Having regard to the Treaty establishing the European Community,

Having regard to Council Directive 89/398/EEC of 3 May 1989 on the approximation of the laws of the Member States relating to foodstuffs intended for particular nutritional uses (1), and in particular Article 4 thereof,

Whereas the Community measures envisaged by this Directive do not exceed what is necessary for the attainment of the objectives already provided for by Directive 89/398/EEC;

in Erwägung nachstehender Gründe:

Whereas the products covered by this Directive are varied and are generally distinguished as those intended to replace the whole of the daily diet and those intended to replace part of the daily diet;

Die in der vorliegenden Richtlinie vorgesehenen Gemeinschaftsmaßnahmen gehen nicht über das zur Erreichung der in der Richtlinie 89/398/EWG genannten Zielsetzungen erforderliche Maß hinaus.

Whereas the composition of such products should be such as to fulfil the daily nutritional requirements for essential nutrients, such as to provide a significant part of those requirements, as the case may be, of the persons for whom they are intended;

Die Lebensmittel für kalorienarme Ernährung zur Gewichtsverringerung sind vielfältig und werden gewöhnlich als Erzeugnisse definiert, die eine Tagesration ganz oder teilweise ersetzen sollen.

Whereas a number of products have been recently developed to be used as a replacement for snacks and to supply certain quantities of selected essential macronutrients and micronutrients; whereas the essential composition of those products will be adopted at a later date;

Diese Erzeugnisse sollten so zusammengesetzt sein, daß sie den täglichen Bedarf an essentiellen Nährstoffen der Personen, für die sie bestimmt sind, oder einen wesentlichen Teil hiervon decken.

Whereas, in addition, the energy provided by the products covered by this Directive must be restricted;

In letzter Zeit sind eine Anzahl Erzeugnisse entwickelt worden, die Imbisse ersetzen und dem Körper bestimmte Mengen essentieller Makro- und Mikronährstoffe zuführen sollen. Die grundlegende Zusammensetzung dieser Erzeugnisse wird später festgelegt.

Whereas the energy content of some products intended to replace the whole of the daily diet is very low; whereas specific rules for these very low energy products will be adopted at a later date;

Whereas this Directive reflects current knowledge about these products; whereas any modification to allow innovation based on scientific and technical progress will be decided by the procedure laid down in Article 13 of Directive 89/398/EEC;

Der Brennwert einiger Erzeugnisse, die eine gesamte Tagesration ersetzen sollen, ist sehr niedrig; für sie werden zu einem späteren Zeitpunkt besondere Vorschriften erlassen.

Whereas pursuant to Article 4 (2) of Directive 89/398/EEC, the provisions relating to the substances with specific nutritional purposes to be used in the manufacture of the products should be laid down in a separate Commission Directive;

Die vorliegende Richtlinie entspricht dem derzeitigen Stand der Kenntnisse über diese Produkte. Etwaige Änderungen zur Berücksichtigung des wissenschaftlichen und technischen Fortschritts werden nach dem Verfahren gemäß Artikel 13 der Richtlinie 89/398/EWG beschlossen.

Whereas the provisions relating to the use of additives in the manufacture of the products should be laid down in the relevant Council Directives;

Es ist zweckmäßig, für Stoffe mit besonderen Ernährungsfunktionen, die bei der Herstellung dieser Erzeugnisse verwendet werden, gemäß Artikel 4 Absatz 2 der Richtlinie 89/398/EWG in einer getrennten Richtlinie der Kommission Vorschriften zu erlassen.

Whereas pursuant to Article 7 of Directive 89/398/EEC, the products covered by this Directive are subject to the general rules laid down by Council Directive 79/112/EEC of 18 December 1978 on the approximation of the laws of the Member States relating to the labelling, presentation and advertising of foodstuffs (2), as last amended by Commission Directive 93/102/EC (3); whereas this Directive adopts and expands upon the additions and exceptions to those general rules, where it is appropriate;

Es empfiehlt sich, die Verwendung von Zusatzstoffen bei der Herstellung der Erzeugnisse in den einschlägigen Richtlinien des Rates zu regeln.

