Vista la Directiva 76/893/CEE del Consejo , de 23 de noviembre de 1976 , relativa a la aproximación de las legislaciones de los Estados miembros sobre los materiales y objetos destinados a entrar en contacto con productos alimenticios (1) y , en particular , su artículo 3 ,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 76/893/EEC of 23 November 1976 on the approximation of the laws of the Member States relating to materials and articles intended to come into contact with foodstuffs (1), and in particular Article 3 thereof,

Considerando que el artículo 2 de la Directiva 76/893/CEE dispone en concreto que los materiales y objetos no deben ceder a los productos alimenticios constituyentes en una cantidad que pueda presentar peligro para la salud humana e implicar una modificación inaceptable de la composición de los productos alimenticios ;

Having regard to the opinion of the Economic and Social Committee (3),

Considerando que , en el caso de las materias plásticas , el instrumento apropiado para alcanzar dicho objetivo es una directiva específica en el sentido del artículo 3 de la Directiva 76/893/CEE , cuyas reglas generales se hacen también aplicables al caso de que ahora se trata ;

Whereas Article 2 of Directive 76/893/EEC laid down inter alia that materials and articles must not transfer their constituents to foodstuffs in quantities which could endanger human health or bring about an unacceptable change in the composition of the foodstuffs;

Considerando que , vista la complejidad del problema , conviene limitarse , en un primer momento , a fijar las normas básicas de control de la migración de los constituyentes y que , ulteriores directivas que deberán adoptarse con arreglo al procedimiento previsto en el artículo 10 de la Directiva 76/893/CEE fijarán los métodos de análisis necesarios para el control de la citada migración ;

Whereas in order to achieve this objective in the case of plastic materials the suitable instrument is a specific directive within the meaning of Article 3 of Directive 76/893/EEC, the general rules of which shall also be applicable to the case in question;

Considerando que la presente Directiva no contempla todos los aspectos de los materiales y objetos de materia plástica y que , así pues , conviene autorizar a los Estados miembros , por una parte , a no exigir las indicaciones de etiquetado fijadas en el artículo 7 de la Directiva 76/893/CEE , de conformidad con los apartados 4 y 5 del citado artículo , y , por otra parte , a prohibir la comercialización de los materiales y objetos que , aún ajustándose a las normas definidas por la citada Directiva , no reúnan las condiciones nacionales relativas a otras posibles normas previstas en el artículo 3 o , en su defecto , en el artículo 2 de la Directiva de que se trata ;

Whereas, given the complexity of the problem, the Directive should initially be limited to fixing the basic rules for verification of constituent migration; whereas further directives, to be adopted in accordance with the procedure laid down in Article 10 of Directive 76/893/EEC, will establish the methods of analysis necessary for the verification of such migration;

Considerando que , a causa de las dificultades analíticas relacionadas con la determinación de las tasas de migración en los productos alimenticios , conviene elegir pruebas convencionales ( líquido apto para simular el ataque de los alimentos y condiciones de ensayo normalizadas ) que puedan reproducir , hasta el límite de lo posible , los fenómenos de migración que puedan resultar del contacto objeto-alimento ;

Whereas this Directive does not affect all aspects of plastic materials and articles; whereas it is therefore necessary to authorize the Member States, on the one hand, not to impose the labelling particulars laid down in Article 7 of Directive 76/893/EEC in accordance with paragraphs 4 and 5 of that Article and, on the other hand, to prohibit the marketing of materials and articles which, although conforming with the standards laid down by that Directive, do not comply with national provisions regarding other possible standards referred to in Article 3 or in the absence of these, with Article 2 of the Directive in question;

Considerando que , si en consecuencia resulta que las citadas pruebas no reflejan la realidad , procede autorizar a los Estados miembros a modificarlas provisionalmente en espera de una decisión comunitaria ;

Whereas, in view of the analytical difficulties connected with the determination of the migration levels in food products, conventional tests should be chosen (liquids capable of simulating the attack on foodstuffs and standard test conditions) in order to reproduce, as far as possible, the migration phenomena which may occur in contact between the article and the foodstuff;

