DIRECTIVA 93/8/CEE DE LA COMISIÓN de 15 de marzo de 1993 por la que se modifica la Directiva 82/711/CEE del Consejo que establece las normas de base necesarias para la verificación de la migración de los componentes de los materiales y objetos de materia plástica destinados a entrar en contacto con productos alimenticios

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 89/109/EEC of 21 December 1988 on the approximation of the laws of the Member States relating to materials and articles intended to come into contact with foodstuffs (1), and in particular Article 3 thereof,

Whereas the Community measures envisaged by this Directive are not only necessary but also indispensable for the attainment of the objectives of the internal market; whereas these objectives cannot be achieved by Member States individually, and whereas furthermore their attainment at Community level is already provided for by Directive 89/109/EEC;

Considerando que las medidas comunitarias previstas por la presente Directiva son no sólo necesarias, sino asimismo indispensables para la consecución de los objetivos del mercado interior, y que dichos objetivos no pueden ser alcanzados por los Estados miembros por separado; que, por otra parte, la Directiva 89/109/CEE ha previsto ya su realización a nivel comunitario;

Whereas Commission Directive 90/128/EEC of 23 February 1990 relating to plastic materials and articles intended to come into contact with foodstuffs (2), as amended by Directive 92/39/EEC (3), provides the possibility of carrying out the migration tests either on foodstuffs or on food simulants, whilst Council Directive 82/711/EEC (4) requires the migration tests to be carried out only on food simulants unless the method of analysis which enables migration into foodstuffs to be established has been adopted officially; whereas this discrepancy is capable of affecting the proper application of the Directives and whereas it is therefore necessary to eliminate it;

Considerando que la Directiva 90/128/CEE de la Comisión, de 23 de febrero de 1990, relativa a los materiales y objetos plásticos destinados a entrar en contacto con productos alimenticios (2), modificada por la Directiva 92/39/CEE (3), prevé la posibilidad de realizar los ensayos de migración bien en productos alimenticios o bien en simulantes, mientras que la Directiva 82/711/CEE del Consejo (4) obliga a realizar las pruebas de migración solamente en simulantes, a no ser que se haya aprobado oficialmente un método de análisis que haga posible determinar la migración a productos alimenticios; que esta discrepancia puede afectar a la correcta aplicación de las Directivas y, por consiguiente, procede suprimirla;

Whereas the increasing use of microwave ovens makes it necessary to establish new specific test conditions;

Considerando que el uso creciente de hornos de microondas hace necesario establecer nuevas condiciones específicas de ensayo;

Whereas it is necessary to remove the possibility given to the Member States to adopt national rules for high-temperature testing in order to eliminate the existing discrepancies;

Considerando que, a fin de eliminar las discrepancias existentes, es necesario suprimir la posibilidad que tenían los Estados miembros de aprobar normas nacionales para los ensayos a altas temperaturas;

Whereas the measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Foodstuffs,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Los niveles de migraciones global y específicas, en la masa o en la superficie de los productos alimenticios o simulantes de alimentos, de los componentes de los materiales y objetos contemplados en el artículo 1 no deberán rebasar los límites fijados en la Directiva 90/128/CEE de la Comisión (*) o en cualquier otra Directiva específica pertinente.

'Article 2

The overall and specific migration levels of constituents of the materials and articles referred to in Article 1 into or onto foodstuffs or food simulants must not exceed the limits laid down in Commission Directive 90/128/EEC (*) or in any other relevant specific directive.

1. Los ensaysos para comprobar si la migración a los productos alimenticios se ajusta a los límites máximos permitidos se realizarán en las condiciones de duración y temperatura más extremas previsibles en el uso real.

Article 3

Para comprobar si la migración a los simulantes de alimentos se ajusta a los límites máximos permitidos se realizarán ensayos de migración convencionales, cuyas normas básicas se establecen en el Anexo de la presente Directiva.

1. Verification of compliance of migration into foodstuffs with the migration limits shall be carried out under the most extreme conditions of time and temperature foreseeable in actual use.

2. a) Sin embargo, si un Estado miembro, como resultado de la obtención de nuevos datos o de una nueva valoración de los datos existentes efectuada con posterioridad a la adopción de la presente Directiva, comprobara que, con respecto a un material o un objeto de materia plástica, las normas básicas para las pruebas de migración previstas en el Anexo resultan inapropiadas, por razones técnicas o porque las condiciones reales de uso difieren de forma esencial de las condiciones fijadas en el cuadro del Anexo, dicho Estado miembro podrá suspender temporalmente, en su territorio y únicamente para tal caso concreto, la aplicación de las normas básicas contempladas en el Anexo y permitir la aplicación de normas básicas más apropiadas. Informará inmediatamente de ello a los restantes Estados miembros y a la Comisión, indicando los motivos de su decisión.

