COMMISSION DECISION of 11 June 1992 laying down certain rules to ensure coordination between organizations and associations which maintain or establish stud-books for registered equidae (92/354/EEC)

DECISIÓN DE LA COMISIÓN de 11 de junio de 1992 por la que se fijan determinadas normas tendentes a garantizar la coordinación entre las organizaciones y asociaciones que lleven o creen libros genealógicos para équidos registrados (92/354/CEE)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,

Having regard to the Treaty establishing the European Economic Community,

Visto el Tratado constitutivo de la Comunidad Económica Europea,

Having regard to Council Directive 90/427/EEC of 26 June 1990 on the zootechnical and genealogical conditions governing intra-Community trade in equidae (1), and in particular Article 4 (2) (e) thereof,

Vista la Directiva 90/427/CEE del Consejo, de 26 de junio de 1990, relativa a las condiciones zootécnicas y genealógicas que regulan los intercambios intracomunitarios de équidos (1), y, en particular, la letra e) del apartado 2 de su artículo 4,

Whereas Decision 92/353/EEC (2) lays down the criteria for the approval or recognition of organizations and associations which maintain or establish stud-books for registered equidae; whereas that Decision provides that the authorities of the Member State concerned are responsible for approving or recognizing organizations or associations which maintain or establish stud-books;

Considerando que, por Decisión 92/353/CEE (2) la Comisión ha establecido los criterios para la autorización o el reconocimiento de las organizaciones o asociaciones que lleven o creen libros genealógicos para équidos registrados; que, de conformidad con dicha Decisión, las autoridades del Estado miembro de que se trate son responsables de la autorización o del reconocimiento de las organizaciones o asociaciones que lleven o creen libros genealógicos;

Whereas in this context, therefore, rules should be laid down to govern the relations between the organization or association which maintains the stud-book of the origin of the breed and an organization or association which maintains or establishes a stud-book or a section of a stud-book for that breed;

Considerando que, en este contexto, conviene prever normas que regulen las relaciones entre la organización o asociación que lleve el libro genealógico de origen de la raza y las organizaciones o asociaciones que lleven o creen un libro genealógico o una sección de un libro genealógico de dicha raza;

Whereas provisions should be made for a procedure enabling the competent authorities concerned to ensure, in special circumstances, coordination between two organizations or associations; whereas it is also important that all the information required for the adoption of the specific coordination rules pursuant to Article 4 (2) (e) of Directive 90/427/EEC be made available to the Commission;

Considerando que es preciso prever un procedimiento que permita, en circunstancias especiales, a las autoridades competentes encargarse de la coordinación entre dos organizaciones o asociaciones; que conviene, además, permitir a la Comisión que disponga de toda la información necesaria para adoptar normas específicas de coordinación con arreglo a la letra e) del apartado 2 del artículo 4 de la Directiva 90/427/CEE;

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

Considerando que las medidas previstas en la presente Decisión se ajustan al dictamen del Comité zootécnico permanente,

HAS ADOPTED THIS DECISION:

HA ADOPTADO LA PRESENTE DECISIÓN:

Article 1

Artículo 1

The organization or association which maintains the stud-book of the origin of the breed must ensure close collaboration with the organization and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute.

La organización o asociación que lleve el libro genealógico de origen de la raza deberá mantener una estrecha colaboración con las organizaciones y asociaciones que lleven libros genealógicos o secciones de libros genealógicos de la misma raza, en particular para prevenir cualquier diferencia.

Article 2

Artículo 2

1. Where the competent authority of a Member State considers that an approved or recognized organization or association in another Member State is not complying with the rules laid down in the relevant Community legislation, and particularly with the principles laid down by the organization or association which maintains the stud-book of the origin of the breed, it shall contact the competent authority of the other Member State concerned forthwith.

1. En los casos en que la autoridad competente de un Estado miembro considere que una organización o asociación autorizada o reconocida en otro Estado miembro no respeta las normas previstas por la normativa comunitaria en la materia, y en particular los principios fijados por la organización o asociación que lleve el libro genealógico de origen de la raza, entrará inmediatamente en contacto con la autoridad competente de ese otro Estado miembro.

The latter shall take all the necessary measures and inform the competent authority of the first Member State of the type of checks carried out, the decisions taken and the reasons for those decisions.

Esta última autoridad adoptará todas las medidas necesarias y comunicará a la autoridad competente del primer Estado miembro las características de los controles efectuados, las decisiones adoptadas y las razones que las justifiquen.

2. If the competent authorities of the first Member State considers these measures likely to be insufficient, it shall explore with the authority of the other Member State ways of remedying the situation, if necessary by visiting that Member State.

2. Si la autoridad competente del primer Estado miembro considerare que esas medidas no son suficientes, estudiará junto con la autoridad del Estado miembro afectado los medios para poder fin a esa situación, recurriendo, si fuera necesario, a la realización de una visita a ese Estado miembro.

3. The competent authorities of the Member States shall inform the Commission of the solutions decided upon.

3. Las autoridades de tales Estados miembros informarán a la Comisión de las soluciones por las que hayan optado.

4. In the event that no solution is found within six months, at the request of one of the authorities of the Member States concerned or on its own initiative, the Commission may, in particular, send an inspection team in collaboration with the competent national authorities.

4. En el supuesto de que, en un plazo de seis meses, no haya podido encontrarse solución alguna, la Comisión, a petición de una de las autoridades de los Estados miembros afectados, o a iniciativa propia, podrá, en particular enviar in situ un equipo de inspección, en colaboración con las autoridades nacionales competentes.