Considerando que el estado actual de las técnicas analíticas no permite determinar todas las condiciones en las que deben efectuarse a pruebas de cesión convencionales en el caso de los materiales y objetos compuestos de dos o más capas , una de las cuales al menos no esté constituida por materia plástica ; que , así pues , conviene que la decisión sobre la aplicación de la presente Directiva a dichos materiales y objetos se tome con posterioridad ;

Whereas if such tests subsequently prove not to reflect reality Member States should be authorized to amend them provisionally, pending a Community decision;

Considerando que la adaptación al progreso técnico de la presente Directiva es una medida de aplicación , y que conviene confiar su adopción a la Comisión con el fin de simplificar y acelerar el procedimiento ;

Whereas, in the current state of analytical techniques, it is not possible to determine all the conditions under which conventional migration tests should be performed on materials and articles consisting of two or more layers, one or more of which does not consist entirely of plastics; whereas a decision on the application of this Directive to such materials and articles should therefore be taken at a later date;

Considerando que , en todos los casos en los que el Consejo confiere competencias a la Comisión para la ejecución de las disposiciones que se refieran al sector de los materiales y objetos de materia plástica destinados a entrar en contacto con productos alimenticios , conviene prever un procedimiento que establezca una estrecha cooperación entre los Estados miembros y la Comisión en el seno del Comité permanente de productos alimenticios , creado por la Decisión 69/414/CEE (4) ,

Whereas the adaptation of this Directive to technical progress is an implementing measure; whereas, in order to simplify and accelerate the procedure, this should be the responsibility of the Commission;

HA ADOPTADO LA PRESENTE DIRECTIVA :

Whereas in all cases in which the Council confers on the Commission authority to implement the provisions relating to plastic materials and articles intended to come into contact with foodstuffs, a procedure should be laid down establishing close cooperation between Member States and the Commission within the Standing Committee for Foodstuffs set up under Decision 69/414/EEC (1),

Artículo 1

HAS ADOPTED THIS DIRECTIVE:

1 . La presente Directiva será una directiva específica en el sentido del artículo 3 de la Directiva 76/893/CEE .

Article 1

2 . La presente Directiva se aplicará a los materiales y objetos de materia plástica , es decir a los materiales y objetos y a sus partes integrantes que estén :

1. This Directive is a specific Directive within the meaning of Article 3 of Directive 76/893/EEC.

a ) constituidas exclusivamente de materia plástica

2. This Directive shall apply to plastic materials and articles, that is to say to materials and articles and parts thereof:

o

(a) consisting exclusively of plastics, or

b ) compuestas de dos o más capas cada una de las cuales esté constituida exclusivamente de materia plástica y que estén unidas entre sí por medio de adhesivos o por cualquier otro medio ,

(b) composed of two or more layers of materials, each consisting exclusively of plastics, which are bound together by means of adhesives or by any other means,

y que , en el estado de productos acabados , estén destinados a ponerse en contacto o estén puestos en contacto , con arreglo a su destino , con productos alimenticios .

which, in the finished product state, are intended to come into contact or are brought into contact with foodstuffs and are intended for that purpose.

3 . A los efectos de la presente Directiva , se entiende por « materia plástica » el compuesto macromolecular orgánico obtenido por polimerización , policondensación , poliadición u otro procedimiento similar a partir de moléculas de peso molecular inferior o por modificación química de macromoléculas naturales . Se considerarán asimismo materias plásticas las siliconas y otros compuestos macromoleculares similares . A dicho compuesto macromolecular podrán añadirse otras substancias o materias .

3. For the purposes of this Directive, 'plastics' shall mean the organic macromolecular compounds obtained by polymerization, polycondensation, polyaddition or any other similar process from molecules with a lower molecular weight or by chemical alteration of natural macromolecules. Silicones and other similar macromolecular compounds shall also be regarded as plastics. Other substances or matter may be added to such macromolecular compounds.

