Having regard to the Treaty establishing the European Community,

Visto el Tratado constitutivo de la Comunidad Europea,

Having regard to Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters(1), and in particular Articles 3(2), 4(2), 44 and 74 thereof,

Visto el Reglamento (CE) n° 44/2001 del Consejo, de 22 de diciembre de 2000, relativo a la competencia judicial, el reconocimiento y la ejecución de resoluciones judiciales en materia civil y mercantil(1), y, en particular, el apartado 2 de su artículo 3, el apartado 2 de su artículo 4 y sus artículos 44 y 74,

Whereas:

Considerando lo siguiente:

(1) According to Article 3(1) of the Regulation (EC) No 44/2001, persons domiciled in a Member State may only be sued in the courts of another Member State by virtue of the rules set out in sections 2 to 7 of Chapter II on jurisdiction; according to Article 3(2), in particular the rules of jurisdiction set out in Annex I shall not be applicable as against them.

(1) Según el apartado 1 del artículo 3 del Reglamento (CE) n° 44/2001, las personas domiciliadas en un Estado miembro solamente podrán ser demandadas en los tribunales de otro Estado miembro en virtud de las normas establecidas en las secciones 2 a 7 del capítulo II sobre competencia; según el apartado 2 del artículo 3, no podrán invocarse frente a ellas, en particular, las reglas de competencia nacionales que figuran en el anexo I.

(2) Therefore, if a rule referred to in Annex I is abolished in a Member State, the content of the list should be modified accordingly.

(2) Por lo tanto, si una norma mencionada en el anexo I es derogada en un Estado miembro, debe modificarse el contenido de la lista.

(3) An application for a declaration of enforceability of a judgment given in a Member State and enforceable in that State, in another Member State, should be submitted to the competent authorities listed in Annex II to Regulation (EC) No 44/2001.

(3) Toda solicitud de otorgamiento de la ejecución en otro Estado miembro de una resolución dictada en un Estado miembro y ejecutoria en dicho Estado, deberá presentarse a las autoridades competentes enumeradas en el anexo II del Reglamento (CE) n° 44/2001.

(4) Articles 38 et seq. and 57(4) of Regulation (EC) No 44/2001 allow that an application for a declaration of enforceability of an authentic instrument may be submitted to notaries as competent authorities.

(4) Los artículos 38 y siguientes y el apartado 4 del artículo 57 del Reglamento (CE) n° 44/2001 permiten que pueda presentarse ante los notarios en calidad de autoridades competentes una solicitud de otorgamiento de la ejecución de un instrumento auténtico.

(5) Article 74 of Regulation (EC) No 44/2001 provides that Member States should notify the Commission of texts amending the list of competent authorities set out in Annexes I to IV.

(5) El artículo 74 del Reglamento (CE) n° 44/2001 dispone que los Estados miembros notifiquen a la Comisión los textos que modifiquen la lista de autoridades competentes establecida en los anexos I a IV.

(6) The Netherlands has notified the Commission of an amendment to the rules of jurisdiction set in Annex I and to the list of competent courts and authorities set out in Annex II and Germany has notified the Commission of an amendment to the list of competent courts and authorities set out in Annex II; therefore, Regulation (EC) No 44/2001 should be amended accordingly,

(6) Los Países Bajos han notificado a la Comisión una modificación de las reglas de jurisdicción establecidas en el anexo I y de la lista de tribunales y autoridades competentes que figuran en el anexo II; Alemania ha notificado a la Comisión una modificación de la lista de tribunales y autoridades competentes que figuran en el anexo II, por tanto, el Reglamento (CE) n° 44/2001 debe modificarse en consecuencia.

HAS ADOPTED THIS REGULATION:

HA ADOPTADO EL PRESENTE REGLAMENTO:

Article 1

Artículo 1

In Annex I to Regulation (EC) No 44/2001, the eighth indent concerning the Netherlands, shall be deleted.

En el anexo I del Reglamento (CE) n° 44/2001, se suprimirá el octavo guión referido a los Países Bajos.

Article 2

Artículo 2

In Annex II to Regulation (EC) No 44/2001, "in Germany the presiding Judge of a chamber of the 'Landgericht'" shall be replaced by the following: "in Germany:

En el anexo II del Reglamento (CE) n° 44/2001, la frase "en Alemania, el Presidente de una Sala del Landgericht" se sustituirá por el texto siguiente: "en Alemania:

(a) the presiding Judge of a chamber of the 'Landgericht';

a) el Presidente de una Sala del Landgericht;

(b) a notary ('...') in a procedure of declaration of enforceability of an authentic instrument."

b) un notario ('...') en un procedimiento de otorgamiento de la ejecución de un instrumento auténtico."

In Annex II to Regulation (EC) No 44/2001, "in the Netherlands, the presiding Judge of the 'arrondissementsrechtbank'" shall be replaced by the following: "in the Netherlands, the 'voorzieningenrechter van de rechtbank'."

En el anexo II del Reglamento (CE) n° 44/2001, la frase "en los Países Bajos, el Presidente del arrondissementsrechtbank" se sustituirá por el texto siguiente: "en los Países Bajos, el voorzieningenrechter van de rechtbank."

Article 4

Artículo 4

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

El presente Reglamento entrará en vigor el séptimo día siguiente al de su publicación en el Diario Oficial de las Comunidades Europeas.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en cada Estado miembro.
