COUNCIL DIRECTIVE 97/42/EC of 27 June 1997 amending for the first time Directive 90/394/EEC on the protection of workers from the risks related to exposure to carcinogens at work (Sixth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC)

THE COUNCIL OF THE EUROPEAN UNION,

RICHTLINIE 97/42/EG DES RATES vom 27. Juni 1997 zur ersten Änderung der Richtlinie 90/394/EWG über den Schutz der Arbeitnehmer gegen Gefährdung durch Karzinogene bei der Arbeit (Sechste Einzelrichtlinie im Sinne von Artikel 16 Absatz 1 der Richtlinie 89/391/EWG)

Having regard to the Treaty establishing the European Community, and in particular Article 118a thereof,

DER RAT DER EUROPÄISCHEN UNION -

Having regard to Council Directive 90/394/EEC of 28 June 1990 on the protection of workers from the risks related to exposure to carcinogens at work (Sixth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC) (1), and in particular Article 16 thereof,

gestützt auf den Vertrag zur Gründung der Europäischen Union, insbesondere auf Artikel 118a,

Having regard to the proposal from the Commission (2), drawn up following consultation with the Advisory Committee on Safety, Hygiene and Health Protection at Work,

gestützt auf die Richtlinie 90/394/EWG des Rates vom 28. Juni 1990 über den Schutz der Arbeitnehmer gegen Gefährdung durch Karzinogene bei der Arbeit (Sechste Einzelrichtlinie im Sinne von Artikel 16 Absatz 1 der Richtlinie 89/391/EWG) (1), insbesondere auf Artikel 16,

Having regard to the opinion of the Economic and Social Committee (3),

auf Vorschlag der Kommission (2), der nach Anhörung des Beratenden Ausschusses für Sicherheit, Arbeitshygiene und Gesundheitsschutz am Arbeitsplatz ausgearbeitet wurde,

Acting in accordance with the procedure referred to in Article 189c of the Treaty (4),

nach Stellungnahme des Wirtschafts- und Sozialausschusses (3),

(1) Whereas Article 118a of the Treaty provides that the Council is to adopt, by means of directives, minimum requirements for encouraging improvements, especially in the working environment, to ensure a better level of protection of the safety and health of workers;

gemäß dem Verfahren des Artikels 189c des Vertrags (4),

(2) Whereas, under the terms of that Article, such directives are to avoid imposing administrative, financial and legal constraints in a way which would hold back the creation and development of small and medium-size undertakings;

in Erwägung nachstehender Gründe:

(3) Whereas Commission Directive 91/325/EEC of 1 March 1991 adapting to technical progress for the twelfth time Council Directive 67/548/EEC on the approximation of the laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances (5) introduces in Annex III new risk phrases to indicate the health hazards resulting from prolonged exposure and the risk of cancer through inhalation;

(1) Artikel 118a des Vertrags sieht vor, daß der Rat durch Richtlinien Mindestvorschriften zur Förderung von Verbesserungen insbesondere der Arbeitsumwelt mit dem Ziel erläßt, ein höheres Niveau beim Schutz der Sicherheit und der Gesundheit von Arbeitnehmern zu gewährleisten.

(4) Whereas in all work situations workers must be protected in respect of preparations containing one or more carcinogens and from carcinogenic compounds arising at work;

(2) Gemäß jenem Artikel sollen diese Richtlinien keine verwaltungsmäßigen, finanziellen oder rechtlichen Auflagen vorschreiben, die der Gründung und Entwicklung von Klein- und Mittelbetrieben entgegenstehen.

(5) Whereas, for some agents it is necessary to consider all absorption pathways, including the possibility of penetration through the skin, in order to ensure the best possible level of protection;

(3) Die Richtlinie 91/325/EWG der Kommission vom 1. März 1991 zur zwölften Anpassung an den technischen Fortschritt der Richtlinie 67/548/EWG des Rates zur Angleichung der Rechts- und Verwaltungsvorschriften für die Einstufung, Verpackung und Kennzeichnung gefährlicher Stoffe (5) führt in Anhang III neue R-Sätze zum Hinweis auf die bei längerer Exposition gegebenen Gesundheitsgefahren und das Krebsrisiko durch Einatmen ein.

(6) Whereas the wording of point 2 of Annex I to Directive 90/394/EEC relating to polycyclic aromatic hydrocarbons has posed problems of interpretation in many Member States; whereas, therefore, a new, more precise wording is called for;

(4) Arbeitnehmer müssen in bezug auf Zubereitungen, die ein oder mehrere Karzinogene enthalten, und auf bei der Arbeit entstehende karzinogene Verbindungen in allen Arbeitssituationen geschützt werden.

(7) Whereas Article 16 of Directive 90/394/EEC makes provision for the establishment of exposure limit values on the basis of the available information, including scientific and technical data, in respect of all those carcinogens for which this is possible;

(5) Soll das größtmögliche Maß an Sicherheit gewährleistet werden, so ist es bei einigen Arbeitsstoffen erforderlich, sämtliche Resorptionswege einschließlich der Möglichkeit einer Hautpenetration zu berücksichtigen.

