Having regard to the Treaty establishing the European Community and in particular Article 37 thereof,
|
gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft, insbesondere auf Artikel 37,

Having regard to the proposal from the Commission(1),

auf Vorschlag der Kommission(1),

Having regard to the opinion of the European Parliament(2),

nach Stellungnahme des Europäischen Parlaments(2),
|

(1) Whereas Article 6 of Council Regulation (EC) No 3072/95 of 22 December 1995 on the common organisation of the market in rice(3) introduces compensatory payments to Community rice producers;
|
in Erwägung nachstehender Gründe:
|
|
(2) Whereas Article 1(a) of Council Regulation (EEC) No 3508/92 of 27 November 1992 establishing an integrated administration and control system for certain Community aid schemes(4) stipulates that the system it introduces is to apply to the aid scheme for rice producers established by Article 6 of Regulation (EC) No 3072/95;

(1) Mit Artikel 6 der Verordnung (EG) Nr. 3072/95 des Rates vom 22. Dezember 1995 über die gemeinsame Marktorganisation für Reis(3) wurde eine Regelung über Ausgleichzahlungen für Reiserzeuger eingeführt.
|
|
(3) Whereas, in order to ensure that the integrated system is properly and permanently applied to the scheme of compensatory payments to rice producers, the deadlines for lodging applications and for certain amendments to applications in the producer Member States should be specified,
|
(2) Gemäß Artikel 1 Buchstabe a) der Verordnung (EWG) Nr. 3508/92 des Rates vom 27. November 1992 zur Einführung eines integrierten Verwaltungs- und Kontrollsystems für bestimmte gemeinschaftliche Beihilferegelungen(4) gilt das eingeführte System für die Stützungsregelung für Reiserzeuger gemäß Artikel 6 der Verordnung (EG) Nr. 3072/95.

HAS ADOPTED THIS REGULATION:
|
(3) Um eine reibungslose und dauerhafte Anwendung des integrierten Systems auf die Regelung über Ausgleichszahlungen für Reiserzeuger zu ermöglichen, gilt es, die Fristen für die Einreichung der Anträge sowie für bestimmte Änderungen der Anträge in den Erzeugermitgliedstaaten festzulegen -

HAT FOLGENDE VERORDNUNG ERLASSEN:
|
|
Article 1
|
|
|
Article 6 of Regulation (EEC) No 3508/92 shall be amended as follows:
|
Artikel 1
|
|
(a) paragraph (2) shall be supplemented by the following subparagraph: "In the context of the compensatory payments to rice producers provided for in Article 6 of Regulation (EC) No 3072/95, the date fixed by the Member State may not be later than 31 May preceding the harvest in question and, in the case of Portugal and Spain, 30 June preceding the harvest.";

Artikel 6 der Verordnung (EWG) Nr. 3508/92 wird wie folgt geändert:
|
|
(b) in paragraph 4 the following subparagraph shall be added: "In the context of the compensatory payments to rice producers provided for in Article 6 of Regulation (EC) No 3072/95, certain amendments may be made to 'area' aid applications provided the competent authorities receive these not later than the dates fixed in the third subparagraph of paragraph 2 of this Article."

a) Dem Absatz 2 wird folgender Unterabsatz angefügt: "Im Rahmen der Regelung über Ausgleichszahlungen für Reiserzeuger gemäß Artikel 6 der Verordnung (EG) Nr. 3072/95 darf der vom Mitgliedstaat festgelegte Zeitpunkt nicht nach dem 31. Mai oder für Portugal und Spanien nicht nach dem 30. Juni liegen, der der entsprechenden Ernte vorangeht."

b) Dem Absatz 4 wird folgender Unterabsatz angefügt: "Im Rahmen der Regelung über Ausgleichszahlungen für Reiserzeuger gemäß Artikel 6 der Verordnung (EG) Nr. 3072/95 kann der Beihilfeantrag 'Flächen' in bestimmten Punkten abgeändert werden, sofern diese Änderungen spätestens zu den in Absatz 2 Unterabsatz 3 dieses Artikels festgelegten Zeitpunkten bei den zuständigen Behörden eingehen."

Article 2

|
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Communities.
|
Artikel 2
|
|
|
Diese Verordnung tritt am dritten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Gemeinschaften in Kraft.
|
|
This Regulation shall be binding in its entirety and directly applicable in all Member States.
|
|
|

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.