Sin embargo , no podrán considerarse « materias plásticas » :

However, the following shall not be regarded as 'plastics':

i ) las películas de celulosa regenerada barnizadas y no barnizadas ;

(i) varnished or unvarnished regenerated cellulose film;

ii ) los elastómetros y cauchos naturales y sintéticos ;

(ii) elastomers and natural and synthetic rubber;

iii ) los papeles y cartones , modificados o no por añadido de materia plástica ;

(iii) paper and paperboard, whether modified or not by the addition of plastics;

iv ) los revestimientos de superficie obtenidos a partir de :

(iv) surface coatings obtained from:

- ceras de parafina , incluidas las ceras de parafina sintética y/o ceras microcristalinas ,

- paraffin waxes, including synthetic paraffin waxes, and/or micro-crystalline waxes,

- mezclas de ceras mencionadas en el primer guión , entre sí y/o con materias plásticas .

- mixtures of the waxes listed in the first indent with each other and/or with plastics.

4 . La presente Directiva no se aplicará a los materiales y objetos compuestos por dos o más capas , cuando al menos una de ellas no esté exclusivamente constituida por materias plásticas , incluso si la destinada a entrar en contacto directo con los productos alimenticios estuviera constituida exclusivamente por materia plástica .

4. This Directive shall not apply to materials and articles composed or two or more layers, one or more of which does not consist exclusively of plastics, even if the one intended to come into direct contact with foodstuffs does consist exclusively of plastics.

Se decidirá posteriormente la aplicación de la presente Directiva a los materiales y objetos contemplados en el artículo 1 , así como las adaptaciones de la presente Directiva que se consideren necesarios .

A decision on the application of this Directive to the materials and articles referred to in the first subparagraph and on any adaptations to the Directive that may become necessary shall be taken at a later date.

Artículo 2

Article 2

1 . La tasa de migración de los constituyentes de los materiales y objetos mencionados en el artículo 1 en el interior o sobre los productos alimenticios no deberá rebasar los límites que se fijen en las listas de las substancias y materias cuyo uso se autorice con exclusión de cualesquiera otras .

1. The migration level of the constituents of the materials and articles referred to in Article 1 into or onto foodstuffs must not exceed the limits laid down in the lists of substances whose use is authorized to the exclusion of any others.

2 . A falta de métodos de análisis establecidos con arreglo al artículo 9 de la Directiva 76/893/CEE que permitan determinar la tasa de migración en los productos alimenticios , ésta se determinará en los simuladores que figuran en el Capítulo 1 del Anexo .

2. In the absence of methods of analysis determined in accordance with Article 9 of Directive 76/893/EEC which make it possible to determine the level of migration into foodstuffs, that level shall be determined in the simulants listed in Chapter I of the Annex.

3 . El Consejo , a propuesta de la Comisión mediante el procedimiento del artículo 100 del Tratado , establecerá la lista de substancias o materias cuyo empleo se autorice con exclusión de cualesquiera otras , así como la lista y la concentración de los simuladores que deban utilizarse para cada producto alimenticio o grupo de productos alimenticios .

3. The Council, acting in accordance with the procedure laid down in Article 100 of the Treaty and on a proposal from the Commission, shall draw up a list of substances or matter whose use is authorized to the exclusion of any others and a list of simulants to be used for each foodstuff or group of foodstuffs and shall determine the concentration thereof.

1 . El control de migración en los simuladores se efectuará mediante pruebas de cesión convencionales , cuyas normas básicas se establecen en el Anexo .

1. Verification of a migration in the simulants shall be carried out using conventional migration tests, the basic rules for which are laid down in the Annex to this Directive.

2 . a ) Sin embargo , si un Estado miembro , como resultado de la obtención de nuevos datos de una nueva valoración de los datos existentes efectuada con posterioridad a la adopción de la presente Directiva , comprobará que con respecto a un material o un objeto de materia plástica las normas de base para las pruebas de cesión previstas en el Anexo fuesen inapropiadas por razones técnicas o porque las condiciones reales de uso difiriesen de manera esencial de las condiciones fijadas en el cuadro del Anexo , dicho Estado miembro podrá suspender provisionalmente , en su territorio y unicamente para el caso concreto , la aplicación de las normas contemplada en el Anexo y permitir la aplicación de normas básicas más apropiadas . Informará inmediatamente de ello a los otros Estados miembros y a la Comisión indicando los motivos de su decisión .

