THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 308 thereof,

Whereas:

Considerando lo siguiente:

(1) By Decision 97/787/EC [2] the Council provided exceptional financial assistance for Armenia and Georgia in the form of long-term loans and grants.

(1) Mediante la Decisión 97/787/CE [2], el Consejo concedió una ayuda financiera excepcional a Armenia y Georgia en forma de préstamos a largo plazo y subvenciones.

(2) By Decision 2000/244/EC the Council provided exceptional financial assistance for Tajikistan and extended the implementation period of the assistance to Armenia and Georgia until 2004.

(2) Mediante la Decisión 2000/244/CE, el Consejo concedió una ayuda financiera excepcional a Tayikistán y amplió el período de aplicación de la misma a Armenia y Georgia hasta 2004.

(3) In case of Georgia, the objectives of the assistance have not been fully met, owing to an unsatisfactory economic policy environment in the country during most of the implementation period.

(3) En el caso de Georgia, los objetivos de la ayuda no se han alcanzado plenamente, debido al insatisfactorio marco de política económica existente en el país durante la mayor parte de su período de ejecución.

(4) Therefore, only EUR 31,5 million of the total grant component of EUR 65 million for Georgia was committed and paid under the exceptional financial assistance.

(4) Por consiguiente, sólo 31,5 millones EUR, de la subvención total de 65 millones EUR asignada a Georgia, se habían comprometido y pagado en el marco de la ayuda financiera excepcional.

(5) The present authorities of Georgia are committed to economic stabilisation and structural reforms, supported by the International Monetary Fund (IMF) through a three-year arrangement under the Poverty Reduction and Growth Facility (PRGF) which was approved on 4 June 2004 for a total amount of SDR 98 million. Subsequently, the Paris Club creditors agreed on 21 July 2004 to a restructuring of Georgia’s bilateral official debt on the Houston terms.

(5) Las autoridades actuales de Georgia se han comprometido con la realización de reformas estructurales y la estabilización económica, con el apoyo del Fondo Monetario Internacional (FMI) mediante un acuerdo trienal en el marco del Servicio financiero de reducción de la pobreza y crecimiento (SRPC), que se aprobó el 4 de junio de 2004 por un importe total de 98 millones DEG. Posteriormente, el Club de acreedores de París acordó el 21 de julio de 2004 una reestructuración de la deuda oficial bilateral de Georgia según las condiciones de Houston.

(6) The new Government of Georgia also received strong support from the international community at the donors’ conference held in Brussels on 16 June 2004.

(6) El nuevo Gobierno de Georgia también recibió un gran apoyo de la comunidad internacional en la conferencia de donantes celebrada en Bruselas el 16 de junio de 2004.

(7) The World Bank approved in June 2004 a USD 24 million Reform Support Credit, and will continue its assistance to Georgia under a new Country Partnership Strategy in the form of Poverty Reduction Support Operations.

(7) En junio de 2004, el Banco Mundial aprobó un préstamo de apoyo de la reforma por importe de 24 millones USD, y proseguirá su ayuda a Georgia en el marco de una nueva estrategia de asociación con el país (Country Partnership Strategy) por medio de operaciones de apoyo a la reducción de la pobreza.

(8) The Georgian authorities have expressed their intention to pursue early debt repayments to the Community with a view to improving debt sustainability.

(8) Las autoridades de Georgia han manifestado su intención de proseguir sus reembolsos anticipados de la deuda con la Comunidad a fin de mejorar la sostenibilidad de su deuda.

(9) As EU-Georgia relations are developing within the framework of the European Neighbourhood Policy, which is expected to lead to deeper economic integration, Community support for the government’s economic reform programme is considered appropriate.

(9) Habida cuenta de que las relaciones entre la Unión Europea y Georgia están desarrollándose en el marco de la política europea de relaciones con los países vecinos, que se espera lleve a una mayor integración económica, el apoyo de la Comunidad al programa de reforma económica del Gobierno se considera adecuado.

(10) Making available an amount equivalent to the uncommitted grant component of the exceptional financial assistance, which would support the country’s economic reforms and help reduce external indebtedness, is an appropriate contribution by the Community to the implementation of poverty reduction and growth strategies in Georgia.

