THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 66/401/EEC of 14 June 1966 on the marketing of fodder plant seed(1), as last amended by Directive 2003/61/EC(2), and in particular Article 17(1) thereof,

Vista la Directiva 66/401/CEE del Consejo, de 14 de junio de 1966, relativa a la comercialización de las semillas de plantas forrajeras(1), cuya última modificación la constituye la Directiva 2003/61/CE(2), y, en particular, el apartado 1 de su artículo 17,

Whereas:

Considerando lo siguiente:

(1) In the United Kingdom the quantity of available seed of spring varieties of field beans (Vicia faba L.) suitable to the national climatic conditions and which satisfies the germination capacity requirements of Directive 66/401/EEC is insufficient and is therefore not adequate to meet the needs of that Member State.

(1) En el Reino Unido, la cantidad disponible de semillas de variedades de primavera de habas y haboncillos (Vicia faba L.) aptas para las condiciones climáticas del país y que cumplen los requisitos de capacidad germinativa de la Directiva 66/401/CEE es insuficiente y, por tanto, inadecuada para satisfacer las necesidades de dicho Estado miembro.

(2) It is not possible to meet the demand for seed of that species satisfactorily with seed from other Member States or from third countries which satisfies all the requirements laid down in Directive 66/401/EEC.

(2) No es posible satisfacer la demanda de semillas de dicha especie con semillas de otros Estados miembros o de terceros países que cumplan todos los requisitos establecidos en la Directiva 66/401/CEE.

(3) Accordingly, the United Kingdom should be authorised to permit the marketing of seed of that species subject to less stringent requirements for a period expiring on 15 February 2004.

(3) En consecuencia, se debería autorizar al Reino Unido a que permita la comercialización de semillas de la citada especie en unas condiciones menos rigurosas durante un plazo que finalizaría el 15 de febrero de 2004.

(4) In addition, other Member States, irrespective of whether the seed was harvested in a Member State or in a third country covered by the Council Decision 2003/17/EC on the equivalence of seed(3), which are in a position to supply the United Kingdom with seed of that species, should be authorised to permit the marketing of such seed.

(4) Asimismo, se debería autorizar a otros Estados miembros que estén en condiciones de suministrar al Reino Unido semillas de la citada especie a que permitan su comercialización, tanto si han sido recogidas en un Estado miembro, como si han sido recogidas en un tercer país contemplado en la Decisión 2003/17/CE del Consejo sobre la equivalencia de las semillas(3).

(5) It is appropriate that the United Kingdom act as coordinator in order to ensure that the total amount of seed authorised pursuant to this Decision does not exceed the maximum quantity covered by this Decision.

(5) Conviene que el Reino Unido actué como coordinador para garantizar que la cantidad total de semillas autorizada en virtud de la presente Decisión no supere la cantidad máxima contemplada en la presente Decisión.

(6) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Seeds and Propagating Material for Agriculture, Horticulture and Forestry,

HAS ADOPTED THIS DECISION

HA ADOPTADO LA PRESENTE DECISIÓN

Article 1

Artículo 1

The marketing in the Community of seed of spring field beans (Vicia faba L.) which does not satisfy the minimum germination capacity requirements laid down in Directive 66/401/EEC shall be permitted, for a period expiring on 15 February 2004, in accordance with the terms set out in the Annex to this Decision and subject to the following conditions:

Se permitirá la comercialización en la Comunidad de semillas de habas y haboncillos de primavera (Vicia faba L.) que no cumplan los requisitos mínimos de capacidad germinativa establecidos en la Directiva 66/401/CEE durante un plazo que finalizará el 15 de febrero de 2004, con arreglo a lo dispuesto en el anexo de la presente Decisión y en las condiciones siguientes:

(a) the germination capacity must be at least that set out in the Annex to this Decision;

a) la capacidad germinativa deberá ser, como mínimo, la establecida en el anexo de la presente Decisión;

(b) the official label must state the germination ascertained in the official examination carried out pursuant to Article 2(1)(C)(d) of Directive 66/401/EEC;

b) la etiqueta oficial deberá indicar la germinación determinada en el examen oficial realizado en virtud de la letra d) del punto C del apartado 1 del artículo 2 de la Directiva 66/401/CEE;

(c) the seed must have been first placed on the market in accordance with Article 2 of this Decision.

Article 2

Any seed supplier wishing to place on the market the seeds referred to in Article 1 shall apply for authorisation to the Member State in which he is established or importing.

Todo proveedor de semillas que desee comercializar las semillas mencionadas en el artículo 1 deberá solicitar una autorización al Estado miembro en que esté establecido o al Estado miembro importador.

The Member State concerned shall authorise the supplier to place that seed on the market, unless:

El Estado miembro autorizará al proveedor a que comercialice las semillas, salvo cuando:

(a) there is sufficient evidence to doubt as to whether the supplier is able to place on the market the amount of seed for which he has applied for authorisation; or

a) existan fundadas razones para dudar de si el proveedor podrá comercializar o no la cantidad de semillas para la cual solicita autorización, o

(b) the total quantity authorised to be marketed pursuant to the derogation concerned would exceed the maximum quantity specified in the Annex.

Article 3

The Member States shall assist each other administratively in the application of this Decision.

Los Estados miembros se prestarán asistencia administrativa a efectos de aplicación de lo dispuesto en la presente Decisión.

The United Kingdom shall act as coordinating Member State in respect of Article 1 in order to ensure that the total amount authorised does not exceed the maximum quantity specified in the Annex.

El Reino Unido actuará como Estado miembro coordinador en relación con el artículo 1, a fin de velar por que la cantidad total autorizada no sobrepase la cantidad máxima que se especifica en el anexo.

Any Member State receiving an application in accordance with Article 2 shall immediately notify the coordinating Member State of the amount covered by the application. The coordinating Member State shall immediately inform the notifying Member State as to whether authorisation would result in the maximum quantity being exceeded.

Todo Estado miembro que reciba una solicitud conforme a lo dispuesto en el artículo 2 notificará inmediatamente al Estado miembro coordinador la cantidad solicitada. Este último comunicará inmediatamente al Estado miembro notificante si dicha autorización provocaría el rebasamiento de la cantidad máxima.

Article 4

Member States shall immediately notify the Commission and the other Member States of the quantities in respect of which they have granted marketing authorisation pursuant to this Decision.

Los Estados miembros notificarán inmediatamente a la Comisión y a los demás Estados miembros las cantidades de semillas autorizadas a ser comercializadas en virtud de la presente Decisión.

Article 5

This Decision is addressed to the Member States.

Los destinatarios de la presente Decisión serán los Estados miembros.