2. (a) However, where a Member State, as a result of new information or of a reassessment of existing information made since this Directive was adopted, has detailed grounds for establishing that for a given plastic material or article the basic rules laid down in the Annex for migration tests are technically unsuitable or because the actual conditions of use are basically different from the test conditions specified in the table in the Annex, that Member State may,

b ) La Comisión examinará , en el plazo más breve posible , los motivos invocados por el Estado miembro interesado y procederá a consultar a los Estados miembros en el seno del Comité permanente de productos alimenticios ; posteriormente , la Comisión emitirá de inmediato un dictamen y tomará las medidas apropiadas .

within its territory and only for the particular case, temporarily suspend application of the basic rules referred to in the Annex and permit the use of more appropriate basic rules. It shall immediately inform the other Member States and the Commission thereof and give the reasons for its decision.

c ) Si la Comisión estimara que para obviar las dificultades invocadas en la letra a ) , son necesarias modificaciones de la presente Directiva , recurrirá el procedimiento previsto en el artículo 10 de la Directiva 76/893/CEE ; en tal caso , el Estado miembro que haya adoptado normas básicas más apropiadas podrá mantenerlas hasta la entrada en vigor de dichas modificaciones .

(b) The Commission shall examine, as soon as possible, the reasons given by the Member State concerned and shall consult the Member States within the Standing Committee for Foodstuffs and shall then deliver its opinion forthwith and take the appropriate measures.

Artículo 4

(c) If the Commission considers that amendments to this Directive are necessary in order to alleviate the difficulties mentioned in subparagraph (a), it shall initiate the procedure laid down in Article 10 of Directive 76/893/EEC; in that case, the Member State which has adopted the more appropriate basic rules may retain them until the said amendments enter into force.

Las adaptaciones que deban incorporarse el Capítulo II del Anexo de la presente Directiva en función de la evolución de los conocimientos científicos y técnicos se adoptarán según el procedimiento mencionado en el artículo 10 de la Directiva 76/893/CEE .

Article 4

Artículo 5

Adaptations to be made to Chapter II of the Annex to this Directive in the light of progress in scientific and technical knowledge shall be adopted in accordance with the procedure laid down in Article 10 of Directive 76/893/EEC.

La presente Directiva no afectará a las disposiciones nacionales referentes a las otras normas previstas en el artículo 3 de la Directiva 76/893/CEE ni las opciones abiertas a los Estados miembros en virtud de los apartados 4 y 5 del artículo 7 de la citada Directiva .

Article 5

Artículo 6

This Directive shall not affect national provisions relating to the other rules provided for in Article 3 of Directive 76/893/EEC nor the options open to Member States under Article 7 (4) and (5) of that Directive.

Los Estados miembros aplicarán la presente Directiva a más tardar en el momento de la aplicación de una directiva específica que fije los límites mencionados en el apartado 1 del artículo 2 .

Member States shall comply with this Directive not later than such time as a specific directive laying down the limits referred to in Article 2 (1) is implemented.

NORMAS BÁSICAS NECESARIAS PARA LA VERIFICACIÓN DE LA MIGRACIÓN EN LOS SIMULADORES

ANNEX

La determinación de la migración en los simuladores se efectuará utilizando los simuladores previstos en el Capítulo I y en las condiciones de prueba establecidas en el Capítulo II .

BASIC RULES NECESSARY FOR TESTING MIGRATION IN SIMULANTS

CAPÍTULO I

The determination of migration in simulants is to be carried out using the simulants laid down in Chapter I of this Annex and under the test conditions specified in Chapter II of the Annex.