(8) Whereas occupational exposure limit values must be regarded as an important component of the general arrangements for the protection of workers; whereas such limit values must be revised whenever this becomes necessary in the light of more recent scientific data;

(6) Der Wortlaut von Anhang I Nummer 2 der Richtlinie 90/394/EWG, der sich auf polyzyklische aromatische Kohlenwasserstoffe bezieht, hat in vielen Mitgliedstaaten zu Interpretationsproblemen geführt; daher ist eine neue, genauere Formulierung erforderlich.

(9) Whereas benzene is a carcinogen which is present in many work situations; whereas, therefore, a large number of workers are exposed to a potential health risk; whereas, although current scientific knowledge is not such that a level can be established below which risks to health cease to exist, a reduction in exposure to benzene will nonetheless reduce these risks;

(7) Artikel 16 der Richtlinie 90/394/EWG sieht die Festlegung von Expositionsgrenzwerten auf der Grundlage der verfügbaren Informationen, einschließlich wissenschaftlicher und technischer Daten, für alle Karzinogene vor, bei denen dies möglich ist.

(10) Whereas the respect of the minimum requirements on the protection of health and safety of workers from the specific risks related to carcinogens aims not only to ensure the protection of the health and safety of each individual worker but also to provide a level of minimum protection of all workers in the Community;

(8) Grenzwerte berufsbedingter Exposition sind als wichtiger Bestandteil der allgemeinen Vorkehrungen zum Schutz der Arbeitnehmer anzusehen. Derartige Grenzwerte müssen revidiert werden, wenn sich dies angesichts neuerer wissenschaftlicher Daten als erforderlich erweist.

(11) Whereas a consistent level of protection from the risks related to carcinogens has to be established for the Community as a whole and whereas that level of protection has to be set not by detailed prescriptive requirements but by a framework of general principles to enable Member States to apply the minimum requirements consistently;

(9) Benzol ist ein in zahlreichen Arbeitssituationen vorhandenes Karzinogen. Daher ist eine Vielzahl von Arbeitnehmern einem möglichen Gesundheitsrisiko ausgesetzt. Zwar ist es nach dem derzeitigen wissenschaftlichen Kenntnisstand nicht möglich, eine Expositionshöhe festzulegen, unterhalb deren keine Gesundheitsrisiken mehr gegeben sind, dennoch wird eine Senkung der Benzolexposition diese Risiken mindern.

(12) Whereas this amendment constitutes a practical aspect of the realization of the social dimension of the internal market;

(10) Durch die Befolgung der Mindestvorschriften über den Schutz von Gesundheit und Sicherheit der Arbeitnehmer gegen die besondere Gefährdung durch Karzinogene wird nicht nur angestrebt, den Schutz der Gesundheit und Sicherheit jedes einzelnen Arbeitnehmers zu gewährleisten, sondern auch ein Mindestmaß an Schutz für alle Arbeitnehmer in der Gemeinschaft zu schaffen.

(13) Whereas, pursuant to Decision 74/325/EEC (6), the Advisory Committee on Safety, Hygiene and Health Protection at Work is to be consulted by the Commission with a view to drawing up proposals in this field,

(11) Es muß ein einheitliches, für die ganze Gemeinschaft geltendes Niveau des Schutzes gegen die Gefährdung durch Karzinogene festgelegt werden, und zwar nicht durch detaillierte Vorschriften, sondern durch einen Rahmen allgemeiner Grundsätze, innerhalb dessen die Mitgliedstaaten die Mindestvorschriften entsprechend anwenden können.

HAS ADOPTED THIS DIRECTIVE:

(12) Diese Änderung stellt einen praktischen Aspekt der Verwirklichung der sozialen Dimension des Binnenmarktes dar.

(13) Gemäß dem Beschluß 74/325/EWG (6) muß die Kommission der Beratenden Ausschuß für Sicherheit, Arbeitshygiene und Gesundheitsschutz am Arbeitsplatz im Hinblick auf die Erstellung von Vorschlägen auf diesem Gebiet konsultieren -

HAT FOLGENDE RICHTLINIE ERLASSEN:

Article 1

Directive 90/394/EEC is hereby amended as follows:

1. in Article 1, the following paragraph shall be added:

Artikel 1

'4. As regards asbestos and vinyl chloride monomer, which are dealt with by specific Directives, the provisions of this Directive shall apply when they are more favourable to safety and health at work.`;

Richtlinie 90/394/EWG wird wie folgt geändert:

2. Article 2 shall be replaced by the following:

1. In Artikel 1 wird folgender Absatz angefügt:

'Article 2

"(4) Für Asbest und Vinylchloridmonomer, die in Einzelrichtlinien behandelt werden, gelten die Bestimmungen der vorliegenden Richtlinie, soweit sie ein höheres Sicherheits- und Gesundheitsschutzniveau bei der Arbeit vorsehen."

