Having regard to the Treaty establishing the European Community, and in particular Articles 47(2), 55 and 95 thereof, in conjunction with the first sentence of Article 300(2) and the second subparagraph of Article 300(3),
|

Having regard to the proposal from the Commission(2),

Having regard to the assent of the European Parliament(3),

Whereas:
|
Considerando lo siguiente:
|
|
(1) The WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT) adopted in Geneva on 20 December 1996 under the auspices of the World Intellectual Property Organisation will help to ensure a balanced level of protection for works and other subject matter, while allowing the public access to material available via networks.

(1) El Tratado de la OMPI sobre derecho de autor (TDA) y el Tratado de la OMPI sobre interpretaciones o ejecuciones y fonogramas (TF), adoptados en Ginebra el 20 de diciembre de 1996 bajo los auspicios de la Organización Mundial de la Propiedad Intelectual contribuirán a garantizar un nivel de protección equilibrado de las obras y otras materias, permitiendo al mismo tiempo el acceso del público a los contenidos que puedan emitirse en las redes.

(2) The competence of the Community to conclude or accede to international agreements or treaties does not derive only from explicit conferral by the Treaty but may also derive from other provisions of the Treaty and from acts adopted pursuant to those provisions by Community institutions.
|
(2) Los poderes de que dispone la Comunidad para celebrar o acceder a acuerdos internacionales o tratados no derivan únicamente de una atribución explícita del Tratado, sino que pueden resultar también de otras disposiciones del Tratado y de actos adoptados por las instituciones de la Comunidad en virtud de dichas disposiciones.

(3) The subject matter of the WCT and the WPPT falls to a large extent within the scope of existing Community directives in this field.
|
(3) El contenido del TDA y del TF está incluido, en gran parte, en el ámbito de aplicación de las Directivas comunitarias que existen en la materia.
|

(4) It follows that the approval of the WCT and the WPPT is a matter for both the Community and its Member States.
|
(4) En consecuencia la aprobación del TDA y del TF es competencia que comparten la Comunidad y sus Estados miembros.
|
|
(5) The WCT and the WPPT should therefore be approved on behalf of the Community with regard to matters within its competence.
|
(5) Conviene, por consiguiente, que el TDA y el TF se aprueben en nombre de la Comunidad, en lo referente a asuntos correspondientes a sus competencias.
|
|
(6) The Community has already signed the WCT and the WPPT, subject to final conclusion.
|
(6) La Comunidad ya ha procedido a la firma del TDA y del TF, sujeta a la celebración definitiva.
|
|
(7) The deposit of the instruments of conclusion of the Community should take place as far as possible simultaneously with the deposit of the instruments of ratification of the Member States,

(7) En la medida de lo posible, el depósito de los instrumentos de celebración de la Comunidad deberá tener lugar simultáneamente al depósito de los instrumentos de ratificación de los Estados miembros.

HAS DECIDED AS FOLLOWS:

1. The WIPO Copyright Treaty (WCT) is hereby approved on behalf of the Community with regard to matters within its competence.
|
1. Queda aprobado, en nombre de la Comunidad y en lo referente a asuntos que correspondieren a sus competencias, el Tratado de la OMPI sobre derecho de autor (TDA).

2. The WIPO Performances and Phonograms Treaty (WPPT) is hereby approved on behalf of the Community with regard to matters within its competence.
|
2. Queda aprobado, en nombre de la Comunidad y en lo referente a asuntos que correspondieren a sus competencias, el Tratado de la OMPI sobre interpretaciones o ejecuciones y fonogramas (TF).
|
|
3. The texts of the Treaties are attached to this Decision.
|
3. Los textos de los Tratados se adjuntan a la presente Decisión.

Article 2

Artículo 2

|
The President of the Council is hereby authorised to deposit the instruments of conclusion with the Director-General of the World Intellectual Property Organisation as from the date by which the Member States will have to bring into force the measures adopted by the European Parliament and the Council necessary to adapt the existing Community legislation to the obligations deriving from the WCT and the WPPT.
|
Se autoriza al Presidente del Consejo a depositar los instrumentos de celebración ante el Director General de la Organización Mundial de la Propiedad Intelectual a partir de la fecha en la que los Estados miembros tuvieren que aplicar las medidas adoptadas por el Parlamento Europeo y el Consejo necesario para la adaptación de la legislación comunitaria vigente a las obligaciones derivadas del TDA y del TF.

1. The Commission is hereby authorised to represent the Community at the meetings of the Assemblies referred to in the WCT and WPPT.
|
1. Se autoriza a la Comisión a representar a la Comunidad en las sesiones de las Asambleas previstas por el TDA y el TF.
|
|
2. On all matters within the sphere of competence of the Community, the Commission shall negotiate in the Assemblies of the WCT and the WPPT on behalf of the Community in accordance with the applicable rules of the EC Treaty, in particular Article 300 thereof.
|
2. La Comisión negociará en las Asambleas del TDA y del TF, en nombre de la Comunidad, todas las cuestiones que son competencia de la Comunidad de acuerdo con las normas aplicables del Tratado CE, y en particular su artículo 300.
|
|
3. The position which the Community may adopt within the Assemblies shall be prepared by the relevant Council working party.
|
3. La posición que la Comunidad haya de adoptar en las Asambleas será preparada por el Grupo de trabajo competente del Consejo.