(10) La puesta a disposición de un importe equivalente al de la subvención no comprometida de la ayuda financiera excepcional, que respaldaría las reformas económicas del país y contribuiría a reducir su endeudamiento exterior, constituye una contribución adecuada de la Comunidad a la aplicación de las estrategias de reducción de la pobreza y crecimiento en Georgia.

(11) In order to ensure efficient protection of the Community’s financial interests in connection with the present macro-financial assistance, it is necessary to provide for appropriate measures by Georgia in relation to the prevention of and the fight against fraud, corruption and any other irregularities linked to this assistance, as well as for controls by the Commission and audits by the Court of Auditors.

(11) Con objeto de garantizar una protección eficaz de los intereses financieros de la Comunidad en relación con la presente ayuda macrofinanciera, es necesario contemplar la adopción por parte de Georgia de medidas adecuadas relativas a la prevención y la lucha contra el fraude, la corrupción y otras posibles irregularidades relacionadas con la ayuda, así como la realización de controles por parte de la Comisión y de auditorías por parte del Tribunal de Cuentas.

(12) The Commission services, with the support of duly mandated external experts, carried out in October 2004 an operational assessment of the financial circuits and administrative procedures at the Ministry of Finance of Georgia and the National Bank of Georgia to ascertain the existence of a framework for sound financial management.

(12) Los servicios de la Comisión, con el apoyo de expertos externos debidamente autorizados, efectuaron en octubre de 2004 una evaluación operativa de los circuitos financieros y procedimientos administrativos existentes en el ministerio de Hacienda y el Banco Nacional de Georgia con objeto de verificar la existencia de un marco apropiado para una gestión financiera equilibrada.

(13) The release of this grant assistance is without prejudice to the powers of the budgetary authority.

(13) El desembolso de esta ayuda en forma de subvención se realiza sin perjuicio de las facultades de la autoridad presupuestaria.

(14) The Commission has consulted the Economic and Financial Committee before submitting its proposal.

(14) La Comisión ha consultado al Comité Económico y Financiero antes de presentar su propuesta.

(15) The Treaty provides for no powers, other than those of Article 308 thereof, for the adoption of this Decision,

HAS DECIDED AS FOLLOWS:

DECIDE:

Article 1

Artículo 1

1. The Community shall make available to Georgia macro-financial assistance in the form of straight grants up to a maximum amount of EUR 33,5 million with a view to supporting economic reforms and helping the country improve debt sustainability.

1. La Comunidad pondrá a disposición de Georgia una ayuda macrofinanciera en forma de subvenciones por un importe máximo de 33,5 millones EUR con vistas a respaldar las reformas económicas y ayudar al país a mejorar la sostenibilidad de su deuda.

2. This Community macro-financial assistance shall be managed by the Commission in consultation with the Economic and Financial Committee and in a manner fully consistent with the agreements reached between the IMF and Georgia.

2. Esta ayuda macrofinanciera de la Comunidad será gestionada por la Comisión en consulta con el Comité Económico y Financiero y de forma totalmente coherente con los acuerdos alcanzados entre el FMI y Georgia.

3. The Community macro-financial assistance shall be made available for two years starting from the first day after the entry into force of this Decision. However, if circumstances so require, the Commission, after consulting the Economic and Financial Committee, may decide to extend the availability period by a maximum of one year.

3. La ayuda macrofinanciera de la Comunidad será puesta a disposición durante un período de dos años a partir del día siguiente a la entrada en vigor de la presente Decisión. Sin embargo, si las circunstancias así lo requieren, la Comisión, previa consulta al Comité Económico y Financiero, podrá decidir la prórroga del período de puesta a disposición por un año como máximo.

Article 2

Artículo 2

1. The Commission shall be empowered to agree with the authorities of Georgia, after consulting the Economic and Financial Committee, the economic policy and financial conditions attached to this assistance, to be laid down in a Memorandum of Understanding. These conditions shall be consistent with the agreements reached between the IMF and Georgia.

La Comisión estará facultada para acordar con las autoridades de Georgia, previa consulta al Comité Económico y Financiero, las condiciones financieras y de política económica asociadas a esta ayuda, que deberán establecerse en un memorándum de acuerdo. Estas condiciones deberán ser compatibles con los acuerdos alcanzados entre el FMI y Georgia.

2. During the implementation of the Community assistance, the Commission shall monitor the soundness of Georgia’s financial circuits, administrative procedures and internal and external control mechanisms which are relevant to this Community macro-financial assistance.