SIMULADORES

CHAPTER I

1 . Caso general : materiales y objetos de materia plástica destinados a entrar en contacto con todo tipo de productos alimenticios

Simulants

Las pruebas se efectuarán utilizando todos los simuladores siguientes y tomado para cada simulador una nueva muestra del material o del objeto :

1. General case: plastic materials and articles intended to come into contact with foodstuffs of all types

- agua destilada o agua de calidad equivalente ( = simulador A ) ,

The tests are to be carried out using all the simulants mentioned below, taking a fresh sample of the plastic material or article for each simulant:

- ácido acético , al 3 % ( p/v ) , en solución acuosa ( = simulador B ) ,

- distilled water or water of equivalent quality (= simulant A),

- etanol al 15 % ( v/v ) , en solución acuosa ( = simulador C ) ,

- 3 % acetic acid (w/v) in aqueous solution (= simulant B),

- aceite de oliva rectificado (1) ; cuando por razones técnicas justificadas relacionadas con el método de análisis sea necesario utilizar otros simuladores , el aceite de oliva deberá reemplazarse por una mezcla de trigliceridos sintéticos (2) o por aceite de girasol ( = simulante D ) .

- 15 % ethanol (v/v) in aqueous solution (= simulant C),

2 . Caso particular : materiales y objetos de materia plástica destinados a entrar en contacto con un solo producto alimenticio o con un grupo determinado de productos alimenticios

- rectified olive oil (1); if for technical reasons connected with the method of analysis it is necessary to use different simulants, olive oil must be replaced by a mixture of synthetic triglycerides (2) or by sunflower oil (= simulant D).

The tests are to be carried out:

- utilizando , entre los simuladores indicados en el número 1 , sólo aquel o aquellos que se adopten mejor a las capacidades de extracción del producto alimenticio o del grupo de productos alimenticios , cuando el producto alimenticio o el grupo de productos alimenticios no estén incluidos en la lista anteriormente mencionada .

- using only the simulants specified as appropriate for the foodstuff or group of foodstuffs in the list referred to in Article 2 (3),

CAPÍTULO II

- where the foodstuff or group of foodstuffs is not included in the list referred to in the first indent, selecting the simulant or simulants prescribed in Section 1 which correspond most closely to the extractive capacity of the foodstuff or group of foodstuffs.

CHAPTER II

1 . Efectuar las pruebas de migración eligiendo , entre la duración y las temperaturas previstas en el cuadro , las que mejor se adapten a las condiciones de contacto normales o previsibles de los materiales y objetos de materia plástica en estudio .

Test conditions (times and temperatures)

2 . Cuando se trate de un material u objeto de materia plástica que esté destinado a ser utilizado repetidamente en breves intervalos en varias de las condiciones de contacto previstas en la columna 1 del cuadro , la migración se determinará sometiendo dicho material u objeto sucesivamente a todas las condiciones de prueba correspondientes previstas en la columna 2 y utilizando el mismo simulador .

1. The migration tests are to be carried out, selecting from the times and temperatures specified in the table those which correspond most closely to the normal or foreseeable conditions of contact for the plastic materials or articles being studied.

3 . A igual duración de la prueba , si un material u objeto de materia plástica superase la prueba a una temperatura superior , no será necesario someterlo a la prueba de temperatura inferior .

2. If a plastic material or article is intended to be used successively at short intervals in several of the conditions of contact referred to in column 1 of the table, migration will be determined by subjecting that material or article successively to all the corresponding test conditions specified in column 2, using the same simulant.

3. For a given test time, where a plastic material or article passes the test at the higher temperature, the test need not be repeated at the lower temperature.

4 . Si , en el uso real , el material u objeto de materia plástica pudiera ser utilizado bajo cualquier condición de duración de contacto o de temperatura , efectúense únicamente las pruebas de diez días a 40 ° C y de dos horas a 70 ° C que convencionalmente se consideren las más duras .

For a given test temperature, where a plastic material or article passes the test over the longer time, the test need not be repeated over the shorter time.

Cuando se utilice el simulador D ( aceite de oliva rectificado o sus substitutos ) , sólo se efectuará la prueba de diez días a 40 ° C .

5 . (1) For plastic materials and articles in contact with foodstuffs for which a preservation temperature of less than 20 °C is specified on the labelling or by law, the test conditions will be 10 days at 20 °C.

4. Where the plastic material or article may in actual use be employed under any conditions of contact time or temperature, only the 10-day tests at 40 °C and the two-hour tests at 70 °C are to be carried out, these being conventionally regarded as the most stringent.
