Having regard to the Treaty establishing the European Community,

Having regard to Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed [1], and in particular Articles 7(3) and 19(3) thereof,

Whereas:

in Erwägung nachstehender Gründe:

(1) On 31 October 2006, Monsanto Europe S.A. submitted to the competent authority of the Netherlands an application, in accordance with Articles 5 and 17 of Regulation (EC) No 1829/2003, for the placing on the market of foods, food ingredients, and feed containing, consisting of, or produced from MON89788 soybean (the application).

(1) Am 31. Oktober 2006 stellte das Unternehmen Monsanto Europe S.A. bei der zuständigen Behörde der Niederlande gemäß den Artikeln 5 und 17 der Verordnung (EG) Nr. 1829/2003 einen Antrag (im Folgenden "Antrag") auf das Inverkehrbringen von Lebensmitteln, Lebensmittelzutaten und Futtermitteln, die Sojabohnen der Sorte MON89788 enthalten, aus ihnen bestehen oder aus ihnen gewonnen werden.

(2) The application also covers the placing on the market of other products containing or consisting of MON89788 soybean for the same uses as any other soybean with the exception of cultivation. Therefore, in accordance with Articles 5(5) and 17(5) of Regulation (EC) No 1829/2003, it includes the data and information required by Annexes III and IV to Directive 2001/18/EC of the European Parliament and of the Council of 12 March 2001 on the deliberate release into the environment of genetically modified organisms and repealing Council Directive 90/220/EEC [2] and information and conclusions about the risk assessment carried out in accordance with the principles set out in Annex II to Directive 2001/18/EC.

(2) Der Antrag betrifft außerdem das Inverkehrbringen anderer Erzeugnisse, die Sojabohnen der Sorte MON89788 enthalten oder aus ihnen bestehen, zu den gleichen Verwendungszwecken wie bei jeder anderen Sojabohnensorte außer zum Anbau. Daher enthält der Antrag gemäß Artikel 5 Absatz 5 und Artikel 17 Absatz 5 der Verordnung (EG) Nr. 1829/2003 die Daten und Angaben, die gemäß den Anhängen III und IV der Richtlinie 2001/18/EG des Europäischen Parlaments und des Rates vom 12. März 2001 über die absichtliche Freisetzung genetisch veränderter Organismen in die Umwelt und zur Aufhebung der Richtlinie 90/220/EWG des Rates [2] erforderlich sind, sowie Informationen und Schlussfolgerungen zu der nach den Grundsätzen in Anhang II der Richtlinie 2001/18/EG durchgeführten Risikobewertung.

(3) On 11 July 2008, the European Food Safety Authority (EFSA) gave a favourable opinion in accordance with Articles 6 and 18 of Regulation (EC) No 1829/2003 and concluded that it is unlikely that the placing on the market of the products containing, consisting of, or produced from MON89788 soybean as described in the application (the products) will have any adverse effects on human or animal health or the environment in the context of their intended uses [3]. In its opinion, EFSA considered all the specific questions and concerns raised by the Member States in the context of the consultation of the national competent authorities as provided for by Articles 6(4) and 18(4) of that Regulation.

(3) Am 11. Juli 2008 gab die Europäische Behörde für Lebensmittelsicherheit (EFSA) gemäß den Artikeln 6 und 18 der Verordnung (EG) Nr. 1829/2003 eine befürwortende Stellungnahme ab und kam zu dem Schluss, es sei unwahrscheinlich, dass das Inverkehrbringen der im Antrag beschriebenen Erzeugnisse, die Sojabohnen der Sorte MON89788 enthalten, aus ihnen bestehen oder aus ihnen gewonnen werden (im Folgenden "Erzeugnisse"), im Rahmen der vorgesehenen Verwendungszwecke schädliche Auswirkungen auf die Gesundheit von Mensch oder Tier oder auf die Umwelt habe [3]. In ihrer Stellungnahme hat die EFSA alle spezifischen Fragen und Bedenken der Mitgliedstaaten berücksichtigt, die im Rahmen der Konsultation der zuständigen nationalen Behörden gemäß Artikel 6 Absatz 4 und Artikel 18 Absatz 4 der genannten Verordnung vorgebracht wurden.

