THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 130s (1) thereof,

Visto el Tratado constitutivo de la Comunidad Europea, y en particular el apartado 1 de su artículo 130 S,

Having regard to the proposal from the Commission (1),

Vista la propuesta de la Comisión (1),

Having regard to the opinion of the Economic and Social Committee (2),

Visto el dictamen del Comité Económico y Social (2),

Acting in accordance with the procedure laid down in Article 189 c of the Treaty,

Con arreglo al procedimiento establecido en el artículo 189 C del Tratado,

Whereas it has become apparent, through the work of the committee provided for in Article 18 of Council Directive 75/442/EEC (3) that it has not been possible, within the time limits fixed by Directive 91/689/EEC (4), to draw up a binding list of hazardous waste, but whereas the implementation of Directive 91/689/EEC depends on the Commission's establishing such a list;

Considerando que se pone de manifiesto, tras los trabajos del Comité previsto en el artículo 18 de la Directiva 75/442/CEE (3), que no ha sido posible elaborar una lista obligatoria de residuos peligrosos en los plazos fijados por la Directiva 91/689/CEE (4), pero que la aplicación de la Directiva 91/689/CEE depende de la elaboración por parte de la Comisión de una lista semejante;

Whereas it is necessary to ensure the implementation of Directive 91/689/EEC within the shortest possible time;

Considerando que es necesario garantizar la aplicación de la Directiva 91/689/CEE a la mayor brevedad;

Whereas a Community list of hazardous waste must still be established in accordance with Article 1 (4) of Directive 91/689/EEC;

Considerando que sigue siendo necesario elaborar una lista comunitaria de residuos peligrosos de conformidad con el apartado 4 del artículo 1 de la referida Directiva;

Whereas the repeal of Council Directive 78/319/EEC of 20 March 1978 on toxic and dangerous waste (5) must therefore be postponed,

Considerando que, en consecuencia, conviene retrasar la derogación de la Directiva 78/319/CEE del Consejo, de 20 de marzo de 1978, relativa a los residuos peligrosos (5),

HAS ADOPTED THIS DIRECTIVE:

HA ADOPTADO LA PRESENTE DIRECTIVA:

Article 1

Artículo 1

Directive 91/689/EEC is hereby amended as follows:

La Directiva 91/689/CEE se modifica como sigue:

1. The following shall be substituted for Article 10 (1):

1) El apartado 1 del artículo 10 se sustituye por el texto siguiente:

'Article 10

« 1. Los Estados miembros pondrán en vigor las disposiciones legales, reglamentarias y administrativas necesarias para dar cumplimiento a lo establecido en la presente Directiva, antes del 27 de junio de 1995. Informarán inmediatamente de ello a la Comisión. ».

1. Member States shall bring into force the laws, regulations and administrative provisions necessary for them to comply with this Directive by 27 June 1995. They shall immediately inform the Commission thereof.'

2) El artículo 11 se sustituye por el texto siguiente:

2. The following shall be substituted for Article 11:

« Artículo 11

'Annex 11

La Directiva 78/319/CEE queda derogada con efectos a partir del 27 de junio de 1995. ».

Directive 78/319/EEC shall be repealed with effect from 27 June 1995.'

Los destinatarios de la presente Directiva serán los Estados miembros.

This Directive is addressed to the Member States.
