Visto el Tratado constitutivo de la Comunidad Económica Europea y , en particular , su artículo 100 ,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 100 thereof,

Having regard to the opinion of the European Parliament (1),

Considerando que los bifenilos policlorados ( PCB ) y los terfenilos policlorados ( PCT ) pueden suponer un serio peligro para la salud y el medio ambiente ;

Having regard to the opinion of the Economic and Social Committee (2),

Considerando que se ha demostrado que , pese a las restricciones en la utilización de los PCB/PCT que introducía la Directiva 76/769/CEE (3) , modificada en último lugar por la Directiva 83/478/CEE (4) , no ha habido en general señal alguna de que la contaminación ambiental causada por los PCB y PCT haya disminuído de forma sensible ; que podrían producirse emisiones muy tóxicas en caso de incendio ; que , por tanto , el umbral de 0,1 % en peso de PCB y PCT en los preparados , que establecía la Directiva 76/769/CEE , debe reducirse sustancialmente ;

Whereas polychlorinated biphenyls (PCBs) and polychlorinated terphenyls (PCTs) may constitute serious risks to health and to the environment;

Considerando que , desde la adopción de la Directiva 76/769/CEE , se han puesto a punto sustitutivos considerados menos peligrosos para los seres humanos y el medio ambiente ; que , en las circunstancias actuales , ya no se justifica por tanto seguir comercializando los PCB/PCT , salvo en ciertos casos excepcionales de duración limitada ;

Whereas it has been ascertained that, despite the restriction on the use of PCBs and PCTs introduced by Directive 76/769/EEC (3), as last amended by Directive 83/478/EEC (4), there is generally no indication that pollution of the environment by PCBs and PCTs has lessened significantly; whereas highly toxic substances may be given off in the event of fires; whereas therefore the threshold laid down in Directive 76/769/EEC of 0,1 % by weight of PCBs and PCTs in preparations must be substantially lowered;

Considerando que debería seguir autorizándose el empleo de los PCB/PCT en determinadas instalaciones y aparatos actualmente en servicio hasta su retirada o hasta el final de la vida útil de dichas instalaciones y aparatos ; que , sin embargo , los Estados miembros podrán prohibir el empleo de los PCB y PCT en su territorio antes del final de la vida útil de esas instalaciones y aparatos ;

Whereas, since Directive 76/769/EEC was adopted, substitutes have been developed which are considered less dangerous to human beings and the environment; whereas the continued marketing of PCBs and PCTs is therefore no longer justified under present circumstances, except in certain exceptional cases of limited duration;

Considerando que los Estados miembros debieran tener la facultad de autorizar excepciones dentro de la prohibición de utilizar los PCB y PCT como productos básicos y , semielaborados cuando se cumplan determinadas condiciones , y concretamente , cuando consideren que no existe peligro para la salud pública ni el medio ambiente ;

Whereas the use of PCBs and PCTs in certain plant and equipment in service at present should continue to be authorized until they have been disposed of or until the end of the service life of the plant and equipment; whereas Member States may nevertheless ban the use of PCBs and PCTs within their territory before the end of the service life of the plant and equipment;

Considerando que en estos momentos no es posible prohibir de forma más general el uso de los PCB y PCT ; que , sin embargo , la presente Directiva constituye un importante paso adelante para lograr esa prohibición ,

Whereas the Member States should be permitted to authorize exceptions to the ban on the use of PCBs and PCTs as primary and intermediate products were certain conditions are fulfilled, in particular where they consider that there is no danger to public health and the environment;

HA ADOPTADO LA PRESENTE DIRECTIVA :

Whereas a more general ban on the use of PCBs and PCTs is not feasible at this stage; whereas, however, this Directive constitutes an important step towards such a ban,

Artículo 1

HAS ADOPTED THIS DIRECTIVE:

1 . El número 1 del Anexo I de la Directiva 76/769/CEE queda reemplazado por el texto del Anexo de la presente Directiva .

Article 1

2 . El Anexo II de la Directiva 76/769/CEE queda modificado como sigue :

1. Point 1 of Annex I to Directive 76/769/EEC is hereby replaced by the text in the Annex to this Directive.

- el actual Anexo II se convertirá en la parte A del Anexo II ;

2. Annex II to Directive 76/769/EEC is hereby amended as follows:

- se le añadirá la siguiente parte B :

- the existing Annex II shall become Annex II, part A;

« B . Disposiciones específicas respecto al etiquetado de productos que contengan PCB y PCT

- part B below shall be added:

Sin perjuicio de lo dispuesto en otras directivas respecto al etiquetado de sustancias y preparados peligrosos , los Estados miembros podrán exigir que en las instalaciones y aparatos que contengan PCB y PCT aparezcan también instrucciones relativas a la eliminación de los PCB y PCT y al mantenimiento y utilización de los aparatos e instalaciones que los contengan . Tales instrucciones habrán de poder leerse horizontalmente cuando el objeto que contenga PCB o PCT esté instalado normalmente . La inscripción deberá destacarse claramente del fondo sobre el que esté inscrita .

'B. Specific provisions relating to the labelling of products containing PCBs and PCTs

Los Estados miembros podrán exigir que la inscripción esté redactada en una lengua que sea comprensible en su territorio . »

Without prejudice to the provisions of other Directives relating to the labelling of dangerous substances and preparations, Member States may require equipment and plant containing PCBs or PCTs also to display instructions concerning the disposal of PCBs and PCTs and the maintenance and use of equipment and plant containing them. These instructions must be capable of being read horizontally when the object containing the PCBs or PCTs is installed in the normal way. The inscription must stand out clearly from its background.

Artículo 2

Member States may require the inscription to be in a language which is understood in their territory.'