(4) In its opinion, EFSA also concluded that the environmental monitoring plan, consisting of a general surveillance plan, submitted by the applicant is in line with the intended use of the products.

(4) Die EFSA kam in ihrer Stellungnahme ferner zu dem Schluss, dass der Umweltüberwachungsplan, der aus einem allgemeinen, vom Antragsteller vorgelegten Überwachungsplan besteht, der vorgesehenen Verwendung der Erzeugnisse entspricht.

(5) Taking into account those considerations, authorisation should be granted for the products.

(5) In Anbetracht dieser Erwägungen sollten die Erzeugnisse zugelassen werden.

(6) A unique identifier should be assigned to each GMO as provided for in Commission Regulation (EC) No 65/2004 of 14 January 2004 establishing a system for the development and assignment of unique identifiers for genetically modified organisms [4].

(6) Jedem genetisch veränderten Organismus (GVO) sollte gemäß der Verordnung (EG) Nr. 65/2004 der Kommission vom 14. Januar 2004 über ein System für die Entwicklung und Zuweisung spezifischer Erkennungsmarker für genetisch veränderte Organismen [4] ein spezifischer Erkennungsmarker zugewiesen werden.

(7) On the basis of the EFSA opinion, no specific labelling requirements other than those provided for in Articles 13(1) and 25(2) of Regulation (EC) No 1829/2003, appear to be necessary for foods, food ingredients and feed containing, consisting of, or produced from MON89788 soybean. However, in order to ensure the use of the products within the limits of the authorisation provided for by this Decision, the labelling of feed containing or consisting of the GMO and products other than food and feed containing or consisting of the GMO for which authorisation is requested should be complemented by a clear indication that the products in question must not be used for cultivation.

(7) Nach der Stellungnahme der EFSA scheinen keine über die in Artikel 13 Absatz 1 und Artikel 25 Absatz 2 der Verordnung (EG) Nr. 1829/2003 hinausgehenden spezifischen Kennzeichnungsanforderungen an Lebensmittel, Lebensmittelzutaten und Futtermittel, die Sojabohnen der Sorte MON89788 enthalten, aus ihnen bestehen oder aus ihnen gewonnen werden, erforderlich zu sein. Um jedoch sicherzustellen, dass die Erzeugnisse nur im Rahmen der mit dieser Entscheidung erteilten Zulassung verwendet werden, sollte die Kennzeichnung von Futtermitteln sowie von anderen Erzeugnissen als Lebensmittel und Futtermittel, die den GVO enthalten oder aus diesem bestehen und für die die Zulassung beantragt wird, auch einen klaren Hinweis darauf enthalten, dass die betreffenden Erzeugnisse nicht zum Anbau verwendet werden dürfen.

(8) Similarly, the EFSA opinion does not justify the imposition of specific conditions or restrictions for the placing on the market and/or specific conditions or restrictions for the use and handling, including post-market monitoring requirements, or of specific conditions for the protection of particular ecosystems/environment and/or geographical areas, as provided for in point (e) of Articles 6(5) and 18(5) of Regulation (EC) No 1829/2003.

(8) Laut der Stellungnahme der EFSA sind außerdem keine spezifischen Bedingungen oder Einschränkungen für das Inverkehrbringen und/oder die Verwendung und Handhabung, einschließlich Bestimmungen für die marktbegleitende Beobachtung, sowie keine spezifischen Bedingungen zum Schutz besonderer Ökosysteme/der Umwelt und/oder geografischer Gebiete gemäß Artikel 6 Absatz 5 Buchstabe e und Artikel 18 Absatz 5 Buchstabe e der Verordnung (EG) Nr. 1829/2003 gerechtfertigt.

(9) All relevant information on the authorisation of the products should be entered in the Community register of genetically modified food and feed, as provided for in Regulation (EC) No 1829/2003.

