THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Visto el Tratado constitutivo de la Comunidad Europea,

Having regard to Council Directive 90/426/EEC of 26 June 1990 on animal health conditions governing the movement and imports from third countries of equidae(1), as last amended by the Act of Accession of Austria, Finland and Sweden, and in particular Articles 15(a) and 16 thereof,

Vista la Directiva 90/426/CEE del Consejo, de 26 de junio de 1990, relativa a las condiciones de policía sanitaria que regulan los movimientos de équidos y las importaciones de équidos procedentes de países terceros(1), cuya última modificación la constituye el Acta de adhesión de Austria, de Finlandia y de Suecia, y, en particular, la letra a) de su artículo 15 y su artículo 16,

(1) Whereas the health conditions and veterinary certification for the temporary admission and imports of registered horses among others from the United Arab Emirates are laid down respectively in Commission Decision 92/260/EEC(2), as last amended by Decision 1999/228/EC(3); and Commission Decision 93/197/EEC(4), as last amended by Decision 1999/252/EC(5);

(1) Considerando que la Decisión 92/260/CEE de la Comisión(2), cuya última modificación la constituye la Decisión 1999/228/CE(3), y la Decisión 93/197/CEE de la Comisión(4), cuya última modificación la constituye la Decisión 1999/252/CE(5), establecen las condiciones sanitarias y el certificado sanitario necesarios para la admisión temporal y la importación en la Comunidad de caballos registrados procedentes, entre otros países, de los Emiratos Árabes Unidos;

(2) Whereas following a second Commission veterinary inspection mission to the United Arab Emirates the animal health situation appears to be under the satisfactory control of the veterinary services and in particular the movement of equidae and their health status are sufficiently controlled;

(2) Considerando que, según se ha comprobado en una segunda inspección veterinaria realizada en los Emiratos Árabes Unidos, las autoridades veterinarias de este país parecen controlar de manera satisfactoria la situación zoosanitaria y, particularmente, el movimiento de équidos y el estado sanitario de los mismos;

(3) Whereas African horse sickness has never been reported in the United Arab Emirates and vaccination against this disease is prohibited for more than one year; whereas moreover a series of serological surveys have been carried out over the entire territory of the country and the satisfactory results have been communicated to the Member States and the Commission;

(3) Considerando que no se conocen casos de peste equina africana en los Emiratos Árabes Unidos y que la vacunación contra dicha enfermedad está prohibida desde hace más de un año; que, por otra parte, se han comunicado a los Estados miembros y a la Comisión los resultados satisfactorios de una serie de investigaciones serológicas realizadas en la totalidad del territorio del país;

(4) Whereas the conditions for imports of equidae into the country concerned are at least as strict as the conditions for imports of equidae into the Community; whereas therefore the country should be considered at low risk of incursion of African horse sickness from outside;

(4) Considerando que los requisitos necesarios para la importación de équidos en el país en cuestión son como mínimo tan estrictos como los exigidos para importar équidos en la Comunidad; que, por consiguiente, debe considerarse que el país presenta un riesgo bajo de irrupción de peste equina africana desde el exterior;

(5) Whereas the animal health conditions and veterinary certification must be adopted according to the animal health situation of the third country concerned; whereas the present case relates only to registered horses to be temporarily or permanently imported from the United Arab Emirates;

(5) Considerando que las condiciones de policía sanitaria y el certificado sanitario deben adoptarse en función de la situación zoosanitaria del tercer país; que la presente Decisión sólo se refiere a los caballos registrados que vayan a ser importados de forma temporal o permanente procedentes de los Emiratos Árabes Unidos;

(6) Whereas Commission Decisions 92/260/EEC and 93/197/EEC must be amended accordingly;

(6) Considerando que deben modificarse con arreglo a ello las Decisiones 92/260/CEE y 93/197/CEE;

(7) Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee,

HAS ADOPTED THIS DECISION:

