Article 294(7)(c) of the Treaty on the Functioning of the European Union provides that the Commission is to deliver an opinion on the amendments proposed by the European Parliament at second reading. The Commission sets out its opinion below on the amendments proposed by the Parliament.

Gemäß Artikel 294 Absatz 7 Buchstabe c des Vertrags über die Arbeitsweise der Europäischen Union gibt die Kommission eine Stellungnahme zu den vom Europäischen Parlament in zweiter Lesung vorgeschlagenen Abänderungen ab. Im Folgenden legt die Kommission ihre Stellungnahme zu den vom Parlament vorgeschlagenen Abänderungen dar.

3.           Objective of the proposal from the Commission

3.           Gegenstand des Vorschlags der Kommission

The proposal consolidates and updates two important areas of labelling legislation, the general food and nutrition labelling covered by Directives 2000/13/EC[1] and 90/496/EEC[2] respectively. The proposal recasts also six other Directives concerning the labelling of certain categories of foods. Some of the main objectives of the proposal were:

Mit dem Vorschlag werden zwei wichtige Bereiche des Kennzeichnungsrechts konsolidiert und aktualisiert: die allgemeine Lebensmittelkennzeichnung und die Nährwertkennzeichnung, die bislang in den Richtlinien 2000/13/EG[1] bzw. 90/496/EWG[2] geregelt sind. Außerdem konsolidiert der Vorschlag sechs weitere Richtlinien zur Kennzeichnung bestimmter Lebensmittelkategorien. Der Vorschlag verfolgt u. a. die folgenden Hauptziele:

– The creation of a single instrument for principles and requirements for horizontal labelling requirements regarding general and nutrition labelling;

– Schaffung eines einzigen Instruments zur Festlegung der Grundsätze und Anforderungen für horizontale Vorschriften über die allgemeine Kennzeichnung und die Nährwertkennzeichnung;

– To include specific provisions on the responsibilities along the food chain with respect to the presence and accuracy of food information;

– Festlegung spezifischer Bestimmungen zur Regelung der Verantwortlichkeiten innerhalb der gesamten Lebensmittelkette in Bezug auf das Vorhandensein und die Richtigkeit der Informationen über die Lebensmittel;

– To establish measurable criteria for certain aspect of legibility of food labelling;

– Aufstellung messbarer Kriterien für bestimmte Aspekte der Lesbarkeit der Lebensmittelkennzeichnung;

– To clarify the rules that apply with respect to country of origin or place of provenance labelling;

– Klarstellung der für die Angabe des Ursprungslands bzw. des Herkunftsorts von Lebensmitteln geltenden Regeln;

– To introduce mandatory nutrition labelling in the principal field of vision for the majority of processed foods.

– Einführung einer Pflicht zur Anbringung der Nährwertkennzeichnung im Hauptblickfeld für die meisten verarbeiteten Lebensmittel.

4.           Opinion of the Commission on the amendments by the European Parliament

The European Parliament voted in second reading a consolidated text which contains a number of amendments to the text of the Council Position at first reading. The text is the result of negotiations between the Parliament, the Council and the Commission. The Commission accepts all the amendments voted by the Parliament, which are the result of interinstitutional negotiations which allowed a second reading agreement.

Das Europäische Parlament stimmte in zweiter Lesung über einen konsolidierten Text ab, der eine Reihe von Abänderungen am Wortlaut des Standpunkts des Rates in erster Lesung enthält. Der Text ist das Ergebnis von Verhandlungen zwischen Parlament, Rat und Kommission. Die Kommission akzeptiert sämtliche Abänderungen, die das Europäische Parlament in zweiter Lesung angenommen hat; diese Abänderungen sind das Ergebnis von Verhandlungen zwischen den Organen, die eine Einigung in zweiter Lesung ermöglichten.
