Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

Vista la Directiva 96/49/CE del Consejo, de 23 de julio de 1996 , sobre la aproximación de las legislaciones de los Estados miembros relativas al transporte de mercancías peligrosas por ferrocarril(1) y, en particular, su artículo 8,

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) El anexo de la Directiva 96/49/CE menciona el Reglamento relativo al transporte internacional ferroviario de mercancías peligrosas (RID), en su forma de aplicación a partir del 1 de julio de 2003 .

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) El RID suele actualizarse cada dos años. Por consiguiente, la versión modificada entrará en vigor el 1 de enero de 2003 , con un período transitorio hasta el 30 de junio de 2003 .

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

Article 1

The Annex to Directive 96/49/EC is replaced by the following:

El anexo de la Directiva 96/49/CE quedará redactado como sigue:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

«Reglamento relativo al transporte internacional ferroviario de mercancías peligrosas (RID), que figura en el anexo I del apéndice B del Convenio relativo a los transportes internacionales ferroviarios (COTIF) en su forma de aplicación a partir del 1 de enero de 2004 , entendiéndose que los términos «parte contratante» y «los Estados o los ferrocarriles» son sustituidos por los términos «Estado miembro» .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

El texto de las modificaciones de la versión de 2004 del RID se publicará en cuanto esté disponible en todas las lenguas oficiales de la Comunidad.» .

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Los Estados miembros pondrán en vigor las disposiciones legales, reglamentarias y administrativas necesarias para dar cumplimiento a lo establecido en la presente Directiva, antes del 1 de octubre de 2004 . Comunicarán inmediatamente a la Comisión el texto de dichas disposiciones y una tabla de correlación entre las mismas y la presente Directiva.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Cuando los Estados miembros adopten dichas disposiciones, éstas harán referencia a la presente Directiva o irán acompañadas de dicha referencia en su publicación oficial. Los Estados miembros establecerán las modalidades de la mencionada referencia.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Los Estados miembros comunicarán a la Comisión el texto de las disposiciones de Derecho interno que adopten en el ámbito regulado por la presente Directiva.

Article 3

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

La presente Directiva entrará en vigor el vigésimo día siguiente al de su publicación en el Diario Oficial de la Unión Europea .

This Directive is addressed to the Member States.

Los destinatarios de la presente Directiva serán los Estados miembros.