Article 1

Commission Decision 92/260/EEC is amended as follows:

La Decisión 92/260/CEE se modificará de la manera siguiente:

1. The first indent in paragraph (d) of Chapter III of the animal health certificate E in Annex II is replaced as follows: "- either

1) El primer guión de la letra d) de la parte III del certificado sanitario E que figura en el anexo II se sustituirá por el texto siguiente: "- bien

- the country of dispatch, in an isolation centre (3)

- en el país de expedición, en un centro de aislamiento (3)

or

o bien

- the United Arab Emirates (AE), in designated premises under official veterinary supervision (3)".

- en los Emiratos Árabes Unidos (AE), en locales autorizados bajo supervisión veterinaria oficial (3)".

2. The fourth indent in paragraph (i) of Chapter III of the animal health certificate E in Annex II is replaced by the following: "- a test for African horse sickness as described in Annex D to Council Directive 90/426/EEC either

2) El cuarto guión de la letra i) de la parte III del certificado sanitario E que figura en el anexo II se sustiturá por el texto siguiente: "- Una prueba para la detección de la peste equina africana con arreglo a lo dispuesto en el anexo D de la Directiva 90/426/CEE del Consejo, realizada:

- on two occasions, carried out on samples of blood taken with an interval of between 21 and 30 days on ... (5) and on ... (5), the second of which must have been taken within 10 days of export (3), either with negative reactions, if it has not been vaccinated (3) (4), or without increase in antibody count, if it has been vaccinated (3) (4)

- en dos ocasiones, sobre muestras de sangre extraída con un intervalo comprendido entre veintiún y treinta días el ... (5) y el ... (5), habiéndose efectuado la segunda prueba dentro de los diez días anteriores a la exportación (3), bien con resultados negativos si no ha sido vacunado (3) (4), o sin observarse incremento alguno de los anticuerpos, si ha sido vacunado (3) (4),

or

o

- on one occasion, carried out on a sample of blood taken within 10 days of export on ... (5) with negative reaction, if it is to be dispatched from the United Arab Emirates (AE) (3) (4);".

- en una ocasión, sobre una muestra de sangre extraída dentro de los diez días anteriores a la exportación el ... (5) con resultado negativo, si ha de ser expedido desde los Emiratos Árabes Unidos (AE) (3) (4)".

3. "United Arab Emirates (AE)" is added in the order of the ISO country code to the list of third countries in the last indent of paragraph (d) of Chapter III of the animal health certificates A, B, C, D and E in Annex II.

3) Se añadirá "Emiratos Árabes Unidos (AE)" en el orden alfabético del código ISO de países a la lista de terceros países que figura en el último guión de la letra d) de la parte III de los certificados sanitarios A, B, C, D y E del anexo II.

Chapter III of the animal health certificate E in Annex II of Decision 93/197/EEC is amended as follows:

La parte III del certificado sanitario E que figura en el anexo II de la Decisión 93/197/CEE se modificará del modo siguiente:

1. Paragraph (d) is replaced by the following: "(d) during the three months immediately preceding the exportation (or since birth, if the animal is less than three months old, or since entry, if it was imported directly from the European Community during the previous three months) it has been resident on holdings under veterinary supervision in the country of dispatch and it has been kept in an approved isolation centre, protected from vector insects, either

1) La letra d) se sustituirá por el texto siguiente: "d) Durante los tres meses inmediatamente anteriores a la exportación (o desde su nacimiento, si tienen menos de tres meses de edad, o desde su entrada, si han sido importados directamente de la Comunidad Europea en los tres meses anteriores) han permanecido en explotaciones bajo control veterinario en el país de expedición y han permanecido en un centro de aislamiento autorizado, protegidos de insectos vectores,

- during the 40 days prior to dispatch (3),

2. Paragraph (k) is replaced by the following: "(k) it was subjected to a test for African horse sickness as described in Annex D to Council Directive 90/426/EEC either
