THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft,

Having regard to Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste [1], and in particular the third subparagraph of Article 37(2) thereof,

gestützt auf die Verordnung (EG) Nr. 1013/2006 des Europäischen Parlaments und des Rates vom 14. Juni 2006 über die Verbringung von Abfällen [1], insbesondere auf Artikel 37 Absatz 2 Unterabsatz 3,

After consultation of the countries concerned,

nach Anhörung der betroffenen Staaten,

Whereas:

in Erwägung nachstehenden Grundes:

The Commission has received replies from Montenegro, Nepal, Serbia and Singapore to its written requests seeking confirmation in writing that waste which is listed in Annex III or IIIA to Regulation (EC) No 1013/2006 and the export of which is not prohibited under its Article 36 may be exported from the Community for recovery in those countries and requesting an indication from them as to which control procedure, if any, would be followed there. The Commission has also received further information relating to Hong Kong, Indonesia and Ukraine. The Annex to Commission Regulation (EC) No 1418/2007 [2] should therefore be amended to take this into account,

Die Kommission hat von Montenegro, Nepal, Serbien und Singapur Antworten auf ihre schriftlichen Ersuchen erhalten, in denen diese Staaten gebeten wurden, schriftlich zu bestätigen, dass Abfälle, die in den Anhängen III oder IIIA der Verordnung (EG) Nr. 1013/2006 aufgeführt sind und deren Ausfuhr nicht gemäß ihrem Artikel 36 verboten ist, zur Verwertung in den betreffenden Staaten aus der Gemeinschaft ausgeführt werden dürfen, und anzugeben, welches Kontrollverfahren von ihnen gegebenenfalls angewandt würde. Darüber hinaus hat die Kommission weitere Informationen bezüglich Hongkong, Indonesien und die Ukraine erhalten. Der Anhang der Verordnung (EG) Nr. 1418/2007 der Kommission [2] sollte daher entsprechend geändert werden —

HAS ADOPTED THIS REGULATION:

HAT FOLGENDE VERORDNUNG ERLASSEN:

Article 1

Artikel 1

Article 1a of Regulation (EC) No 1418/2007 is replaced by the following:

The replies received following a written request by the Commission in accordance with the first subparagraph of Article 37 (1) of Regulation (EC) No 1013/2006 are listed in the Annex.

Die auf ein schriftliches Ersuchen der Kommission gemäß Artikel 37 Absatz 1 der Verordnung (EG) Nr. 1013/2006 eingegangenen Antworten sind im Anhang aufgeführt.

Where it is indicated in the Annex that a country, with regard to certain shipments of waste, does not prohibit them or apply the procedure of prior written notification and consent as described in Article 35 of that Regulation, Article 18 of that Regulation shall apply mutatis mutandis to such shipments."

Gilt nach dem Anhang, dass ein Staat für die Verbringung bestimmter Abfälle weder ein Verbot verhängt noch ein Verfahren der vorherigen Notifizierung und Zustimmung gemäß Artikel 35 der genannten Verordnung anwendet, so findet für solche Verbringungen Artikel 18 der genannten Verordnung sinngemäß Anwendung."

The Annex to Regulation (EC) No 1418/2007 is amended in accordance with the Annex to this Regulation.

Der Anhang der Verordnung (EG) Nr. 1418/2007 wird gemäß dem Anhang dieser Verordnung geändert.

Article 3

Artikel 3

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Diese Verordnung tritt am zwanzigsten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Union in Kraft.

It shall apply from the date of entry into force.

Sie gilt ab dem Datum des Inkrafttretens.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.