2. Durante la ejecución de la ayuda de la Comunidad, la Comisión deberá supervisar la adecuación de los circuitos financieros, los procedimientos administrativos y los mecanismos de control interno y externo de Georgia que son pertinentes para esta ayuda macrofinanciera de la Comunidad.

3. The Commission shall verify at regular intervals that the government’s economic policies are in accordance with the objectives of this assistance and that the agreed economic policy and financial conditions are being fulfilled.

3. La Comisión deberá verificar a intervalos regulares que las políticas económicas del Gobierno se ajustan a los objetivos de la presente ayuda y que se están cumpliendo las condiciones financieras y de política económica acordadas.

Article 3

Artículo 3

1. The grant amount shall be made available to Georgia in at least two instalments insofar as its net debtor position towards the Community has been reduced, as a rule, by at least a similar amount.

1. El importe de la subvención se pondrá a disposición de Georgia en al menos dos tramos en la medida en que su endeudamiento neto respecto de la Comunidad se haya reducido, por regla general, en al menos un importe similar.

2. The first grant instalment shall be released on the basis of a satisfactory implementation of the economic programme supported by the IMF under the Poverty Reduction and Growth Facility.

2. El desembolso del primer tramo de subvención estará supeditado a una aplicación satisfactoria del programa económico respaldado por el FMI en el marco del Servicio financiero de reducción de la pobreza y crecimiento.

The second and any further instalments shall be released on the basis of a satisfactory implementation of the IMF-supported economic programme and any other measures laid down in the Memorandum of Understanding referred to in Article 2(1), and not before three months have elapsed since the release of the previous instalment.

El desembolso del segundo y otros posibles tramos estará supeditado a la aplicación satisfactoria del programa económico respaldado por el FMI y de cualesquiera otras medidas establecidas en el memorándum de acuerdo con que se refiere el artículo 2, apartado 1, y, en cualquier caso, no antes de transcurrido un trimestre tras el desembolso del tramo anterior.

3. The funds shall be paid to the National Bank of Georgia. The final recipient of the funds will be the Ministry of Finance of Georgia.

3. Los fondos se pagarán al Banco Nacional de Georgia. El receptor final de los fondos será el Ministerio de Hacienda de Georgia.

Article 4

Artículo 4

The implementation of this assistance shall take place in accordance with the provisions of Council Regulation (EC, Euratom) No 1605/2002, of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities [3] and its implementing rules. In particular, the Memorandum of Understanding referred to in Article 2(1) shall provide for appropriate measures by Georgia in relation to the prevention of and the fight against fraud, corruption and any other irregularities linked to this assistance. It shall also provide for controls by the Commission, including the European Anti-Fraud Office (OLAF), with the right to perform on-the-spot checks and inspections, and for audits by the Court of Auditors, where appropriate, to be carried out on the spot.

La ejecución de la presente ayuda tendrá lugar de conformidad con el Reglamento (CE, Euratom) no 1605/2002 del Consejo, de 25 de junio de 2002, por el que se aprueba el Reglamento financiero aplicable al presupuesto general de las Comunidades Europeas [3], y sus normas de desarrollo. En particular, el memorándum de acuerdo con que se refiere el artículo 2, apartado 1, dispondrá las medidas adecuadas que deberá adoptar Georgia relativas a la prevención y la lucha contra el fraude, la corrupción y otras posibles irregularidades relacionadas con la ayuda. También contemplará la realización de controles por parte de la Comisión, en particular, a través de la Oficina Europea de Lucha contra el Fraude (OLAF), con el derecho a realizar inspecciones y verificaciones in situ, y de auditorías por parte del Tribunal de Cuentas, en su caso, in situ.

Article 5

Artículo 5

At least once a year, before September, the Commission shall submit to the European Parliament and to the Council a report including an evaluation of the implementation of this Decision in the previous year.

Al menos una vez al año, y, en cualquier caso, antes de septiembre, la Comisión deberá presentar al Parlamento Europeo y al Consejo un informe que incluirá una evaluación de la aplicación de la presente Decisión el año anterior.

Article 6

This Decision shall take effect on the day of its publication in the Official Journal of the European Union.

La presente Decisión entrará en vigor el día de su publicación en el Diario Oficial de la Unión Europea.