Whereas, in particular, the nature and destination of the products covered by this Directive require nutritional labelling for the energy value and principal nutrients they contain;

Gemäß Artikel 7 der Richtlinie 89/398/EWG gelten für die unter diese Richtlinie fallenden Erzeugnisse die allgemeinen Vorschriften der Richtlinie 79/112/EWG des Rates vom 18. Dezember 1978 zur Angleichung der Rechtsvorschriften der Mitgliedstaaten über die Etikettierung und Aufmachung von Lebensmitteln sowie die Werbung hierfür (2), zuletzt geändert durch die Richtlinie 93/102/EG der Kommission (3). Diese Richtlinie übernimmt und erweitert gegebenenfalls die Ergänzungen und Ausnahmen zu diesen allgemeinen Vorschriften.

Whereas the Scientific Committee for Food, in accordance with Article 4 of Directive 89/398/EEC, has been consulted on the provisions liable to affect public health;

Es erscheint angezeigt, den Brennwert und die wichtigsten in den von dieser Richtlinie erfaßten Erzeugnissen enthaltenen Nährstoffe je nach Art und Bestimmung der Erzeugnisse anzugeben.

Whereas the measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Foodstuffs,

Gemäß Artikel 4 der Richtlinie 89/398/EWG wurde der Wissenschaftliche Lebensmittelausschuß zu den Bestimmungen gehört, die Auswirkungen auf die Volksgesundheit haben können.

HAS ADOPTED THIS DIRECTIVE:

Die in dieser Richtlinie vorgesehenen Maßnahmen entsprechen der Stellungnahme des Ständigen Lebensmittelausschusses -

HAT FOLGENDE RICHTLINIE ERLASSEN:

Article 1

1. This Directive is a 'specific Directive` within the meaning of Article 4 of Directive 89/398/EEC and lays down compositional and labelling requirements for foods for particular nutritional uses intended for use in energy restricted diets for weight reduction and presented as such.

Artikel 1

2. Foods for use in energy-restricted diets for weight reduction are specially formulated foods which, when used as instructed by the manufacturer, replace the whole or part of the total daily diet. They are divided in two categories:

(1) Diese Richtlinie ist eine Einzelrichtlinie im Sinne von Artikel 4 der Richtlinie 89/398/EWG, in der Anforderungen an Zusammensetzung und Kennzeichnung von Lebensmitteln, die für eine besondere kalorienarme Ernährung zur Gewichtsverringerung bestimmt sind und als solche angeboten werden, festgelegt sind.

(a) products presented as a replacement for the whole of the daily diet;

(2) "Lebensmittel für kalorienarme Ernährung zur Gewichtsverringerung" sind Lebensmittel mit einer besonderen Zusammensetzung, die, sofern sie gemäß den Anweisungen des Herstellers verwendet werden, die tägliche Nahrungsmittelration ganz oder teilweise ersetzen. Es sind zwei Kategorien zu unterscheiden:

(b) products presented as a replacement for one or more meals of the daily diet.

a) Erzeugnisse zum Ersatz einer ganzen Tagesration;

b) Erzeugnisse, die als Ersatz einer oder mehrerer Mahlzeiten im Rahmen der Tagesration angeboten werden.

Article 2

Member States shall ensure that the products referred to in Article 1 may be marketed within the Community only if they conform to the rules laid down in this Directive.

Artikel 2

Die Mitgliedstaaten gewährleisten, daß die in Artikel 1 genannten Erzeugnisse in der Gemeinschaft nur dann in Verkehr gebracht werden dürfen, wenn sie den Vorschriften dieser Richtlinie entsprechen.

Article 3

Foods covered by this Directive shall comply with the compositional criteria specified in Annex 1.

Artikel 3

Die Zusammensetzung der von dieser Richtlinie erfaßten Lebensmittel muß den in Anhang I aufgeführten Kriterien entsprechen.