Verification of compliance of migration into food simulants with the migration limits shall be carried out using conventional migration tests, the basic rules for which are laid down in the Annex to this Directive.

b) La Comisión examinará, en el plazo más breve posible, los motivos invocados por el Estado miembro interesado y procederá a consultar a los Estados miembros en el seno del Comité permanente de productos alimenticios; la Comisión emitirá de inmediato un dictamen y modificará la presente Directiva si es necesario. En tal caso, el Estado miembro que haya adoptado tales normas básicas más apropiadas podrá mantenerlas hasta la entrada en vigor de dichas modificaciones.

2. (a) However, where a Member State, as a result of new information or of a reassessment of existing information made since this Directive was adopted, has detailed grounds for establishing that for a given plastic material or article the basic rules laid down in the Annex for migration tests are technically unsuitable or because the actual conditions of use are basically different from the test conditions specified in the table in the Annex, that Member State may, within its territory and only for the particular case, temporarily suspend application of the basic rules referred to in the Annex and permit the use of more appropriate basic rules. It shall immediately inform the other Member States and the Commission thereof and give the reasons for its decision.

(b) The Commission shall examine, as soon as possible, the reasons given by the Member States concerned and shall consult the Member States within the Standing Committee for Foodstuffs and shall then deliver its opinion forthwith and amend this Directive, if necessary. In that case, the Member State which has adopted the more appropriate basic rules may retain them until the said amendments enter into force.

Artículo 2

Los Estados miembros adoptarán las disposiciones legales, reglamentarias y administrativas necesarias para cumplir la presente Directiva con efectos a partir del 1 de abril de 1994. Informarán inmediatamente de ello a la Comisión.

Article 2

Cuando los Estados miembros adopten dichas disposiciones, éstas harán referencia a la presente Directiva o irán acompañadas de dicha referencia en su publicación oficial. Los Estados miembros establecerán las modalidades de la mencionada referencia.

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive as from 1 April 1994. They shall immediately inform the Commission thereof.

When Member States adopt these provisions, these shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such reference shall be adopted by Member States.

NORMAS BÁSICAS PARA LA VERIFICACIÓN DE LA MIGRACIÓN EN LOS SIMULANTES DE ALIMENTOS

'ANNEX

La determinación de la migración en los simulantes de alimentos se efectuará utilizando los simulantes de alimentos previstos en el capítulo I del presente Anexo y en las condiciones de ensayo establecidas en el capítulo II de dicho Anexo. Sin embargo, la determinación de la migración se circunscribirá al (a los) simulante(s) de alimentos y a la(s) condición(ones) de ensayo que, en el caso específico examinado, puedan considerarse las más estrictas de acuerdo con la experiencia.

BASIC RULES FOR TESTING MIGRATION IN FOOD SIMULANTS

CAPÍTULO I

The determination of migration in food simulants shall be carried out using the food simulants laid down in Chapter I of Annex and under the test conditions specified in Chapter II of Annex. However the determination of migration shall be restricted to the food simulant(s) and to the condition(s) of test which, in the specific case under examination, may be considered to be the most severe on the basis of experience.

Los ensayos se efectuarán utilizando todos los simulantes de alimentos indicados a continuación y tomando para cada simulante una nueva muestra del material o del objeto:

1. General case: plastic materials and articles intended to come into contact with foodstuffs of all types

- agua destilada o agua de calidad equivalente (= simulante A),

The tests shall be carried out using the food simulants mentioned below, taking a fresh sample of the plastic material or article for each simulant:

- ácido acético, al 3 % (p/v), en solución acuosa (= simulante B),

- distilled water or water of equivalent quality (= simulant A),

- etanol al 15 % (v/v), en solución acuosa (= simulante C),

- 3 % acetic acid (w/v) in aqueous solution (= simulant B),

- aceite de oliva rectificado (1) (= simulante D); cuando por razones técnicas justificadas relacionadas con el método de análisis sea necesario utilizar otros simulantes de alimentos, el aceite de oliva deberá reemplazarse por una mezcla de triglicéridos sintéticos (2) o por aceite de girasol. Si todos los simulantes de alimentos citados anteriormente en este punto resultan inapropiados, podrán utilizarse otros simulantes así como otras condiciones de tiempo y temperatura.

- 15 % ethanol (v/v) in aqueous solution (= simulant C),

Sin embargo, el simulante A debe utilizarse únicamente en los casos mencionados específicamente en el cuadro de este Anexo.

- rectified olive oil (1) (= simulant D); if for technical reasons connected with the method of analysis it is necessary to use different food simulants, olive oil shall be replaced by a mixture of synthetic triglycerides (2) or by sunflower oil. If all the food simulants provided in this indent are inappropriate, other food simulants and conditions of time and temperature may be used.

However, the simulant A shall be used only in the cases mentioned specifically in the Table of this Annex.

The tests shall be carried out:

- using only the food simulant(s) specified as appropriate for the foodstuff or group of foodstuffs in the Directive 85/572/EEC (3),

- where the foodstuff or group of foodstuffs is not included in the list referred to in the first indent, selecting the food simulant(s) prescribed in Section 1 which correspond most closely to the extractive capacity of the foodstuff or group of foodstuffs.

