Having regard to the Treaty establishing the European Community,

under henvisning til traktaten om oprettelse af Det Europæiske Fællesskab,

Having regard to Council Regulation (EEC) No 3813/92 of 28 December 1992 on the unit of account and the conversion rates to be applied for the purposes of the common agricultural policy (1), as last amended by Regulation (EC) No 150/95 (2),

under henvisning til Rådets forordning (EØF) nr. 3813/92 af 28. december 1992 om den regningsenhed og de omregningskurser, der skal anvendes i den fælles landbrugspolitik (1), senest ændret ved forordning (EF) nr. 150/95 (2),

Having regard to Commission Regulation (EEC) No 1068/93 of 30 April 1993 on detailed rules for determining and applying the agricultural conversion rates (3), as last amended by Regulation (EC) No 1053/95 (4), and in particular Article 18 (2) thereof,

under henvisning til Kommissionens forordning (EØF) nr. 1068/93 af 30. april 1993 om fastsættelse og anvendelse af omregningskurserne i landbrugssektoren (3), senest ændret ved forordning (EF) nr. 1053/95 (4), særlig artikel 18, stk. 2, og

Whereas with effect from 1 February 1995, Article 13 (2) of Council Regulation (EEC) No 3813/92 alters the value in ecus of certain prices and amounts in order to neutralize the effects of the abolition of the corrective factor of 1,207509 which until 31 January 1995 affected the conversion rates used for agriculture;

ud fra følgende betragtninger:

Whereas the new values in ecus of the prices and amounts concerned have been established as of 1 February 1995 according to the rules laid down in Article 13 (2) of Regulation (EEC) No 3813/92 and Article 18 (1) of Regulation (EEC) No 1068/93;

Med virkning fra 1. februar 1995 blev visse prisers og beløbs størrelse i ecu ved artikel 13, stk. 2, i forordning (EØF) nr. 3813/92 ændret for at neutralisere virkningerne af afskaffelsen af justeringsfaktoren på 1,207509, der indtil den 31. januar 1995 blev anvendt på omregningskurserne i landbruget;

Whereas, in accordance with Article 18 (2) of Regulation (EEC) No 1068/93, in order to avoid confusion and to facilitate the application of the common agricultural policy, the values in ecus of the amounts given in Council Regulation (EEC) No 2078/92 (5), as last amended by the Act of Accession of Austria, Finland and Sweden, which apply at least from:

de nye beløb i ecu blev fastlagt fra den 1. februar 1995 efter reglerne i artikel 13, stk. 2, i forordning (EØF) nr. 3813/92 og artikel 18, stk. 1, i forordning (EØF) nr. 1068/93;

- 1 January 1996 for amounts which are not affected by a marketing year,

for at undgå forvirring og lette gennemførelsen af den fælles landbrugspolitik bør der efter artikel 18, stk. 2, i forordning (EØF) nr. 1068/93 ske en ændring i Rådets forordning (EØF) nr. 2078/92 (5), senest ændret ved akten vedrørende Østrigs, Finlands og Sveriges tiltrædelse, af de pågældende beløb i ecu, der mindst skal anvendes fra:

- the beginning of the 1996 marketing year in the case of amounts for which the marketing year begins in January 1996, and - the beginning of the 1995/96 marketing year in the other cases,

- 1. januar 1996, for så vidt angår beløb, der ikke berøres af et produktionsår

and which are among the legal instruments coming into force before 1 February 1995, should be replaced,

- begyndelsen af produktionsåret 1996, for så vidt angår beløb, for hvilke nævnte produktionsår begynder i januar 1996

HAS ADOPTED THIS REGULATION:

- begyndelsen af produktionsåret 1995/96 i de øvrige tilfælde

og som figurerer i retsakter, der trådte i kraft før den 1. februar 1995 -

UDSTEDT FØLGENDE FORORDNING:

Article 1

As a consequence of the adjustment with effect from 1 February 1995, pursuant to Article 13 (2) of Regulation (EEC) No 3813/92 and to Article 18 (1) of Regulation (EEC) No 1068/93, on the amounts in ecus in Regulation (EEC) No 2078/92, the latter shall be amended as laid down in Article 2 hereof.

Artikel 1

Article 2

Som følge af justeringen af beløbene i ecu i forordning (EØF) nr. 2078/92 fra den 1. februar 1995 efter artikel 13, stk. 2, i forordning (EØF) nr. 3813/92 og artikel 18, stk. 1, i forordning (EØF) nr. 1068/93 ændres den i artikel 2 nævnte retsakt efter angivelserne i samme artikel.

Regulation (EEC) No 2078/92 is amended as follows:

1. in Article 4 (2) the amount 'ECU 150` is replaced by 'ECU 181,1`; the amounts 'ECU 250` are replaced by 'ECU 301,9`; the amount 'ECU 100` is replaced by 'ECU 120,8`; the amount 'ECU 400` is replaced by 'ECU 483,0`; the amount 'ECU 1 000` is replaced by 'ECU 1 208`; the amount 'ECU 700` is replaced by 'ECU 845,3` and the amount 'ECU 600` is replaced by 'ECU 724,5`;

Artikel 2

2. in Article 4 (3) the amount 'ECU 350` is replaced by 'ECU 422,6`;

Forordning (EØF) nr. 2078/92 ændres som følger:

3. in Article 6 (1) the amount 'ECU 2 500` is replaced by 'ECU 3 019`.

1) I artikel 4, stk. 2, ændres beløbet »150 ECU« til beløbet »181,1 ECU« , beløbet »250 ECU« ændres til beløbet »301,9 ECU«, beløbet »100 ECU« ændres til beløbet »120,8 ECU«, beløbet »400 ECU« ændres til beløbet »483,0 ECU«, beløbet »1 000 ECU« ændres til beløbet »1 208 ECU«, beløbet »700 ECU« ændres til beløbet »845,3 ECU« og beløbet »600 ECU« ændres til beløbet »724,5 ECU«.

2) I artikel 4, stk. 3, ændres beløbet »350 ECU« til beløbet »422,6 ECU«.

Article 3

3) I artikel 6, stk. 1, ændres beløbet »2 500 ECU« til beløbet »3 019 ECU«.

This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.

It shall apply, for each amount in question, from the date on which an agricultural conversion rate fixed on or after 1 February 1995 is first applied.

Artikel 3

Denne forordning træder i kraft på syvendedagen efter offentliggørelsen i De Europæiske Fællesskabers Tidende.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Den anvendes for hvert berørt beløb fra datoen for den første anvendelse af en landbrugsomregningskurs, der er fastsat fra den 1. februar 1995.