Article 4

All individual components making up the products referred to in point (a) of Article 1 (2), as sold, shall be contained in the same package.

Artikel 4

Sämtliche Bestandteile der in Artikel 1 Absatz 2 Buchstabe a) genannten, zum Verkauf angebotenen Erzeugnisse müssen in einer einzigen Verpackung enthalten sein.

Article 5

1. The name under which the product is sold shall be:

2. The labelling of the products concerned shall bear, in addition to those provided for in Article 3 of Council Directive 79/112/EEC, the following mandatory particulars:

"Mahlzeit für eine gewichtskontrollierende Ernährung".

(a) the available energy value expressed in kJ and kcal, and the content of proteins, carbohydrates and fat, expressed in numerical form, per specified quantity of the product ready for use as proposed for consumption;

(2) Die Etikettierung der obengenannten Erzeugnisse muß neben den in Artikel 3 der Richtlinie 79/112/EWG genannten Einzelheiten folgende Angaben aufweisen:

(b) the average quantity of each mineral and each vitamin for which mandatory requirements are stipulated in paragraph 5 of Annex 1, expressed in numerical form, per specified quantity of the product ready for use as proposed for consumption. In addition, for products mentioned in point (b) of Article 1 (2), information on vitamins and minerals listed in the Table of point 5 of Annex I shall also be expressed as a percentage of the values as defined in the Annex to Council Directive 90/496/EEC (4);

a) Brennwert (in Kilojoule und Kilokalorien) sowie Protein-, Kohlenhydrat- und Fettgehalt in Zahlenwerten je angegebene Menge des gebrauchsfertigen, zum Verbrauch angebotenen Erzeugnisses;

(c) instructions for appropriate preparation, when necessary and a statement as to the importance of following those instructions;

b) die durchschnittliche Menge aller Mineralstoffe und Vitamine, für die in Anhang I Punkt 5 Vorschriften niedergelegt sind, in Zahlenwerten je angegebene Menge des gebrauchsfertigen, zum Verbrauch angebotenen Erzeugnisses. Ferner sind Angaben über die in der Tabelle des Anhangs I Punkt 5 aufgeführten Vitamine und Mineralstoffe bei den in Artikel 1 Absatz 2 Buchstabe b) genannten Erzeugnissen zusätzlich in Prozent der Werte im Anhang der Richtlinie 90/496/EWG des Rates (4) anzugeben;

(d) if a product, when used as instructed by the manufacturer, provides a daily intake of polyols in excess of 20 g per day, there shall be a statement to the effect that the food may have a laxative effect;

c) erforderlichenfalls Anweisungen für die richtige Zubereitung sowie ein Hinweis auf die Bedeutung ihrer Befolgung;

(e) a statement on the importance of maintaining an adequate daily fluid intake;

d) führt ein gemäß den Hinweisen des Herstellers verwendetes Erzeugnis zu einer täglichen Einnahme von mehr als 20 g Polyalkoholen, die Angabe, daß das Erzeugnis laxative Wirkung haben kann;

(f) for products mentioned in point (a) of Article 1 (2):

e) eine Erklärung über die Bedeutung einer ausreichenden täglichen Flüssigkeitsaufnahme;

(i) a statement that the product provides adequate amounts of all essential nutrients for the day;

f) bei Erzeugnissen gemäß Artikel 1 Absatz 2 Buchstabe a):

(ii) a statement that the product should not be used for more than three weeks without medical advice;

i) eine Erklärung, daß das Erzeugnis alle für einen Tag erforderlichen Nährstoffe in angemessener Menge enthält;

(g) for products mentioned in point (b) of Article 1 (2), a statement to the effect that the products are useful for the intended use only as part of an energy-restricted diet and that other foodstuffs should be a necessary part of such diet.

ii) eine Erklärung, daß das Erzeugnis nicht länger als drei Wochen ohne ärztlichen Rat verwendet werden sollte;

3. The labelling, advertising and presentation of the products concerned shall not make any reference to the rate or amount of weight loss which may result from their use or to a reduction in the sense of hunger or an increase in the sense of satiety.

g) bei Erzeugnissen gemäß Artikel 1 Absatz 2 Buchstabe b) eine Erklärung, daß die Erzeugnisse nur im Rahmen einer kalorienarmen Ernährung den angestrebten Zweck erfuellen und andere Lebensmittel Teil dieser Ernährung sein müssen.

