COUNCIL DIRECTIVE 94/31/EC of 27 June 1994 amending Directive 91/689/EEC on hazardous waste

RICHTLINIE 94/31/EG DES RATES vom 27. Juni 1994 zur Änderung der Richtlinie 91/689/EWG über gefährliche Abfälle

THE COUNCIL OF THE EUROPEAN UNION,

DER RAT DER EUROPÄISCHEN UNION -

Having regard to the Treaty establishing the European Community, and in particular Article 130s (1) thereof,

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft, insbesondere auf Artikel 130s Absatz 1,

Having regard to the proposal from the Commission (1),

auf Vorschlag der Kommission (1),

Having regard to the opinion of the Economic and Social Committee (2),

nach Stellungnahme des Wirtschafts- und Sozialausschusses (2),

Acting in accordance with the procedure laid down in Article 189 c of the Treaty,

gemäß dem Verfahren des Artikels 189c des Vertrags,

Whereas it has become apparent, through the work of the committee provided for in Article 18 of Council Directive 75/442/EEC (3) that it has not been possible, within the time limits fixed by Directive 91/689/EEC (4), to draw up a binding list of hazardous waste, but whereas the implementation of Directive 91/689/EEC depends on the Commission's establishing such a list;

in Erwägung nachstehender Gründe:

Whereas it is necessary to ensure the implementation of Directive 91/689/EEC within the shortest possible time;

Bei den Arbeiten des Ausschusses gemäß Artikel 18 der Richtlinie 75/442/EWG (3) wurde deutlich, daß es innerhalb der in der Richtlinie 91/689/EWG (4) festgelegten Frist nicht möglich war, eine verbindliche Liste gefährlicher Abfälle zu erstellen, daß aber die Durchführung der Richtlinie 91/689/EWG von der Erstellung einer solchen Liste durch die Kommission abhängt.

Whereas a Community list of hazardous waste must still be established in accordance with Article 1 (4) of Directive 91/689/EEC;

Die Richtlinie 91/689/EWG muß mit möglichst geringer Verzögerung durchgeführt werden.

Whereas the repeal of Council Directive 78/319/EEC of 20 March 1978 on toxic and dangerous waste (5) must therefore be postponed,

Die Erstellung einer Gemeinschaftsliste gefährlicher Abfälle gemäß Artikel 1 Absatz 4 der genannten Richtlinie ist nach wie vor erforderlich.

HAS ADOPTED THIS DIRECTIVE:

Es ist daher notwendig, die Aufhebung der Richtlinie 78/319/EWG des Rates vom 20. März 1978 über giftige und gefährliche Abfälle (5) zu verschieben -

HAT FOLGENDE RICHTLINIE ERLASSEN:

Article 1

Directive 91/689/EEC is hereby amended as follows:

Artikel 1

1. The following shall be substituted for Article 10 (1):

Die Richtlinie 91/689/EWG wird wie folgt geändert:

'Article 10

1. Artikel 10 Absatz 1 erhält folgende Fassung:

1. Member States shall bring into force the laws, regulations and administrative provisions necessary for them to comply with this Directive by 27 June 1995. They shall immediately inform the Commission thereof.'

"(1) Die Mitgliedstaaten erlassen die erforderlichen Rechts- und Verwaltungsvorschriften, um dieser Richtlinie bis zum 27. Juni 1995 nachzukommen. Sie setzen die Kommission unverzueglich davon in Kenntnis."

2. The following shall be substituted for Article 11:

2. Artikel 11 erhält folgende Fassung:

'Annex 11

"Artikel 11

Directive 78/319/EEC shall be repealed with effect from 27 June 1995.'

Die Richtlinie 78/319/EWG wird zum 27. Juni 1995 aufgehoben."

This Directive is addressed to the Member States.

Diese Richtlinie ist an die Mitgliedstaaten gerichtet.
