Commission Directive 2004/98/EC of 30 September 2004 amending Council Directive 76/769/EEC as regards restrictions on the marketing and use of pentabromodiphenyl ether in aircraft emergency evacuation systems for the purpose of adapting its Annex I to technical progress (Text with EEA relevance)

Richtlinie 2004/98/EG der Kommission vom 30. September 2004 zur Änderung der Richtlinie 76/769/EWG des Rates hinsichtlich der Beschränkungen des Inverkehrbringens und der Verwendung von Pentabromdiphenylether in Notevakuierungssystemen von Flugzeugen zwecks Anpassung ihres Anhangs I an den technischen Fortschritt (Text von Bedeutung für den EWR)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

DIE KOMMISSION DER EUROPÄISCHEN GEMEINSCHAFTEN -

Having regard to the Treaty establishing the European Community, and

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft,

Having regard to Council Directive 76/769/EEC of 27 July 1976 on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of dangerous substances and preparations(1), and in particular Article 2a thereof,

gestützt auf die Richtlinie 76/769/EWG des Rates vom 27. Juli 1976 zur Angleichung der Rechts- und Verwaltungsvorschriften der Mitgliedstaaten für Beschränkungen des Inverkehrbringens und der Verwendung gewisser gefährlicher Stoffe und Zubereitungen(1), insbesondere auf Artikel 2 Buchstabe a),

Whereas:

in Erwägung nachstehender Gründe:

(1) Pentabromodiphenyl ether (pentaBDE) is used as a brominated flame retardant in order to protect plastics, fabrics and other articles against fire.

(1) Pentabromdiphenylether (PBDE) wird als bromiertes Flammschutzmittel verwendet und soll Kunststoffe, Gewebe und andere Materialien vor Brand schützen.

(2) On the basis of a risk assessment pursuant to Council Regulation (EEC) No 793/93 of 23 March 1993 on the evaluation and control of the risks of existing substances(2) it was considered necessary to restrict the placing on the market and use of pentaBDE, and the substance was therefore added to Annex I to Directive 76/769/EEC.

(2) Nach einer gemäß Verordnung (EWG) Nr. 793/93 des Rates vom 23. März 1993 zur Bewertung und Kontrolle der Umweltrisiken chemischer Altstoffe(2) durchgeführten Risikobewertung wurde es für notwendig erachtet, das Inverkehrbringen und die Verwendung von PBDE einzuschränken. Der Stoff wurde deshalb in Anhang I der Richtlinie 76/769/EWG aufgenommen.

(3) Recently, new information has become available showing that pentaBDE is used in specific fabrics for aircraft evacuation slides and slide-rafts and cannot be replaced by suitable alternatives due to the extensive safety testing and regulatory requirements.

(3) Vor kurzem wurde bekannt, dass bestimmte in Notrutschen von Flugzeugen verwendete Gewebe mit PBDE behandelt werden und dass keine Alternativstoffe zur Verfügung stehen, weil sie einer Vielzahl von Vorschriften entsprechen und umfangreichen Sicherheitsprüfungen unterzogen werden müssten.

(4) Emissions from such slides into the environment and exposure of humans cannot be expected, except in emergency cases for a few seconds, and only in the rare event that the material is burning.

(4) Schadstoffemissionen von solchen Notrutschen und die Exposition von Menschen sind nur in Notfällen während einiger Sekunden zu erwarten und dann auch nur, wenn das Material brennt.

(5) Considering the limited application of pentaBDE in aircraft emergency evacuation systems and the negligible contribution to the overall risks posed by that article to health and the environment, it is justified to permit pentaBDE to be placed on the market and used for that specific purpose.

(5) Da PBDE in Notevakuierungssystemen von Flugzeugen nur in geringem Umfang verwendet wird und die von ihm ausgehenden Risiken für Gesundheit und Umwelt zu vernachlässigen sind, erscheint es gerechtfertigt, das Inverkehrbringen und die Verwendung von PBDE für diesen besonderen Zweck zuzulassen.

(6) Given the complexity of the substitution process and the authorisation regulations for aircraft emergency systems, and the serious socio-economic implications, a time limited derogation is justified for articles essential for evacuation situations. Permitting the use of pentaBDE in aircraft emergency evacuation systems would maintain aircraft safety by preventing the use of older emergency systems.