For the purposes of this Directive,

2. Artikel 2 erhält folgende Fassung:

(a) "carcinogen" means:

"Artikel 2

(i) a substance which meets the criteria for classification as a category 1 or 2 carcinogen set out in Annex VI of Directive 67/548/EEC;

Im Sinne dieser Richtlinie

(ii) a preparation composed of one or more substances referred to in point (i) where the concentration of one or more of the individual substances meets the requirements for concentration limits for the classification of a preparation as a category 1 or 2 carcinogen set out either:

a) gilt als Karzinogen

- in Annex I to Directive 67/548/EEC, or

i) ein Stoff, der die in Anhang VI der Richtlinie 67/548/EWG genannten Kriterien für die Einstufung als krebserzeugender Stoff der Kategorie 1 oder 2 erfuellt;

- in Annex I to Directive 88/379/EEC where the substance or substances do not appear in Annex I to Directive 67/548/EEC or appear in it without concentration limits;

ii) eine Zubereitung, die einen oder mehrere der in Ziffer i) genannten Stoffe enthält, sofern die Konzentration einer oder mehrerer der einzelnen Stoffe die Anforderungen für Konzentrationsgrenzen für die Einstufung einer Zubereitung als krebserzeugender Stoff der Kategorie 1 oder 2 erfuellt, die vorgeschrieben sind

(iii) a substance, preparation or process referred to in Annex I as well as a substance or preparation released by a process referred to in Annex I;

- entweder in Anhang I der Richtlinie 67/548/EWG

(b) "limit value" means, unless otherwise specified, the limit of the time-weighted average of the concentration for a "carcinogen" in the air within the breathing zone of a worker in relation to a specified reference period as set out in Annex III.`;

- oder in Anhang I der Richtlinie 88/379/EWG, sofern der Stoff bzw. die Stoffe in Anhang I der Richtlinie 67/548/EWG nicht aufgeführt sind oder ohne Konzentrationsgrenzen aufgeführt sind;

3. Article 3 (3) shall be replaced by the following:

iii) ein Stoff, eine Zubereitung oder ein Verfahren gemäß Anhang I sowie ein Stoff oder eine Zubereitung, der bzw. die durch ein in Anhang I genanntes Verfahren freigesetzt wird;

'3. Furthermore, when assessing the risk, account shall be taken of all other routes of exposure, such as absorption into and/or through the skin`.

b) gilt als Grenzwert, sofern nicht anders angegeben, die Grenze des zeitlich gewogenen Mittelwerts der Konzentration für ein Karzinogen in der Luft im Atembereich eines Arbeitsnehmers innerhalb eines in Anhang III angegebenen Referenzzeitraums."

4. in Article 5, the following paragraph shall be inserted after paragraph 3:

3. Artikel 3 Absatz 3 erhält folgende Fassung:

'4. Exposure shall not exceed the limit value of a carcinogen as set out in Annex III.`

"(3) Außerdem sind alle sonstigen Expositionswege, z. B. Aufnahme in und/oder über die Haut, bei der Risikobewertung zu berücksichtigen."

Former paragraph 4 shall become paragraph 5.

4. In Artikel 5 wird nach Absatz 3 folgender Absatz eingefügt:

5. item 2 of Annex I shall be replaced by the following:

"(4) Die in Anhang III aufgeführten Grenzwerte für Karzinogene dürfen nicht überschritten werden."

'2. Work involving exposure to polycyclic aromatic hydrocarbons present in coal soot, coal tar or coal pitch`.

Der bisherige Absatz 4 wird zu Absatz 5.

6. Part A of Annex III shall be replaced by the following:

5. Anhang I Nummer 2 erhält folgende Fassung:

'A. LIMIT VALUES FOR OCCUPATIONAL EXPOSURE

"2. Arbeiten, bei denen die betreffenden Arbeitnehmer polyzyklischen aromatischen Kohlenwasserstoffen ausgesetzt sind, die in Steinkohlenruß, Steinkohlenteer oder Steinkohlenpech vorhanden sind."

6. Anhang III Teil A erhält folgende Fassung:

Article 2

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive not later than 27 June 2000. They shall forthwith inform the Commission thereof.

When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by the Member States.

Artikel 2

2. Member States shall communicate to the Commission the texts of the provisions of national law which they adopt in the field covered by this Directive.

(1) Die Mitgliedstaaten erlassen die erforderlichen Rechts- und Verwaltungsvorschriften, um dieser Richtlinie spätestens am 27. Juni 2000 nachzukommen. Sie setzen die Kommission unverzüglich davon in Kenntnis.

Wenn die Mitgliedstaaten diese Vorschriften erlassen, nehmen sie in den Vorschriften selbst oder durch einen Hinweis bei der amtlichen Veröffentlichung auf diese Richtlinie Bezug. Die Mitgliedstaaten regeln die Einzelheiten der Bezugnahme.

Article 3

(2) Die Mitgliedstaaten teilen der Kommission den Wortlaut der innerstaatlichen Rechtsvorschriften mit, die sie auf dem unter diese Richtlinie fallenden Gebiet erlassen.
