Having regard to the Treaty establishing the European Community,
|

Having regard to Council Regulation (EC) No 2330/98 of 22 October 1998 providing for an offer of compensation to certain producers of milk and milk products temporarily restricted in carrying out their trade (1), and in particular Articles 9 and 16 thereof,
|

Whereas, pursuant to Article 9 of Regulation (EC) No 2330/98, applications for compensation must be addressed by the producers concerned to the competent authority designated for that purpose in each Member State, using a standard form; whereas such forms must be drawn up to serve as working documents for the competent authorities, each of those authorities having the right, having regard to the differences in administrative requirements, to adapt the content;
|
Visto el Reglamento (CE) n° 2330/98 del Consejo, de 22 de octubre de 1998, por el que se establece una oferta de indemnización para determinados productores de leche y productos lácteos a los que se ha impedido ejercer temporalmente su actividad (1), y, en particular, sus artículos 9 y 16,

Whereas, pursuant to Article 16 of that Regulation, the Commission was instructed to adopt detailed rules for its application and, in particular, the provisions regarding payment of the costs of the agents of the producers in question;
|
Considerando que, de acuerdo con el artículo 9 del Reglamento (CE) n° 2330/98, los productores interesados deben presentar las solicitudes de indemnización a la autoridad competente que cada Estado miembro designe a tal fin, mediante un impreso conforme al modelo común; que dicho impreso debe poder servir como documento de trabajo a las autoridades competentes, lo que no excluye que cada una de ellas pueda adaptar su contenido en función de las diferentes necesidades administrativas;

Whereas it is necessary to take account in the compensation offer of the fees of agents incurred by producers in pursuing their claims against the Community institutions prior to the entry into force of Regulation (EC) No 2330/98; whereas the reasons which led the Council to determine that the compensation should be calculated on a flat-rate basis apply also with regard to the costs of agents; whereas, moreover, a single agent has frequently represented a large number of producers; whereas therefore the reimbursement of fees on a flat-rate basis is considered appropriate;
|
Considerando que, en virtud del artículo 16 de dicho Reglamento, la Comisión recibió la competencia de adoptar las disposiciones de aplicación y, concretamente, las relativas al pago de los gastos de los mandatarios de los productores en cuestión;

Whereas those producers who brought proceedings before the Court of First Instance will have incurred higher agents' fees and should therefore receive a higher flat-rate amount; whereas in certain specific cases the possibility should also be foreseen to reimburse costs in excess of the flat-rate amount;
|
Considerando que es necesario tener en cuenta, en la oferta de indemnización, los honorarios pagados por los productores a sus mandatarios por sus acciones reivindicativas frente a las instituciones comunitarias antes de la entrada en vigor del Reglamento (CE) n° 2330/98; que las razones que han llevado al Consejo a estipular que la indemnización debe calcularse a tanto alzado se aplican igualmente a los gastos de los mandatarios; que, además, a menudo un único mandatario ha representado a un gran número de productores; que, por lo tanto, se juzga adecuado el reembolso de los honorarios a tanto alzado;

Whereas it is considered appropriate to introduce, by way of receipt in full and final settlement, a single document for the whole of the Community, without prejudice to the Commission's right to adjust the wording thereof in respect of a Member State if necessary;
|
Considerando que los productores que han presentado un recurso ante el Tribunal de Primera Instancia tendrán que abonar honorarios más elevados a sus mandatarios y, por consiguiente, deberían recibir un importe a tanto alzado más elevado; que, en determinados casos concretos, convendría prever la posibilidad de reembolsar los gastos que superen el importe a tanto alzado;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Milk and Milk Products,
|
Considerando que resulta oportuno prever como recibo del finiquito de todas las cuentas un texto único para el conjunto de la Comunidad, sin perjuicio de que la Comisión pueda adaptar los términos del mismo para un Estado miembro si resultara necesario;

HAS ADOPTED THIS REGULATION:
|
Considerando que las medidas previstas en el presente Reglamento se ajustan al dictamen del Comité de gestión de la leche y de los productos lácteos,