(3) Die Etikettierung und die Verpackung der Erzeugnisse sowie die Werbung hierfür dürfen keine Angaben über das Zeitmaß bzw. die Höhe der aufgrund ihrer Verwendung möglichen Gewichtsabnahme oder über eine Verringerung des Hungergefühls bzw. ein verstärktes Sättigungsgefühl enthalten.

Article 6

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 30 September 1997. They shall forthwith inform the Commission thereof.

Those laws, regulations and administrative provisions shall be applied in such a way as to:

Die Mitgliedstaaten erlassen die erforderlichen Rechts- und Verwaltungsvorschriften, um dieser Richtlinie bis spätestens 30. September 1997 nachzukommen. Sie unterrichten die Kommission unverzüglich davon. Die Vorschriften sind derart anzuwenden, daß

- permit trade in products complying with this Directive, by 1 October 1997,

- der Handel mit Erzeugnissen, die dieser Richtlinie entsprechen, ab dem 1. Oktober 1997 möglich ist und

- prohibit trade in products which do not comply with this Directive, with effect from 31 March 1999.

- der Handel mit Erzeugnissen, die dieser Richtlinie nicht entsprechen, ab dem 31. März 1999 untersagt ist.

When Member States adopt these provisions, these shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The procedure for such reference shall be adopted by Member States.

Wenn die Mitgliedstaaten diese Vorschriften erlassen, nehmen sie in diesen Vorschriften selbst oder durch einen Hinweis bei der amtlichen Veröffentlichung auf diese Richtlinie Bezug. Sie regeln die Einzelheiten dieser Bezugnahme.

Article 7

Artikel 7

This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Communities.

Diese Richtlinie tritt am zwanzigsten Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Gemeinschaften in Kraft.

This Directive is addressed to the Member States.

Diese Richtlinie ist an alle Mitgliedstaaten gerichtet.

ESSENTIAL COMPOSITION OF FOODS FOR ENERGY RESTRICTED DIETS

WESENTLICHE BESTANDTEILE VON LEBENSMITTELN FÜR KALORIENARME ERNÄHRUNG

The specifications refer to the products ready for use, marketed as such or reconstituted as instructed by the manufacturer.

Die Angaben beziehen sich auf gebrauchsfertige Erzeugnisse, die als solche vertrieben bzw. nach den Anweisungen des Herstellers gebrauchsfertig gemacht werden.

1. Energy

1. Brennwert

1.1. The energy provided by a product mentioned in Article 1 (2) (a) shall not be less than 3 360 kJ (800 kcal) and shall not exceed 5 040 kJ (1 200 kcal) for the total daily ration.

1.1. Der Brennwert eines Erzeugnisses gemäß Artikel 1 Absatz 2 Buchstabe a) sollte mindestens 3 360 Kilojoule (800 Kilokalorien) und höchstens 5 040 Kilojoule (1 200 Kilokalorien) je Tagesration betragen.

1.2. The energy provided by a product mentioned in Article 1 (2) (b) shall not be less than 840 kJ (200 kcal) and shall not exceed 1 680 kJ (400 kcal) per meal.

1.2. Der Brennwert eines Erzeugnisses gemäß Artikel 1 Absatz 2 Buchstabe b) sollte nicht unter 840 Kilojoule (200 Kilokalorien) und nicht über 1 680 Kilojoule (400 Kilokalorien) je Mahlzeit liegen.

2. Protein

2. Proteine

2.1. The protein contained in products mentioned in Article 1 (2) (a) and (b) shall provide not less than 25 % and not more than 50 % of the total energy of the product. In any case the amount of protein of products mentioned in Article 1 (2) (a) shall not exceed 125 g.