1. Las pruebas de migración se efectuarán eligiendo, entre los tiempos y las temperaturas indicadas en el cuadro, las condiciones que más se aproximen, sin ser inferiores a las de contacto usuales o previsibles de los materiales y objetos plásticos en estudio.

2. Si un material u objeto superase un ensayo de una duración determinada a una temperatura dada, no será necesario someterlo a otro ensayo de duración inferior y misma temperatura, ni a otro de la misma duración y temperatura inferior.

1. The migration tests are to be carried out, selecting from the times and temperatures specified in the table those which correspond most closely to, but are not less than, the normal or foreseeable conditions of contact for the plastic materials or articles being studied.

3. Sin embargo, cuando se trate de un material u objeto de materia plástica destinado a ser utilizado en varias de las condiciones de tiempo y temperatura que figuran en el cuadro, la migración se determinará sometiendo sucesivamente dicho material u objeto a todas las condiciones de ensayo correspondientes y utilizando la misma porción del simulante de alimentos.

2. Where a material or article passes a test at a given time and temperature, it need not to be tested for a shorter time at the same temperature, nor for the same time at a lower temperature.

4. Si un material u objeto de materia plástica estuviera destinado a entrar en contacto con productos alimenticios en cualquier condición de tiempo, se utilizarán las condiciones de ensayo siguientes:

However if a plastic material or article is intended for a food contact application covered by two or more combinations of time and temperature taken from the Table, migration will be determined by subjecting that material or article successively to all the applicable test conditions, using the same aliquot of food simulant.

a) cuando, en su uso real, un material u objeto de materia plástica se utilice a una temperatura no superior a 70 °C, y ello esté indicado en la etiqueta o las instrucciones, sólo habrá que efectuar el (los) ensayo(s) de diez días a 40 °C;

4. If a plastic material or article is intended to come into contact with foodstuffs at any condition of time, the conditions for testing will be the following:

b) cuando, en su uso real, un material u objeto de materia plástica se utilice a una temperatura superior a 70 °C:

(a) where the plastic material or article may in actual use be employed at any temperature up to and including 70 °C and that is indicated by an appropriate labelling or instructions, only the 10 day test(s) at 40 °C shall be carried out;

i) si no existiese etiqueta ni instrucciones que indiquen la temperatura prevista en el uso real, se utilizarán los simulantes B y C a la temperatura de reflujo, si es posible, y si no dos horas a 100 °C y el simulante D dos horas a 175 °C;

(b) where a plastic material or article may in actual use be employed at a temperature above 70° C:

ii) si existiese etiqueta o instrucciones que indiquen las condiciones previstas en el uso real, se seleccionarán las duraciones y temperaturas correspondientes del cuadro.

(i) where no labelling or instructions are given to indicate temperature expected in real use, simulants B and C shall be used at reflux temperature, if possible, or at two-hour test(s) at 100° C and simulant D shall be used for two hours at 175° C;

5. No obstante las condiciones previstas en el cuadro y en el punto 2, si un material u objeto de materia plástica se utiliza durante períodos inferiores a 15 minutos a temperaturas entre 70 °C y 100 °C y ello se indica en la etiqueta o instrucciones, sólo habrá que efectuar los ensayos de dos horas a 70 °C y diez días a 40 °C. Para cada uno de estos dos tipos de ensayos hay que utilizar una nueva muestra del mismo material u objeto a estudiar.

(ii) where labelling or instructions are given to indicate conditions expected in real use, time and temperatures from the Table shall be selected.

6. Si se comprobara que el desarrollo de los ensayos en las condiciones previstas en el cuadro provoca en los materiales y objetos de materia plástica modificaciones físicas o de otro tipo, que no ocurren en las condiciones normales o previsibles de uso del material u objeto, los ensayos de migración deberán efectuarse en las condiciones más adecuadas al caso específico.

5. By derogation from the conditions provided in the table and in paragraph 2, if the plastic material or article may in actual use be employed for periods of less than 15 minutes at temperatures between 70° C and 100° C and that is indicated by an appropriate labelling or instructions, only the two-hour test at 70° C and the 10-day test at 40° C shall be carried out. These tests shall be carried out separately taking different samples. For each of these two types of test, use a new sample of the same material or article to be examined.

7. En los ensayos de migración de los materiales y objetos de materia plástica para uso en hornos de microondas, se utilizará un horno convencional en las condiciones de tiempo y temperatura pertinentes seleccionadas del cuadro.

6. If it is found that carrying out the tests under the conditions specified in the table causes physical or other changes in the plastic material or article which do not occur under normal of foreseeable conditions of use of that material or article, the migration tests shall be carried out under conditions more appropriate to the specific case.

7. For materials and articles intended for use in microwave ovens, migration testing shall use a conventional oven and appropriate time and temperature conditions selected from the Table.
