Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof,

Considerando lo siguiente:

(1) The eighth Directive, 97/44/EC, of the European Parliament and of the Council of 22 July 1997 on summer-time arrangements(4) introduced a common date and time in all Member States, for the beginning and end of summer time in 1998, 1999, 2000 and 2001.

(1) La Octava Directiva 97/44/CE del Parlamento Europeo y del Consejo, de 22 de julio de 1997, relativa a las disposiciones sobre la hora de verano(4), fija una fecha y una hora comunes a todos los Estados miembros para el comienzo y el fin del período de la hora de verano durante los años 1998, 1999, 2000 y 2001.

(2) Given that the Member States apply summer-time arrangements, it is important for the functioning of the internal market that a common date and time for the beginning and end of the summer-time period be fixed throughout the Community.

(2) Habida cuenta de que los Estados miembros aplican disposiciones relativas a la hora de verano, resulta importante para el funcionamiento del mercado interior seguir fijando una fecha y una hora comunes para el comienzo y el fin del período de la hora de verano aplicables en toda la Comunidad.

(3) Since the summer-time period considered most appropriate by the Member States runs from the end of March to the end of October, it is appropriate that that period therefore be maintained.

(3) El período de la hora de verano considerado más apropiado por los Estados miembros es el comprendido entre el final de marzo y el final de octubre. Procede, por consiguiente, mantener ese período.

(4) The proper functioning of certain sectors, not only transport and communications, but also other sectors of industry, requires stable, long-term planning. Provisions concerning summer time should therefore be laid down for an unspecified period. Article 4 of Directive 97/44/EC provides, in that respect, that the European Parliament and the Council are to adopt, by 1 January 2001, the arrangements to apply from 2002 onwards.

(4) El buen funcionamiento de algunos sectores, no sólo el de los transportes y las comunicaciones, sino también otros ramos de la industria, requiere una programación estable a largo plazo. Resulta por consiguiente apropiado establecer por un período indeterminado disposiciones relativas al período de la hora de verano. El artículo 4 de la Directiva 97/44/CE establece a este respecto que el régimen aplicable a partir de 2002 debe ser aprobado por el Parlamento Europeo y el Consejo antes del 1 de enero de 2001.

(5) For reasons of clarity and accuracy of information, a timetable for the implementation of the summer-time period for the following five years should be published every five years.

(5) En aras de la claridad y de la precisión de la información, es preciso publicar cada cinco años el calendario de aplicación del período de la hora de verano para los cinco años siguientes.

(6) Implementation of this Directive should, moreover, be monitored by means of a report, to be presented by the Commission to the European Parliament, the Council and the Economic and Social Committee, on the impact of these provisions in all of the areas concerned. That report should be based on the information made available to the Commission by the Member States in sufficient time to enable the report to be presented at the specified time.

(6) Es preciso, además, supervisar la aplicación de la presente Directiva sobre la base de un informe que la Comisión deberá presentar al Parlamento Europeo, al Consejo y al Comité Económico y Social sobre las repercusiones de las presentes disposiciones en todos los sectores afectados. Dicho informe se deberá basar en la información comunicada por los Estados miembros a la Comisión con tiempo suficiente para permitir la presentación del informe en el plazo fijado.

(7) Given that the complete harmonisation of the timetable for the summer-time period with a view to facilitating transport and communications cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may take measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty. This Directive does not go beyond what is necessary to achieve those objectives.

(7) Dado que el objetivo de la armonización completa del calendario de la hora de verano con el fin de facilitar los transportes y las comunicaciones no puede ser alcanzado de manera suficiente por los Estados miembros, y por consiguiente puede lograrse mejor a nivel comunitario, la Comunidad puede tomar medidas con arreglo al principio de subsidiariedad establecido en el artículo 5 del Tratado. La presente Directiva no excederá de lo que sea necesario para alcanzar ese objetivo.

(8) For geographical reasons, the common summer-time arrangements should not apply to the overseas territories of the Member States,

HAVE ADOPTED THIS DIRECTIVE:

Article 1

Artículo 1

For the purposes of this Directive "summer-time period" shall mean the period of the year during which clocks are put forward by 60 minutes compared with the rest of the year.

A efectos de la presente Directiva, se entenderá por "período de la hora de verano" el período del año durante el cual la hora se adelanta en sesenta minutos respecto a la hora del resto del año.

From 2002 onwards, the summer-time period shall begin, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in March.

A partir del año 2002, el período de la hora de verano comenzará en todos los Estados miembros a la 1 de la madrugada, hora universal, del último domingo de marzo.

From 2002 onwards, the summer-time period shall end, in every Member State, at 1.00 a.m., Greenwich Mean Time, on the last Sunday in October.

A partir del año 2002, el período de la hora de verano terminará en todos los Estados miembros a la 1 de la madrugada, hora universal, del último domingo de octubre.

Article 4

The Commission shall publish a communication in the Official Journal of the European Communities(5), for the first time on the occasion of the publication of this Directive, and every five years thereafter, containing the timetable showing the dates on which the summer-time period will begin and end for the following five years.

La Comisión publicará en el Diario Oficial de las Comunidades Europeas(5), por primera vez en el momento de la publicación de la presente Directiva y en lo sucesivo cada cinco años, una comunicación que incluirá el calendario de fechas de inicio y fin de la hora de verano para los cinco años siguientes.

Article 5

Artículo 5

The Commission shall report to the European Parliament, the Council and the Economic and Social Committee on the impact of the provisions of this Directive on the sectors concerned by 31 December 2007 at the latest.

La Comisión presentará al Parlamento Europeo, al Consejo y al Comité Económico y Social, a más tardar el 31 de diciembre de 2007, un informe en el que dará cuenta de la incidencia de la aplicación de las disposiciones de la presente Directiva en los sectores afectados.

That report shall be drawn up on the basis of the information made available to the Commission by each Member State by 30 April 2007 at the latest.

Dicho informe se elaborará sobre la base de la información comunicada por los Estados miembros a la Comisión a más tardar el 30 de abril de 2007.

The Commission shall, if necessary and following the conclusions of the report, make appropriate proposals.

La Comisión presentará, en su caso, las propuestas adecuadas, siguiendo las conclusiones del informe.

Article 6

This Directive shall not apply to the overseas territories of the Member States.

La presente Directiva no se aplicará a los territorios de ultramar de los Estados miembros.

Article 7

Artículo 7

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 December 2001 at the latest. They shall forthwith inform the Commission thereof.

Los Estados miembros pondrán en vigor las disposiciones legales, reglamentarias y administrativas necesarias para dar cumplimiento a lo establecido en la presente Directiva a más tardar el 31 de diciembre de 2001. Informarán de ello inmediatamente a la Comisión.

When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Cuando los Estados miembros adopten dichas disposiciones, éstas incluirán una referencia a la presente Directiva o irán acompañadas de dicha referencia en su publicación oficial. Los Estados miembros establecerán las modalidades de la mencionada referencia.

Article 8

This Directive shall enter into force on the day of its publication in the Official Journal of the European Communities.

La presente Directiva entrará en vigor el día de su publicación en el Diario Oficial de las Comunidades Europeas.

Article 9

This Directive is addressed to the Member States.

Los destinatarios de la presente Directiva serán los Estados miembros.
