VERORDNUNG (EG) Nr. 2772/95 DER KOMMISSION vom 30. November 1995 zum Ersatz der Beträge in Ecu in der Verordnung (EWG) Nr. 2078/92 des Rates für umweltgerechte und den natürlichen Lebensraum schützende landwirtschaftliche Produktionsverfahren

Having regard to the Treaty establishing the European Community,

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft,

Having regard to Council Regulation (EEC) No 3813/92 of 28 December 1992 on the unit of account and the conversion rates to be applied for the purposes of the common agricultural policy (1), as last amended by Regulation (EC) No 150/95 (2),

gestützt auf die Verordnung (EWG) Nr. 3813/92 des Rates vom 28. Dezember 1992 über die Rechnungseinheit und die im Rahmen der gemeinsamen Agrarpolitik anzuwendenden Umrechnungskurse (1), zuletzt geändert durch die Verordnung (EG) Nr. 150/95 (2),

Having regard to Commission Regulation (EEC) No 1068/93 of 30 April 1993 on detailed rules for determining and applying the agricultural conversion rates (3), as last amended by Regulation (EC) No 1053/95 (4), and in particular Article 18 (2) thereof,

gestützt auf die Verordnung (EWG) Nr. 1068/93 der Kommission vom 30. April 1993 mit Durchführungsvorschriften für die Bestimmung und Anwendung der im Agrarsektor verwendeten Umrechnungskurse (3), zuletzt geändert durch die Verordnung (EG) Nr. 1053/95 (4), insbesondere auf Artikel 18 Absatz 2,

Whereas with effect from 1 February 1995, Article 13 (2) of Council Regulation (EEC) No 3813/92 alters the value in ecus of certain prices and amounts in order to neutralize the effects of the abolition of the corrective factor of 1,207509 which until 31 January 1995 affected the conversion rates used for agriculture;

in Erwägung nachstehender Gründe:

Whereas the new values in ecus of the prices and amounts concerned have been established as of 1 February 1995 according to the rules laid down in Article 13 (2) of Regulation (EEC) No 3813/92 and Article 18 (1) of Regulation (EEC) No 1068/93;

Gemäß Artikel 13 Absatz 2 der Verordnung (EWG) Nr. 3813/92 wurden zum 1. Februar 1995 bestimmte in Ecu ausgedrückte Preise und Beträge geändert, um die Auswirkung der Abschaffung des bis zum 31. Januar 1995 auf die landwirtschaftlichen Umrechnungskurse angewandten Berichtigungsfaktors 1,207509 auszugleichen.

Whereas, in accordance with Article 18 (2) of Regulation (EEC) No 1068/93, in order to avoid confusion and to facilitate the application of the common agricultural policy, the values in ecus of the amounts given in Council Regulation (EEC) No 2078/92 (5), as last amended by the Act of Accession of Austria, Finland and Sweden, which apply at least from:

Die in Ecu ausgedrückten Preise und Beträge werden seit 1. Februar 1995 bestimmt gemäß Artikel 13 Absatz 2 der Verordnung (EWG) Nr. 3813/92 und Artikel 18 Absatz 1 der Verordnung (EWG) Nr. 1068/93.

- 1 January 1996 for amounts which are not affected by a marketing year,

Um Irrtümer zu vermeiden und die Anwendung der gemeinsamen Agrarpolitik zu erleichtern, sollten gemäß Artikel 18 Absatz 2 der Verordnung (EWG) Nr. 1068/93 in der Verordnung (EWG) Nr. 2078/92 des Rates (5), zuletzt geändert durch die Akte über den Beitritt Österreichs, Finnlands und Schwedens, die in Ecu ausgedrückten Beträge ersetzt werden, die spätestens anwendbar sind ab

- the beginning of the 1996 marketing year in the case of amounts for which the marketing year begins in January 1996, and - the beginning of the 1995/96 marketing year in the other cases,

- 1. Januar 1996 im Fall der wirtschaftsjahrunabhängigen Beträge;

and which are among the legal instruments coming into force before 1 February 1995, should be replaced,

- Beginn des Wirtschaftsjahres 1996 im Fall der Beträge, die in einem im Januar 1996 beginnenden Wirtschaftsjahr gelten;

HAS ADOPTED THIS REGULATION:

- Beginn des Wirtschaftsjahres 1995/96 in allen in den vor dem 1. Februar 1995 in Kraft getretenen Rechtsakten angeführten anderen Fällen -

HAT FOLGENDE VERORDNUNG ERLASSEN:

Article 1

As a consequence of the adjustment with effect from 1 February 1995, pursuant to Article 13 (2) of Regulation (EEC) No 3813/92 and to Article 18 (1) of Regulation (EEC) No 1068/93, on the amounts in ecus in Regulation (EEC) No 2078/92, the latter shall be amended as laid down in Article 2 hereof.

Artikel 1

Die in der Verordnung (EWG) Nr. 2078/92 in Ecu ausgedrückten Beträge werden wegen der ab 1. Februar 1995 nach Artikel 13 Absatz 2 der Verordnung (EWG) Nr. 3813/92 erfolgten Anpassung gemäß Artikel 18 Absatz 1 der Verordnung (EWG) Nr. 1068/93 wie in Artikel 2 vorgesehen ersetzt.

Article 2

Regulation (EEC) No 2078/92 is amended as follows:

Artikel 2

1. in Article 4 (2) the amount 'ECU 150` is replaced by 'ECU 181,1`; the amounts 'ECU 250` are replaced by 'ECU 301,9`; the amount 'ECU 100` is replaced by 'ECU 120,8`; the amount 'ECU 400` is replaced by 'ECU 483,0`; the amount 'ECU 1 000` is replaced by 'ECU 1 208`; the amount 'ECU 700` is replaced by 'ECU 845,3` and the amount 'ECU 600` is replaced by 'ECU 724,5`;

Die Verordnung (EWG) Nr. 2078/92 wird wie folgt geändert:

2. in Article 4 (3) the amount 'ECU 350` is replaced by 'ECU 422,6`;

1. In Artikel 4 Absatz 2 werden die nachstehenden, in Ecu ausgedrückten Beträge wie folgt ersetzt: "150" durch "181,1"; "250" durch "301,9"; "100" durch "120,8"; "400" durch "483,0"; "1 000" durch "1 208"; "700" durch "845,3" und "600" durch "724,5".

3. in Article 6 (1) the amount 'ECU 2 500` is replaced by 'ECU 3 019`.

2. In Artikel 4 Absatz 3 wird der Betrag von 350 ECU durch den Betrag von 422,6 ECU ersetzt.

3. In Artikel 6 Absatz 1 wird der Betrag von 2 500 ECU durch den Betrag von 3 019 ECU ersetzt.

Article 3

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

Artikel 3

It shall apply, for each amount in question, from the date on which an agricultural conversion rate fixed on or after 1 February 1995 is first applied.

Diese Verordnung tritt am siebten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Gemeinschaften in Kraft.

Sie gilt für den jeweiligen Preis oder Betrag ab der erstmaligen Anwendung des entsprechenden, zum 1. Februar 1995 oder danach festgesetzten landwirtschaftlichen Umrechnungskurses.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
