Having regard to the Treaty on European Union, and in particular third subparagraph of Article 25 thereof,

Having regard to Council Joint Action 2006/319/CFSP of 27 April 2006 on the European Union military operation in support of the United Nations Organisation Mission in the Democratic Republic of the Congo (MONUC) during the election process [1] (Operation EUFOR RD Congo), and in particular Article 10(5) thereof,

Vista la Acción Común 2006/319/PESC del Consejo, de 27 de abril de 2006, sobre la Operación Militar de la Unión Europea de apoyo a la Misión de las Naciones Unidas en la República Democrática del Congo (MONUC) durante el proceso electoral [1] (Operación EUFOR RD Congo), y en particular el apartado 5 de su artículo 10,

Whereas:

Considerando lo siguiente:

(1) Under Article 10(5) of Joint Action 2006/319/CFSP, the Council authorised the Political and Security Committee (PSC) to take relevant decisions on the setting up of a Committee of Contributors for the European Union military operation in the Democratic Republic of the Congo (DRC) in support of MONUC during the election process.

(1) En virtud del apartado 5 del artículo 10 de la Acción Común 2006/319/PESC, el Consejo autorizó al Comité Político y de Seguridad (CPS) a adoptar las decisiones pertinentes sobre el establecimiento de un Comité de Contribuyentes para la Operación Militar de la Unión Europea en la República Democrática del Congo (RED) de apoyo a la MONUC durante el proceso electoral.

(2) The European Council Conclusions of Nice of 7, 8 and 9 December 2000 and Brussels of 24 and 25 October 2002 laid down the arrangements for the participation of third States in crisis management operations and the setting up of a Committee of Contributors.

(2) En las conclusiones de los Consejos Europeos de Niza de 7, 8 y 9 de diciembre de 2000 y de Bruselas de 24 y 25 de octubre de 2002, se establecieron el régimen de participación de terceros Estados en operaciones de gestión de crisis y las modalidades del establecimiento de un comité de contribuyentes.

(3) The Committee of Contributors will play a key role in the day-to-day management of the operation. It will be the main forum where contributing States collectively address questions relating to the employment of their forces in the operation. The PSC, which exercises the political control and strategic direction of the operation, will take account of the views expressed by the Committee of Contributors.

(3) El Comité de Contribuyentes desempeñará un papel fundamental en la gestión cotidiana de la operación. Será el foro principal en el que los Estados contribuyentes traten colectivamente las cuestiones relativas al empleo de sus fuerzas en la operación. El CPS, que ejerce el control político y la dirección estratégica de la operación, tendrá en cuenta las opiniones expresadas por el Comité de Contribuyentes.

(4) In accordance with Article 6 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark does not participate in the elaboration and implementation of decisions and actions of the European Union which have defence implications,

HAS DECIDED AS FOLLOWS:

DECIDE:

Article 1

Establishment and terms of reference

Creación y mandato

A Committee of Contributors for the European Union military operation in the DRC in support of MONUC during the election process (hereafter called "the CoC") is hereby established. Its terms of reference are laid down in the European Council Conclusions of Nice and Brussels.

Se crea por la presente Decisión un Comité de Contribuyentes para la Operación Militar de la Unión Europea de apoyo a la Misión de las Naciones Unidas en la República Democrática del Congo (MONUC) durante el proceso electoral (denominado en lo sucesivo "el CdC"). El mandato del CdC está fijado en las conclusiones de los Consejos Europeos de Niza y Bruselas.

Article 2

1. The CoC members shall be as follows:

- representatives of all Member States,

- representantes de todos los Estados miembros, y

- representatives of third States participating in the operation and providing significant military contributions, as referred to in the Annex.

2. The Director General of the European Union Military Staff and the EU Operation Commander shall also be entitled to attend, or to be represented at, the CoC meetings.

2. También podrán asistir a las reuniones del CdC o estar representados en ellas el Director General del Estado Mayor de la UE y el Comandante de la Operación de la UE.

In accordance with the European Council conclusions of Nice and without prejudice to the prerogatives of the Presidency, the CoC for this operation shall be chaired by the Secretary-General/High Representative or his representative in close consultation with the Presidency, assisted by the Chairman of the European Union Military Committee (CEUMC) or his representative.

De acuerdo con las conclusiones del Consejo Europeo de Niza y sin perjuicio de las prerrogativas de la Presidencia, presidirá el CdC para la presente operación el Secretario General/Alto Representante o su representante, en estrecha consulta con la Presidencia y asistido por el Presidente del Comité Militar de la Unión Europea o su representante.

Meetings

1. The CoC shall be convened by the Chair on a regular basis. Where circumstances require, emergency meetings may be convened on the Chair's initiative, or at the request of a member.

1. El CdC será convocado periódicamente por su Presidente. Podrán convocarse reuniones urgentes cuando las circunstancias lo requieran, por iniciativa del Presidente o a petición de un miembro.

2. The Chair shall circulate in advance a provisional agenda and documents relating to the meeting. Summary of the meetings shall be circulated after each meeting.

2. El Presidente difundirá con antelación un orden del día provisional así como los documentos relativos a la reunión. Se difundirá un acta después de cada reunión.

3. Representatives of the Commission and other persons may be invited for relevant parts of the discussion, as appropriate.

3. Se podrá invitar, según convenga, a representantes de la Comisión y a otras personas para partes concretas del debate.

1. Except as provided in paragraph 3 and without prejudice to the competencies of the PSC and the responsibilities of the EU Operation Commander,

- unanimity of the representatives of States contributing to the operation shall apply when the CoC takes decisions on the day-to-day management of the operation,

- será necesaria la unanimidad de los representantes de los Estados que contribuyen a la operación cuando el CdC adopte decisiones sobre su gestión diaria;

- unanimity of the CoC members shall apply when the CoC makes recommendations on possible adjustments to operational planning, including possible adjustment to objectives.

- será necesaria la unanimidad de los miembros del CdC cuando éste formule recomendaciones sobre posibles ajustes del planeamiento operativo y, en particular, de los objetivos.

The abstention of a member shall not preclude unanimity.

La abstención de un miembro no impedirá la unanimidad.

2. The Chair shall establish that the majority of the representatives of States entitled to take part in the deliberations is present.

2. El Presidente comprobará que están presentes la mayoría de los representantes de los Estados con derecho a participar en las deliberaciones.

3. All procedural questions shall be settled by the simple majority of the members present at the meeting.

3. Todas las cuestiones de procedimiento se resolverán por mayoría simple de los miembros presentes en la reunión.

4. Denmark shall not take part in any decision of the Committee.

1. The Council Security Regulations shall apply to the meetings and proceedings of the CoC. In particular, representatives in the CoC shall possess adequate security clearance.

2. The deliberations of the CoC shall be covered by the obligation of professional secrecy, except insofar the CoC unanimously decides otherwise.

2. Las deliberaciones del CdC estarán sujetas a la obligación de secreto profesional, salvo que el CdC decida otra cosa por unanimidad.

This Decision shall enter into force on the day of its adoption.