(6) In Anbetracht der Komplexität des Substitutionsverfahrens und der Zulassungsvorschriften für Flugzeug-Notfallsysteme sowie der erheblichen sozioökonomischen Auswirkungen erscheint eine befristete Ausnahmeregelung für zu ihrer Herstellung notwendige Erzeugnisse gerechtfertigt. Wird die Verwendung von PBDE in Notevakuierungssystemen von Flugzeugen zugelassen, bleibt die Sicherheit an Bord auf ihrem derzeitigen Niveau, weil dann nicht auf Systeme älterer Bauart zurückgegriffen werden muss.

(7) Directive 76/769/EEC should therefore be amended accordingly.

(7) Die Richtlinie 76/769/EWG sollte deshalb entsprechend geändert werden.

(8) This Directive should apply without prejudice to Community legislation laying down minimum requirements for the protection of workers, in particular Council Directive 89/391/EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work(3), and Directive 2004/37/EC of the European Parliament and of the Council of 29 April 2004 on the protection of workers from the risks related to exposure to carcinogens or mutagens at work (Sixth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC)(4).

(8) Diese Richtlinie gilt unbeschadet gemeinschaftlicher Rechtsvorschriften, die Mindestanforderungen für den Schutz von Arbeitnehmern vorschreiben, insbesondere der Richtlinie 89/391/EWG des Rates vom 12. Juni 1989 über die Durchführung von Maßnahmen zur Verbesserung der Sicherheit und des Gesundheitsschutzes der Arbeitnehmer bei der Arbeit(3) und der Richtlinie 2004/37/EG des Europäischen Parlaments und des Rates vom 29. April 2004 über den Schutz der Arbeitnehmer gegen Gefährdung durch Karzinogene oder Mutagene bei der Arbeit(4) (Sechste Einzelrichtlinie im Sinne von Artikel 16 Absatz 1 der Richtlinie 89/391/EWG).

(9) The measures provided for in this Directive are in accordance with the opinion of the Committee for the adaptation to technical progress of the Directives on the removal of technical barriers to trade in dangerous substances and preparations,

HAS ADOPTED THIS DIRECTIVE:

HAT FOLGENDE RICHTLINIE ERLASSEN:

Article 1

Artikel 1

Annex I to Directive 76/769/EEC is amended in accordance with the Annex to this Directive.

Anhang I der Richtlinie 76/769/EWG wird entsprechend dem Anhang der vorliegenden Richtlinie geändert.

Article 2

Artikel 2

1. Member States shall adopt and publish, by 1 January 2005 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

(1) Die Mitgliedstaaten erlassen und veröffentlichen bis spätestens 1. Januar 2005 die erforderlichen Rechts- und Verwaltungsvorschriften, um dieser Richtlinie nachzukommen. Sie teilen der Kommission unverzüglich den Wortlaut dieser Rechtsvorschriften mit und fügen eine Entsprechungstabelle dieser Rechtsvorschriften und dieser Richtlinie bei.

They shall apply those provisions from 1 January 2005 at the latest.

Sie wenden diese Vorschriften spätestens ab 1. Januar 2005 an.

When Member States adopt those provisions, these shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Bei dem Erlass dieser Vorschriften nehmen die Mitgliedstaaten in den Vorschriften selbst oder durch einen Hinweis bei der amtlichen Veröffentlichung auf diese Richtlinie Bezug. Die Mitgliedstaaten regeln die Einzelheiten der Bezugnahme.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

(2) Die Mitgliedstaaten teilen der Kommission den Wortlaut der wichtigsten innerstaatlichen Rechtsvorschriften mit, die sie auf dem unter diese Richtlinie fallenden Gebiet erlassen.

Article 3

This Directive shall enter into force on the day of its publication in the Official Journal of the European Union .

Diese Richtlinie tritt am Tage ihrer Veröffentlichung im Amtsblatt der Europäischen Union in Kraft.

This Directive is addressed to the Member States.

Diese Richtlinie ist an alle Mitgliedstaaten gerichtet.

Annex I to Directive 76/769/EEC, is amended as follows:

Anhang I der Richtlinie 76/769/EWG wird wie folgt geändert:

In the second column of point 44, entitled diphenylether, pentabromo derivative C12 H5 Br5 O, a new paragraph 3 is added:

Unter Ziffer 44, zweite Spalte, Diphenylether-Pentabromderivat C12 H5 Br5 O, wird folgende Nummer 3 eingefügt:

«3. By way of derogation, until 31 March 2006 paragraphs 1 and 2 shall not apply to aircraft emergency evacuation systems.»

«3. Abweichend hiervon gelten die Nummern 1 und 2 bis 31. März 2006 nicht für Notevakuierungssysteme von Flugzeugen.»
