Summary


Notwithstanding the fact that a particular shipyard is named in Regulation No 1013/97, by which the Council empowers the Commission to adopt decisions addressed to the governments of particular Member States authorising, subject to certain conditions, the payment of new aid to certain shipyards situated in their respective territories, the regional authority on whose territory that shipyard is located lacks locus standi to contest the regulation.
Selv om et skibsvaerft naevnes ved navn i forordning nr. 1013/97, hvori Raadet bemyndiger Kommissionen til at vedtage beslutninger med visse medlemsstaters regeringer som adressat, og som paa visse betingelser tillader udbetaling af ny stoette til visse skibsvaerfter beliggende paa deres respektive omraader, kan et soegsmaal til anfaegtelse af naevnte forordning anlagt af den regionale myndighed, paa hvis omraade naevnte skibsvaerft er beliggende, ikke admitteres.
The regional authority cannot rely on the second paragraph of Article 173 of the Treaty since it is manifestly clear from the general scheme of the Treaty that the concept of Member State, within the meaning of the provisions relating to remedies, only applies to the government authorities of the Member States of the European Communities and cannot be extended to regional governments or self-governing communities, regardless of the extent of their powers.
En saadan regional myndighed kan nemlig ikke paaberaabe sig traktatens artikel 173, stk. 2, idet det klart fremgaar af den generelle maade, hvorpaa traktaten er opbygget, at begrebet medlemsstat i bestemmelserne vedroerende domstolsproevelse kun omfatter regeringsmyndighederne i De Europaeiske Faellesskabers medlemsstater, og ikke kan antages ogsaa at omfatte regionale regeringer og selvstaendige faellesskabers regeringer, uanset hvilken kompetence de maatte vaere tillagt.
Although such an authority possesses the required legal personality to bring an action under the fourth paragraph of Article 173 of the Treaty, any general interest that it may have, as a third person, in obtaining a result which will favour the economic prosperity of a given business and, as a result, the level of employment in the geographical region where it carries on its activities, is insufficient on its own to enable that authority to be regarded as individually concerned, for the purposes of the fourth paragraph of Article 173 of the Treaty, by the provisions of the contested Regulation.
Saafremt en myndighed af denne art er en juridisk person, der som saadan kan anlaegge sag i henhold til traktatens artikel 173, stk. 4, er den generelle interesse, som tredjemand kan have i at opnaa et resultat, der er fordelagtigt for en given virksomheds oekonomiske trivsel, og dermed for beskaeftigelsesniveauet i det geografiske omraade, hvor denne udoever sin virksomhed, ikke i sig selv tilstraekkelig til, at den kan anses for beroert i traktatens artikel 173, stk. 4's forstand, af den anfaegtede forordnings bestemmelser.
Nor is such an authority directly concerned by the contested Regulation since the simple fact of adopting that measure cannot alone entail the consequences for employment in the region and the socio-economic repercussions which it alleges. The creation of such consequences necessarily supposes, first, the adoption of a decision by the Commission authorising the payment of aid on condition that no ship conversions are undertaken in the shipyard located in the region in question and, secondly, the adoption by that shipyard of autonomous measures connected with that decision, namely making employees redundant.
Den er heller ikke umiddelbart beroert af den anfaegtede forordning, idet dennes vedtagelse ikke i og for sig kan have de foelger for beskaeftigelsesniveauet i regionen og de sociooekonomiske virkninger, som den paaberaaber sig. Saadanne virkningers indtraeden forudsaetter noedvendigvis, at Kommissionen foerst vedtager en beslutning, hvorved stoettens udbetaling tillades, paa betingelse af, at der ikke sker ombygning af skibe paa det skibsvaerft, der er beliggende i den paagaeldende region, og dernaest, at sidstnaevnte virksomhed traeffer foranstaltninger, der er selvstaendige i forhold til naevnte beslutning, nemlig om afskedigelser.
