de muestras para el control oficial de los residuos de plaquicidas en las frutas y hortalizas

Having regard to Council Directive 76/895/EEC of 23 November 1976 relating to the fixing of maximum levels for pesticide residues in and on fruit and vegetables (1), and in particular Article 6 thereof,

Whereas that Directive requires that the official checks provided for therein to ensure compliance with maximum levels for pesticide residues in and on fruit and vegetables shall be carried out according to Community methods of sampling and of qualitative and quantitative analysis;

Whereas, as a first stage, methods of sampling should be laid down;

Whereas, in formulating these methods, it has been recognized that on account of the variation in size, state and packaging (if any) of fruit and vegetables which are in circulation, the methods will only be practicable if certain operations are sufficiently empirical;

Vista la Directiva 76/895/CEE del Consejo , de 23 de noviembre de 1976 , referente a la fijación de los contenidos máximos de residuos de plaquicidas en las frutas y hortalizas (1) y , en particular , su artículo 6 ,

Whereas the measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Plant Health,

Considerando que la mencionada Directiva establece que los controles oficiales en ella previstos para comprobar el respeto de los contenidos máximos de residuos de plaquicidas en las plantas y hortalizas se efectúen de acuerdo con métodos comunitarios de toma de muestras y de análisis cualitativo y cuantitativo ;

HAS ADOPTED THIS DIRECTIVE:

Considerando que es conveniente fijar , en una primera fase , los métodos de toma de muestras ;

Considerando que al elaborar dichos métodos se ha partido del supuesto de que sólo se podrán aplicar si se realizan determinadas operaciones de manera suficientemente empírica , habida cuenta de las variaciones en cuanto a tamaño , estado y envase eventual de las frutas y hortalizas que se encuentran en libre circulación ;

Article 1

Considerando que las medidas previstas en la presente Directiva se ajustan al dictamen del Comité fitosanitario permanente ,

The Member States shall require that sampling for the checks provided for in Article 6 of Directive 76/895/EEC be carried out in accordance with the methods described in the Annex hereto.

HA ADOPTADO LA PRESENTE DIRECTIVA :

Los Estados miembros dispondrán que las tomas de muestras previstas en el artículo 6 de la Directiva 76/895/CEE se lleven a cabo de acuerdo con los métodos descritos en el Anexo de la presente Directiva .

The Member States shall, not later than 31 December 1980, bring into force the laws, regulations or administrative provisions necessary to comply with the provisions of this Directive. They shall forthwith notify the Commission thereof.

Artículo 2

Los Estados miembros aplicarán , a más tardar el 31 de diciembre de 1980 las disposiciones legales , reglamentarias y administrativas necesarias para cumplir las disposiciones de la presente Directiva , e informarán de ello inmediatamente a la Comisión .

This Directive is addressed to the Member States.

MÉTODOS DE TOMA DE MUESTRAS

1 . OBJETO Y ÁMBITO DE APLICACIÓN

Las muestras destinadas a los controles oficiales del contenido en residuos de plaguicidas en las frutas y hortalizas se tomarán con arreglo a las modalidades indicadas a continuación . Las muestras finales y de laboratorio obtenidas de esta forma se considerarán representativas de los lotes . La conformidad de los lotes , en lo referente a cualquier contenido máximo fijado de acuerdo con la Directiva 76/895/CEE , se determinará en función de los contenidos encontrados en las muestras finales y de laboratorio .

ANNEX METHODS OF SAMPLING

2 . AGENTES FACULTADOS PARA LA TOMA DE MUESTRAS

1. PURPOSE AND SCOPE

Las tomas las efectuarán agentes autorizados a tal fin por los Estados miembros .

Samples intended for the official control of the levels of pesticide residues in and on fruit and vegetables shall be taken according to the methods described below. Final and laboratory samples thus obtained shall be considered as representative of the lots. Compliance with any maximum levels laid down in accordance with Directive 76/895/EEC shall be established on the basis of the levels determined in the final and laboratory samples.

3 . DEFINICIONES

The samples shall be taken by officers authorized for that purpose by the Member States.

4.2 . Precauciones

4. SAMPLING PROCEDURE 4.1. Material to be sampled

Durante la toma de muestras y la preparación de la muestra de laboratorio , se deberán tomar precauciones con objeto de evitar cualquier alteración que pueda modificar el contenido en residuos , afectar a los análisis o a la representatividad de la muestra de laboratorio .

Each lot which is to be examined must be sampled separately.

En la medida de lo posible , recogerlas en distintos puntos del lote . Consignar cualquier excepción de esta norma en el acta prevista en el punto 5 . Los productos que estén total o fuertemente deteriorados no deberán ser objeto de toma de muestras . El conjunto de las muestras elementales no deberá ser nunca inferior a la cantidad requerida para las muestras de laboratorios citadas en el punto 4.6 .