1 . Los Estados miembros adoptarán las disposiciones necesarias para cumplir la presente Directiva a más tardar el 30 de junio de 1986 e informarán de ello inmediatamente a la Comisión .

Article 2

2 . Los Estados miembros comunicarán a la Comisión el texto de las disposiciones de Derecho interno que adopten en el ámbito regulado por la presente Directiva .

1. Member States shall take the measures necessary to comply with this Directive by 30 June 1986 at the latest. They shall forthwith inform the Commission thereof.

Artículo 3

2. Member States shall communicate to the Commission the texts of the provisions of national law which they adopt in the field covered by this Directive.

Los destinatarios de la presente Directiva serán los Estados miembros .

ANNEX

1 . - Bifenilos policlorados ( PCB ) , con excepción de los monoclorobifenilos y diclorobifenilos * No se admitirán . Con todo , podrán utilizarse las siguientes categorías , en las condiciones que se indican a continuación : *

1.2 // // // Designation of the substance, of the groups of substances or of the preparation // Conditions of restriction // // // 1. - Polychlorinated biphenyls (PCB) except mono- and dichlorinated biphenyls - Polychlorinated terphenyls (PCTs) - Preparations, including waste oils, with a PCB or PCT content higher than 0,01 % by weight. // May not be used. However, the following categories may be used under the following conditions: 1. until 30 June 1986 at the latest: closed-system electrical equipment transformers, resistors and inductors; 2. until 30 June 1986 at the latest: large condensers ( 1 kg total weight); 3. until 30 June 1986 at the latest: small condensers (provided that the PCB has a maximum chlorine content of 43 % and does not contain more than 3,5 % of penta- and higher chlorinated biphenyls); // // 4. until 30 June 1986 at the latest: heat-transmitting fluids in closed-circuit heat-transfer installations: // // 5. until 30 June 1986 at the latest: hydraulic fluids for underground mining equipment; // // - The use of equipment, plant and fluids referred to in points 1 to 5 above which are in service on 30 June 1986 shall continue to be authorized until they are disposed of or reach the end of their service life. // // - Member States may, for reasons of protection of health and the environment, prohibit within their territory the use of such equipment, plant and fluids before they are disposed of or reach the end of their service life. // // - The placing on the second-hand market of such equipment, plant and fluids which are not intended for disposal shall be prohibited from 30 June 1986 onwards. // // - Where the Member States consider that it is not possible for technical reasons to use substitute products, they may continue to authorize the use of PCBs, PCTs and preparations thereof where the latter are solely intended, in the normal conditions of maintenance of equipment, to supplement the level of liquids containing PCBs in properly functioning existing plant purchased before the entry into force of this Directive. // // 6. until 30 June 1986 at the latest: primary and intermediate products for further processing into other products not prohibited by Directive 76/769/EEC and the Directives amending it; after 30 June 1986 Member States may, provided prior notification stating the reasons is sent to the Commission, grant derogations from the ban on the marketing and use of such primary and intermediate products, in so far as they consider that these derogations have no deleterious effects on health and the environment. // //

- Terfenilos policlorados ( PCT ) * *

- Preparados , incluidos los aceites residuales , cuyo contenido en PCB o PCT sea superior al 0,01 % en peso * *

* 1 . hasta el 30 de junio de 1986 , como máximo : aparatos eléctricos de circuito cerrado ; transformadores , resistencias e inductores ; *

* 2 . hasta el 30 de junio de 1986 , como máximo : condensadores pesados ( peso total * 1 kg ) ; *

* 3 . hasta el 30 de junio de 1986 , como máximo : condensadores ligeros ( siempre que el contenido máximo en cloro de los PCB sea del 43 % no contengan más del 3,5 % de pentaclorobifenilos o de bifenilos con un contenido más elevado en cloro ) ; *

* 4 . hasta el 30 de junio de 1986 , como máximo : fluídos termoconductores en las instalaciones caloríficas de circuito cerrado ; *

* 5 . hasta el 30 de junio de 1986 , como máximo : fluídos hidráulicos para equipos subterráneos de minas ; *

* - Se seguirá autorizando la utilización de los aparatos , instalaciones y fluidos recogidos en los números 1 al 5 anteriores que estén en servicio el 30 de junio de 1986 , hasta que se retiren o lleguen al final de su vida útil . *

* - Por razones de protección de la salud y el medio ambiente , los Estados miembros podrán sin embargo prohibir el uso de estos aparatos , instalaciones y fluídos en su territorio antes de que se retiren o alcancen el final de su vida útil . *

* - A partir del 30 de junio de 1986 , quedará prohibido vender de segunda mano dichos aparatos , instalaciones y fluídos no destinados a la retirada . *

* - Si los Estados miembros consideraran que , por razones técnicas , no es posible utilizar sustitutivos , podrán continuar permitiendo el uso de los PCB y PCT así como de sus preparados si estuvieran destinados exclusivamente , en condiciones normales de mantenimiento del material , a completar el nivel de los líquidos que contengan PCB en las instalaciones existentes y en buen estado de funcionamiento que se hubieran comprado antes de que la presente Directiva entrara en vigor ; *

* 6 . hasta el 30 de junio de 1986 , como máximo : productos básicos y semielaborados destinados a ser transformados en otros productos que no incurran en la prohibición de la Directiva 76/769/CEE y de las Directivas que la modifiquen ; después del 30 de junio de 1986 , los Estados miembros , siempre que envíen una notificación previa a la Comisión especificando los motivos , podrán establecer excepciones dentro de la prohibición de comercializar y utilizar estos productos básicos e intermedios , si consideraran que tales excepciones no tienen efectos nocivos para la salud y el medio ambiente .