2.1. Der Brennwert der in Artikel 1 Absatz 2 Buchstabe a) und Absatz 2 Buchstabe b) genannten Erzeugnisse soll zu mindestens 25 und höchstens 50 % auf Proteine entfallen. In keinem Fall darf ein Erzeugnis gemäß Artikel 1 Absatz 2 Buchstabe a) mehr als 125 g Proteine enthalten.

2.2. The abovementioned provisions on protein refer to a protein the chemical index of which is equal to that of the FAO/WHO (1985) reference protein given in Annex 2. If the chemical index is lower than 100 % of the reference protein, the minimum protein levels shall be correspondingly increased. In any case the chemical index of the protein shall at least be equal to 80 % of that of the reference protein.

2.2. Die obigen Vorschriften für Proteine beziehen sich auf ein Protein, dessen chemischer Index demjenigen des in Anhang II genannten Referenzproteins der FAO/WHO (1985) entspricht. Liegt der chemische Index unter 100 % des Indexes des Referenzproteins, ist der Mindestproteingehalt entsprechend zu erhöhen. Der chemische Index des Proteins muß in jedem Fall zumindest bei 80 % des Indexes des Referenzproteins liegen.

2.3. The 'chemical index` shall mean the lowest of the ratios between the quantity of each essential amino acid of the test protein in and the quantity of each corresponding amino acid of the reference protein.

2.3. Der "chemische Index" ist das niedrigste Verhältnis zwischen der Menge jeder einzelnen essentiellen Aminosäure des zu prüfenden Proteins und der Menge der jeweils entsprechenden Aminosäure des Referenzproteins.

2.4. In all cases, the addition of amino acids is permitted solely for the purpose of improving the nutritional value of the proteins, and only in the proportions necessary for that purpose.

2.4. In jedem Fall ist der Zusatz von Aminosäuren allein zur Verbesserung des Nährwerts der Proteine und nur in dem dazu erforderlichen Ausmaß gestattet.

3. Fat

3. Fette

3.1. The energy derived from fat shall not exceed 30 % of the total available energy of the product.

3.1. Der Brennwert der Fette darf 30 % des gesamten Brennwertes des Erzeugnisses nicht überschreiten.

3.2. For products mentioned in Article 1 (2) (a), the linoleic acid (in the form of glycerides) shall not be less than 4,5 g.

3.2. Erzeugnisse gemäß Artikel 1 Absatz 2 Buchstabe a) müssen mindestens 4,5 g Linolsäure (in Form von Glyceriden) enthalten.

3.3. For products mentioned in Article 1 (2) (b), the linoleic acid (in the form of glycerides) shall not be less than 1 g.

3.3. Erzeugnisse gemäß Artikel 1 Absatz 2 Buchstabe b) müssen mindestens 1 g Linolsäure (in Form von Glyceriden) enthalten.

4. Dietary fibre

4. Ballaststoffe

The dietary fibre content of products mentioned in Article 1 (2) (a) shall not be less than 10 g and shall not exceed 30 g for the daily ration.

Die Erzeugnisse gemäß Artikel 1 Absatz 2 Buchstabe a) müssen mindestens 10 g und höchstens 30 g Ballaststoffe je Tagesration enthalten.

5. Vitamins and minerals

5.1. The products mentioned in Article 1 (2) (a) shall provide for the whole of the daily diet at least:

100 % of the amounts of vitamins and minerals specified in Table 1.

5.2. The products mentioned in Article 1 (2) (b) shall provide at least 30 % of the amounts of vitamins and minerals specified in the Table per meal; however, the amount of potassium per meal provided by these products shall be at least 500 mg.

5.2. Die in Artikel 1 Absatz 2 Buchstabe b) genannten Erzeugnisse müssen je Mahlzeit mindestens 30 % der in Tabelle aufgeführten Vitamin- und Mineralstoffmengen liefern; dagegen müssen diese Erzeugnisse mindestens 500 mg Kalium je Mahlzeit enthalten.