HA ADOPTADO EL PRESENTE REGLAMENTO:

|
|
|
|
Article 1
|
|
|
The form referred to in Article 9 of Regulation (EC) No 2330/98 shall be as set out in Annex I.
|

|
The competent authority may adapt the form to take account of information already at its disposal, or in order to obtain additional information or evidence necessary for the purpose of implementing the provisions of Regulation (EC) No 2330/98, and in particular Article 5(3) and (4) thereof.
|
En el anexo I figura el impreso mencionado en el artículo 9 del Reglamento (CE) n° 2330/98.
|
|
|
La autoridad competente podrá adaptar el impreso para tener en cuenta la información de que ya disponga, o para obtener información o pruebas suplementarias necesarias para la aplicación de las disposiciones del Reglamento (CE) n° 2330/98, y en particular, de los apartados 3 y 4 de su artículo 5.
|
|
Article 2
|
|
|
The costs incurred by a producer in respect of payment of an agent who has acted in his name and on his behalf in dealing with the Community institutions shall be reimbursed on a flat-rate basis at the rate of 0,5 % of the amount of the compensation referred to in Article 10 of Regulation (EC) No 2330/98, subject to a minimum of ECU 500 in the case of producers who have brought proceedings against the Community in the Court of First Instance, and a minimum of ECU 250 in other cases.

The reimbursement shall be made by the competent authority only on request by the producer in the form referred to in Article 1 and upon presentation of the bill for the agent's fees.
|
Los gastos anticipados por el productor para el pago de un mandatario que haya actuado en su nombre y en representación suya ante las instituciones comunitarias se reembolsarán a tanto alzado por un importe del 0,5 % de la indemnización contemplada en el artículo 10 del Reglamento (CE) n° 2330/98, con un mínimo de 500 ecus en el caso de los productores que han presentado recursos contra la Comunidad ante el Tribunal de Primera Instancia, y un mínimo de 250 ecus en los demás casos.

However, the sum paid to the producer may not exceed the amount shown on the bill and each producer may claim only the fees of one agent.
|
La autoridad competente sólo reembolsará los gastos a petición del productor mediante el impreso al que se hace referencia en el artículo 1 y contra la presentación de la nota de honorarios del mandatario.
|
|
|
No obstante, la suma pagada al productor no podrá superar el importe que figura en la nota de honorarios y cada productor sólo podrá reclamar los honorarios de un solo mandatario.
|
|
Article 3
|
|
|
Notwithstanding the provisions of Article 2, in those cases which have been the subject of a ruling by the Court of First Instance on the issue of the liability of the Community Institutions, the amount of costs may be agreed directly between the Community Institutions and the agents of the producers concerned.
|

No obstante lo dispuesto en el artículo 2, en aquellos casos que hayan sido objeto de una resolución del Tribunal de Primera Instancia sobre la responsabilidad de las instituciones comunitarias, el importe de los gastos podrá ser acordado directamente entre las instituciones comunitarias y los mandatarios de los productores implicados.

Article 4
|
|
|
For the purposes of this Regulation, a body which renders services solely against payment of dues shall not be considered an agent.
|

A efectos de la aplicación del presente Reglamento, no se considerará como mandatario un organismo cuyos servicios se presten contra el simple pago de una cotización.
|
|
Article 5
|
|
|
Subject to verifying that the agent's bill concerns costs relating to services performed prior to the entry into force of Regulation (EC) No 2330/98, the competent authority shall indicate and include in the compensation offer made to the producer the amount determined in accordance with Article 2 or, where appropriate, the amount agreed in accordance with Article 3 and notified to the competent authority.

Articles 11 and 12 of Regulation (EC) No 2330/98 shall also apply to the aforementioned sum.

Previa comprobación de que los gastos del mandatario corresponden a los gastos por los servicios prestados antes de la entrada en vigor del Reglamento (CE) n° 2330/98, la autoridad competente indicará e incluirá en la oferta de indemnización presentada al productor el importe calculado de conformidad con el artículo 2 o, en su caso, el importe acordado de conformidad con el artículo 3 y notificado a la autoridad competente.

|
Los artículos 11 y 12 del Reglamento (CE) n° 2330/98 se aplicarán igualmente a dicho importe.

Article 6
|
|
|
The statement of receipt in full and final settlement referred to in Article 13(3) of Regulation (EC) No 2330/98 shall be made on the standard form in Annex II.
|

|
|
At the request of a Member State, the Commission may decide to alter the standard form in respect of that Member State in order to take account of specific relevant national provisions.
|
El recibo para finiquitar todas las cuentas contemplado en el apartado 3 del artículo 13 del Reglamento (CE) n° 2330/98 se ajustará al modelo que figura en el anexo II.
|
|
|
La Comisión podrá decidir la adaptación del modelo para un Estado miembro a petición del mismo, para ajustarse a las disposiciones específicas nacionales aplicables en la materia.

|
Article 7
|
|
|
This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
