THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

s ohledem na Smlouvu o založení Evropského společenství,

Having regard to Council Directive 96/49/EC of 23 July 1996 on the approximation of the laws of the Member States with regard to the transport of dangerous goods by rail(1), and in particular Article 8 thereof,

s ohledem na směrnici Rady 96/49/ES ze dne 23. července 1996 o sbližování právních předpisů členských států týkajících se železniční přepravy nebezpečných věcí(1), a zejména na článek 8 uvedené směrnice,

Whereas:

vzhledem k těmto důvodům:

(1) The Annex to Directive 96/49/EC refers to the Regulation concerning the International Carriage of Dangerous Goods by Rail (RID), as applicable with effect from 1 July 2003 .

(1) Příloha směrnice 96/49/ES obsahuje Řád pro mezinárodní železniční přepravu nebezpečných věcí (RID) ve znění platném od 1. července 2003 .

(2) The RID is normally updated every two years, the latest update being in force from 1 January 2003 , with a transitional period up to 30 June 2003 .

(2) RID se běžně aktualizuje každé dva roky, přičemž poslední aktualizace vstoupila v platnost 1. ledna 2003 , s přechodným obdobím do 30. června 2003 .

(3) Exceptionally the RID was updated again after one year so that the amended version entered into force on 1 January 2004 .

(3) RID byl výjimečně znovu aktualizován po jednom roce a tato aktualizovaná verze vstoupila v platnost 1. ledna 2004 .

(4) It is therefore necessary to amend the Annex to Directive 96/49/EC.

(4) Je proto nezbytné změnit přílohu směrnice 96/49/ES.

(5) The measures provided for in this Directive are in accordance with the opinion of the Committee on the transport of dangerous goods referred to in Article 9 of Directive 96/49/EC,

HAS ADOPTED THIS DIRECTIVE:

The Annex to Directive 96/49/EC is replaced by the following:

Příloha směrnice 96/49/ES se nahrazuje tímto:

«Regulation concerning the International Carriage of Dangerous Goods by Rail (RID) appearing in Annex I to Appendix B to the Convention concerning International Carriage by Rail (COTIF), as applicable with effect from 1 January 2004 , it being understood that the terms «contracting party» and «the States or the railways» will be replaced by the term «Member State» .

ŤŘád pro mezinárodní železniční přepravu nebezpečných věcí (RID) obsažený v příloze I k dodatku B Úmluvy o mezinárodní železniční přepravě (COTIF), ve znění platném od 1. ledna 2004 , s tím, že slova Ťsmluvní stranať a Ťstáty nebo železniceť se nahrazují slovy Ťčlenský státť .

The text of the amendments of the 2004 version of the RID will be published as soon as it is available in all official languages of the Community.»

Znění změn RID ve znění z roku 2004 bude zveřejněno, jakmile bude dostupné ve všech úředních jazycích Společenství.ť

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 October 2004 at the latest. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

1. Členské státy uvedou v účinnost právní a správní předpisy nezbytné pro dosažení souladu s touto směrnicí nejpozději do 1. října 2004. Neprodleně sdělí Komisi znění těchto předpisů a srovnávací tabulku mezi uvedenými předpisy a ustanoveními této směrnice.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Tato opatření přijatá členskými státy musí obsahovat odkaz na tuto směrnici nebo musí být takový odkaz učiněn při jejich úředním vyhlášení. Způsob odkazu si stanoví členské státy.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

2. Členské státy sdělí Komisi znění hlavních ustanovení vnitrostátních předpisů, které přijmou v oblasti působnosti této směrnice.

This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

Tato směrnice vstupuje v platnost dvacátým dnem po vyhlášení v Úředním věstníku Evropské unie .

This Directive is addressed to the Member States.

Tato směrnice je určena členským státům.
