THE COUNCIL OF THE EUROPEAN COMMUNITIES,

RAADET FOR DE EUROPAEISKE FAELLESSKABER HAR -

Having regard to the Treaty establishing the European Economic Community, and in particular Article 113 thereof,

Having regard to the proposal from the Commission (1),

Having regard to the opinion of the European Parliament (2),

Having regard to the opinion of the Economic and Social Committee (3),

Whereas Community rules concerning infant formulae and follow-on formulae are laid down by Council Directive 89/398/EEC of 3 May 1989 on the approximation of the laws of the Member States relating to foodstuffs for particular nutritional uses (4) in Commission Directive 91/321/EEC (5);

ud fra foelgende betragtninger:

Whereas given the nature of the products in question it is desirable that Community rules or international standards relating to their composition are made applicable to such products intended for export to third countries;

Faellesskabets regler for modermaelkserstatninger og tilskudsblandinger til spaedboern og smaaboern er fastsat i Raadets direktiv 89/398/EOEF af 3. maj 1989 om indbyrdes tilnaermelse af medlemsstaternes lovgivning om levnedsmidler bestemt til saerlig ernaering (4) og i Kommissionens direktiv 91/321/EOEF (5);

Whereas in order to prevent inappropriate use of these products which could prejudice the health of infants it is also desirable to extend the application of the Community rules on labelling of infant formulae and follow-on formuale to those products intended for export to third countries;

da disse produkter er af en saerlig art, boer de ogsaa vaere omfattet af faellesskabsregler eller internationale standarder for sammensaetning, naar de skal eksporteres til tredjelande;

Whereas the products complying with Directive 91/321/EEC may be marketed in the Community as from 1 December 1992; whereas no legislation prohibits the export of such products to third countries,

for at forhindre at disse produkter bruges forkert og bringer smaaboerns sundhed i fare, boer Faellesskabets regler for maerkning af modermaelkserstatninger og tilskudsblandinger til spaedboern og smaaboern desuden udvides til at omfatte produkter, der skal eksporteres til tredjelande;

HAS ADOPTED THIS DIRECTIVE:

produkter, der er i overensstemmelse med direktiv 91/321/EOEF vil kunne afsaettes i Faellesskabet fra den 1. december 1992; ingen lovgivning forbyder eksport af saadanne produkter til tredjelande -

UDSTEDT FOELGENDE DIREKTIV:

Article 1

Artikel 1

This Directive concerns infant formuale and follow-on formulae, as defined by Article 1 (2) (c) and (d) of Directive 91/321/EEC, intended for export to third countries.

Dette direktiv gaelder for modermaelkserstatninger og tilskudsblandinger, som svarer til definitionen i artikel 1, stk. 2, litra c) og d), i direktiv 91/321/EOEF, og som er bestemt til udfoersel til tredjelande.

Artikel 2

Article 2

Medlemsstaterne sikrer, at de i artikel 1 naevnte produkter kun kan udfoeres fra Faellesskabet, hvis de er i overensstemmelse med dette direktiv.

Member States shall ensure that the products referred to in Article 1 may be exported from the Community only if they comply with this Directive.

Artikel 3

1. Kun modermaelkserstatninger maa praesenteres som vaerende i stand til i sig selv at kunne daekke normale, sunde spaedboerns ernaeringsmaessige behov i de foerste 4-6 levemaaneder.

2. De i artikel 1 naevnte produkter skal desuden vaere i overensstemmelse med

1. No product other than infant formulae may be represented as suitable for satisfying by itself the nutritional requirements of normal healthy infants during the first four to six months of life.

a) artikel 3, 4, 5 og 6 i direktiv 91/321/EOEF eller med de internationale standarder, som er blevet udarbejdet af Kodeks Alimentarius

2. In addition the products referred to in Article 1 must comply:

b) artikel 7, stk. 2 til 6, i direktiv 91/321/EOEF

(a) with Articles 3, 4, 5 and 6 of Directive 91/321/EEC or with relevant applicable world standards established by Codex Alimentarius;

c) Raadets direktiv 89/396/EOEF af 14. juni 1989 om angivelsen af eller maerker til identifikation af et bestemt levnedsmiddelparti (6)

(b) with Article 7 (2) to (6) of Directive 91/321/EEC;

medmindre importlandet eller dets bestemmelser forlanger andet.

(c) with the provisions of Council Directive 89/396/EEC of 14 June 1989 on indications or marks identifying the lot to which a foodstuff belongs (6),

3. Produkterne skal maerkes paa et egnet sprog, saa enhver risiko for at forvekle modermaelkserstatninger med tilskudsblandinger undgaas.

unless otherwise requested or stipulated by provisions established by the importing country.

4. De i artikel 7, stk. 2 til 6, i direktiv 91/321/EOEF fastsatte krav, forbud og begraensninger gaelder ligeledes for praesentationen af de omhandlede produkter, saerligt deres form, udseende og emballage og det anvendte emballagemateriale.

3. These products shall be labelled in an appropriate language and in such a way as to avoid any risk of confusion between infant formulae and follow-on formulae.

Artikel 4

4. The stipulations, prohibitions and restrictions laid down in Article 7 (2) to (6) of Directive 91/321/EEC shall also apply to the presentation of the products concerned and in particular their form, aspect or packaging and the packaging materials used.

Medlemsstaterne traeffer de noedvendige foranstaltninger for at efterkomme dette direktiv. De underretter straks Kommissionen herom. Foranstaltningerne anvendes saaledes, at eksport af produkter, som ikke opfylder dette direktivs bestemmelser, forbydes fra den 1. juni 1994.

Naar medlemsstaterne vedtager disse foranstaltninger, skal de indeholde en henvisning til dette direktiv, eller de skal ved offentliggoerelsen ledsages af en saadan henvisning. De naermere regler for denne henvisning fastsaettes af medlemsstaterne.

Article 4

Artikel 5

Member States shall take the necessary measures to comply with this Directive. They shall forthwith inform the Commission thereof. Those measures shall be applied in such a way as to prohibit exports of products which do not comply with this Directive, with effect from 1 June 1994.

When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The methods of making such a reference shall be laid down by the Member States.