(9) Alle relevanten Informationen über die Zulassung der Erzeugnisse sollten gemäß der Verordnung (EG) Nr. 1829/2003 in das Gemeinschaftsregister genetisch veränderter Lebensmittel und Futtermittel aufgenommen werden.

(10) Article 4(6) of Regulation (EC) No 1830/2003 of the European Parliament and of the Council of 22 September 2003 concerning the traceability and labelling of genetically modified organisms and the traceability of food and feed products produced from genetically modified organisms and amending Directive 2001/18/EC [5], lays down labelling requirements for products consisting of, or containing GMOs.

(10) Artikel 4 Absatz 6 der Verordnung (EG) Nr. 1830/2003 des Europäischen Parlaments und des Rates vom 22. September 2003 über die Rückverfolgbarkeit und Kennzeichnung von genetisch veränderten Organismen und über die Rückverfolgbarkeit von aus genetisch veränderten Organismen hergestellten Lebensmitteln und Futtermitteln sowie zur Änderung der Richtlinie 2001/18/EG [5] legt die Anforderungen an die Kennzeichnung von Erzeugnissen fest, die aus GVO bestehen oder GVO enthalten.

(11) This Decision is to be notified through the Biosafety Clearing-House to the Parties to the Cartagena Protocol on Biosafety to the Convention on Biological Diversity, pursuant to Articles 9(1) and 15(2)(c) of Regulation (EC) No 1946/2003 of the European Parliament and of the Council of 15 July 2003 on transboundary movements of genetically modified organisms [6].

(11) Diese Entscheidung ist gemäß Artikel 9 Absatz 1 und Artikel 15 Absatz 2 Buchstabe c der Verordnung (EG) Nr. 1946/2003 des Europäischen Parlaments und des Rates vom 15. Juli 2003 über grenzüberschreitende Verbringungen genetisch veränderter Organismen [6] über die Informationsstelle für biologische Sicherheit den Vertragsparteien des Protokolls von Cartagena über die biologische Sicherheit zum Übereinkommen über die biologische Vielfalt zu melden.

(12) The applicant has been consulted on the measures provided for in this Decision.

(13) The Standing Committee on the Food Chain and Animal Health has not delivered an opinion within the time limit laid down by its Chairman.

(14) At its meeting on 19 November 2008, the Council was unable to reach a decision by qualified majority either for or against the proposal. The Council indicated that its proceedings on this file were concluded. It is accordingly for the Commission to adopt the measures,

HAS ADOPTED THIS DECISION:

Article 1

Genetically modified organism and unique identifier

Genetically modified soybean (Glycine max) MON89788, as specified in point (b) of the Annex to this Decision, is assigned the unique identifier MON-89788-1, as provided for in Regulation (EC) No 65/2004.

Der im Anhang dieser Entscheidung unter Buchstabe b bezeichneten genetisch veränderten Sojabohnensorte (Glycine max) MON89788 wird gemäß der Verordnung (EG) Nr. 65/2004 der spezifische Erkennungsmarker MON-89788-1 zugewiesen.

The following products are authorised for the purposes of Articles 4(2) and 16(2) of Regulation (EC) No 1829/2003 in accordance with the conditions set out in this Decision:

1. For the purposes of the labelling requirements laid down in Articles 13(1) and 25(2) of Regulation (EC) No 1829/2003 and in Article 4(6) of Regulation (EC) No 1830/2003, the "name of the organism" shall be "soybean".

2. The words "not for cultivation" shall appear on the label of and in documents accompanying products containing or consisting of MON-89788-1 soybean referred to in Article 2(b) and (c).

1. The authorisation holder shall ensure that the monitoring plan for environmental effects, as set out in point (h) of the Annex, is put in place and implemented.

2. The authorisation holder shall submit to the Commission annual reports on the implementation and the results of the activities set out in the monitoring plan.

The genetically modified MON-89788-1 soybean, as described in the application, expresses the CP4 EPSPS protein which confers tolerance to the glyphosate herbicide.