In the course of sampling and preparation of the laboratory samples precautions must be taken to avoid any changes which would affect the residue content, adversely affect the analytical determinations or make the laboratory samples unrepresentative.

4.3.1 . El número mínimo de muestras elementales que se han de tomar está indicado en la tabla A siguiente . Tomar muestras de la misma importancia , a ser posible .

4.3. Incremental samples

As far as possible these should be taken at various places distributed throughout the lot. Departure from this procedure must be recorded in the record provided for under 5. Goods which are wholly or extensively spoiled are not to be used for sampling. The combined total of the incremental samples must never be less than that required for the laboratory samples as provided for in 4.6. 4.3.1. The minimum number of incremental samples to be taken is given in Table A below. As far as possible the samples should be of similar size.

4.3.2. In the case of frozen goods or if the weight of the lot is unknown to the sampling officer or cannot be sufficiently accurately estimated, the minimum number of incremented samples may, by way of derogation from 4.3.1, be determined in accordance with Table B.

4.3.2 . Cuando se trate de productos congelados o si el agente facultado para la toma de muestras ignor el peso del lote o incluso si éste no se pudiere estimar adecuadamente , el número mínimo de muestras elementales por tomar se podrá determinar con arreglo a la tabla B siguiente , no obstante lo dispuesto en el punto 4.3.1 .

4.5. Preparation of the final sample

The aggregate sample may be used as it stands as the final sample.

If the aggregate sample is too large, the final sample may be prepared from it by a suitable method of reduction, for example by quartering, rejecting two diagonally opposite quarters, mixing and requartering the remainder and so on until the size required is reached. In this process, however, individual fruits and vegetables must not be cut or divided.

4.4 . Preparación de la muestra global

4.6. Preparation of laboratory samples 4.6.1. As many laboratory samples as required by national rules shall be prepared from the final sample.

4.6.2. For mushrooms and truffles, culinary herbs and capers, each laboratory sample shall weigh at least 0 75 kg.

4.5 . Preparación de la muestra final

4.6.3. For other fruit and vegetables, each laboratory sample shall weigh at least 1 kg and shall consist of at least 10 individual fruits or vegetables. However, if the weight of 10 individual fruits or vegetables exceeds 5 kg, the laboratory sample may consist of only five.

La muestra global se podrá utilizar tal cual como muestra final .

Si la muestra global fuere demasiado grande , la muestra final se podrá preparar a partir de aquella por medio de un método de reducción adecuado . Dividir , por ejemplo , la muestra en cuatro partes , siguiendo las diagonales , eliminar dos cuartos opuestos , mezclar el resto ; volver a dividir en cuatro y proseguir las operaciones hasta obtener la cantidad requerida . Sin embargo , la aplicación de este método no debe conducir a cortar o dividir las frutas u hortalizas .

4.6 . Preparación de las muestras de laboratorio

4.6.1 . Preparar a partir de la muestra final tantas muestras de laboratorio como prescriban las normas nacionales .

4.6.2 . En el caso de setas y trufas , de hierbas para cocinar y de alcaparras , cada muestra de laboratorio pesará 0,5 kg por lo menos .

5. PACKAGING AND TRANSMISSION OF LABORATORY SAMPLES

4.6.3 . En lo referente a las demás frutas y hortalizas , cada muestra de laboratorio pesará por lo menos 1 kg y comprenderá 10 unidades de frutas u hortalizas como mínimo . No obstante , si el peso de 10 unidades de frutas u hortalizas fuere superior a 5 kg , la muestra de laboratorio podrá incluir 5 unidades solamente .

Each laboratory sample shall be placed in a clean, inert container offering adequate protection from contamination and against damage in transit. The container shall then be labelled and sealed in such a manner that it cannot be opened or the label removed without damaging the seal. As in 4.2, all necessary precautions shall be taken to avoid any change of composition of the laboratory sample which might arise during transportation or storage.

5 . ACONDICIONAMIENTO Y ENVÍO DE LAS MUESTRAS FINALES

A record must be kept of each sampling, permitting each lot to be identified unambiguously and giving the date and place of sampling together with any additional information likely to be of assistance to the analyst.

Colocar cada muestra de laboratorio en un recipiente limpio de material inerte , que la proteja convenientemente ante cualquier factor de contaminación y daño que pueda derivarse del transporte . Etiquetar y precintar después el recipiente de forma que sea imposible abrirlo o despegar la etiqueta sin deteriorar el precinto . Tomar asimismo todas las precauciones necesarias , como en el punto 4.2 , para evitar cualquier modificación de la composición de la muestra de laboratorio que pueda producirse durante el transporte o el almacenamiento .

Para cada toma de muestras , realizar un acta de toma de muestras que permita identificar sin ambigueedad el lote recogido y dar la fecha y el lugar de la toma de muestra así como cualquier información adicional que pueda ser de utilidad para el analista .
