RICHTLINIE 92/52/EWG DES RATES vom 18. Juni 1992 über Säuglingsanfangsnahrung und Folgenahrung zur Ausfuhr in Drittländer

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

DER RAT DER EUROPÄISCHEN GEMEINSCHAFTEN -

Having regard to the Treaty establishing the European Economic Community, and in particular Article 113 thereof,

gestützt auf den Vertrag zur Gründung der Europäischen Wirtschaftsgemeinschaft, insbesondere auf Artikel 113,

Having regard to the proposal from the Commission (1),

Whereas Community rules concerning infant formulae and follow-on formulae are laid down by Council Directive 89/398/EEC of 3 May 1989 on the approximation of the laws of the Member States relating to foodstuffs for particular nutritional uses (4) in Commission Directive 91/321/EEC (5);

in Erwägung nachstehender Gründe:

Whereas given the nature of the products in question it is desirable that Community rules or international standards relating to their composition are made applicable to such products intended for export to third countries;

Die Gemeinschaftsvorschriften für Säuglingsanfangsnahrung und Folgenahrung sind in der Richtlinie 89/398/EWG des Rates vom 3. Mai 1989 zur Angleichung der Rechtsvorschriften der Mitgliedstaaten über Lebensmittel, die für eine besondere Ernährung bestimmt sind (4), und in der Richtlinie 91/321/EWG (5) der Kommission festgelegt.

Whereas in order to prevent inappropriate use of these products which could prejudice the health of infants it is also desirable to extend the application of the Community rules on labelling of infant formulae and follow-on formuale to those products intended for export to third countries;

Wegen der Art dieser Erzeugnisse sollten die Gemeinschaftsvorschriften oder internationalen Normen über ihre Zusammensetzung auf solche Erzeugnisse angewandt werden, die zur Ausfuhr in Drittländer bestimmt sind.

Whereas the products complying with Directive 91/321/EEC may be marketed in the Community as from 1 December 1992; whereas no legislation prohibits the export of such products to third countries,

Um eine unsachgemässe Verwendung dieser Erzeugnisse, die die Gesundheit von Säuglingen beeinträchtigen könnte, zu vermeiden, sollte die Anwendung der Gemeinschaftsvorschriften für die Kennzeichnung der Säuglingsanfangsnahrung und Folgenahrung auf die zur Ausfuhr nach Drittländern bestimmten Produkte ausgedehnt werden.

HAS ADOPTED THIS DIRECTIVE:

Die der Richtlinie 91/321/EWG entsprechenden Erzeugnisse können in der Gemeinschaft ab 1. Dezember 1992 in Verkehr gebracht werden. Es bestehen keine Rechtsvorschriften, die die Ausfuhr derartiger Erzeugnisse in Drittländer verbieten -

HAT FOLGENDE RICHTLINIE ERLASSEN:

Article 1

Artikel 1

This Directive concerns infant formuale and follow-on formulae, as defined by Article 1 (2) (c) and (d) of Directive 91/321/EEC, intended for export to third countries.

Diese Richtlinie bezieht sich auf Säuglingsanfangsnahrung und Folgenahrung im Sinne des Artikels 1 Absatz 2 Buchstaben c) und d) der Richtlinie 91/321/EWG, die zur Ausfuhr nach Drittländern bestimmt sind.

Artikel 2

Article 2

Die Mitgliedstaaten sorgen dafür, daß die in Artikel 1 genannten Erzeugnisse aus der Gemeinschaft nur ausgeführt werden dürfen, wenn sie dieser Richtlinie entsprechen.

Member States shall ensure that the products referred to in Article 1 may be exported from the Community only if they comply with this Directive.

Artikel 3

(1) Kein Erzeugnis ausser Säuglingsanfangsnahrung darf so dargestellt werden, als ob es für sich allein den Ernährungsbedürfnissen normaler, gesunder Säuglinge während der ersten vier bis sechs Lebensmonate genügen könnte.

Article 3

(2) Die in Artikel 1 genannten Erzeugnisse müssen folgendes einhalten:

1. No product other than infant formulae may be represented as suitable for satisfying by itself the nutritional requirements of normal healthy infants during the first four to six months of life.

a) Die Artikel 3, 4, 5 und 6 der Richtlinie 91/321/EWG oder einschlägige im Codex Alimentarius aufgestellte internationale Normen,

2. In addition the products referred to in Article 1 must comply:

b) Artikel 7 Absätze 2 bis 6 der Richtlinie 91/321/EWG,

(a) with Articles 3, 4, 5 and 6 of Directive 91/321/EEC or with relevant applicable world standards established by Codex Alimentarius;

c) die Richtlinie 89/396/EWG des Rates vom 14. Juni 1989 über Angaben oder Marken, mit denen sich das Los, zu dem ein Lebensmittel gehört, feststellen lässt (6),

(b) with Article 7 (2) to (6) of Directive 91/321/EEC;

sofern in dem Einfuhrland nicht etwas anderes beschlossen wurde oder besondere Bestimmungen gelten.

(c) with the provisions of Council Directive 89/396/EEC of 14 June 1989 on indications or marks identifying the lot to which a foodstuff belongs (6),

(3) Die Erzeugnisse müssen in einer geeigneten Sprache so gekennzeichnet sein, daß das Risiko einer Verwechslung zwischen Säuglingsanfangsnahrung und Folgenahrung ausgeschlossen ist.

unless otherwise requested or stipulated by provisions established by the importing country.

(4) Die Vorschriften, Verbote und Beschränkungen nach Artikel 7 Absätze 2 bis 6 der Richtlinie 91/321/EWG gelten auch für die Aufmachung der betreffenden Erzeugnisse, insbesondere für Form, Aussehen der Verpackung und verwendetes Verpackungsmaterial.

3. These products shall be labelled in an appropriate language and in such a way as to avoid any risk of confusion between infant formulae and follow-on formulae.

Artikel 4

4. The stipulations, prohibitions and restrictions laid down in Article 7 (2) to (6) of Directive 91/321/EEC shall also apply to the presentation of the products concerned and in particular their form, aspect or packaging and the packaging materials used.

Die Mitgliedstaaten treffen die erforderlichen Maßnahmen, um dieser Richtlinie nachzukommen. Sie setzen die Kommission unverzueglich davon in Kenntnis. Diese Maßnahmen sind so anzuwenden, daß die Ausfuhr von Erzeugnissen, die dieser Richtlinie nicht entsprechen, ab 1. Juni 1994 verboten ist.

Wenn die Mitgliedstaaten Vorschriften nach Absatz 1 erlassen, nehmen sie in diesen Vorschriften selbst oder durch einen Hinweis bei der amtlichen Veröffentlichung auf diese Richtlinie Bezug. Die Mitgliedstaaten regeln die Einzelheiten dieser Bezugnahme.

Article 4

Artikel 5

Member States shall take the necessary measures to comply with this Directive. They shall forthwith inform the Commission thereof. Those measures shall be applied in such a way as to prohibit exports of products which do not comply with this Directive, with effect from 1 June 1994.

When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The methods of making such a reference shall be laid down by the Member States.
