s ohledem na Smlouvu o založení Evropského společenství,

Having regard to the Treaty establishing the European Community,

s ohledem na směrnici Rady 90/426/EHS ze dne 26. června 1990 o veterinárních předpisech pro přesun koňovitých a jejich dovoz ze třetích zemí [1], naposledy pozměněnou Aktem o přistoupení Rakouska, Finska a Švédska, a zejména na čl. 15 bod a) a článek 16 uvedené směrnice,

Having regard to Council Directive 90/426/EEC of 26 June 1990 on animal health conditions governing the movement and imports from third countries of equidae(1), as last amended by the Act of Accession of Austria, Finland and Sweden, and in particular Articles 15(a) and 16 thereof,

(1) vzhledem k tomu, že veterinární podmínky a veterinární osvědčení pro dočasný dovoz evidovaných koní mimo jiné ze Spojených arabských emirátů jsou stanoveny rozhodnutím Komise 92/260/EHS [2] naposledy pozměněným rozhodnutím 1999/228/ES [3], respektive rozhodnutím Komise 93/197/EHS [4] naposledy pozměněným rozhodnutím 1999/252/ES [5];

(1) Whereas the health conditions and veterinary certification for the temporary admission and imports of registered horses among others from the United Arab Emirates are laid down respectively in Commission Decision 92/260/EEC(2), as last amended by Decision 1999/228/EC(3); and Commission Decision 93/197/EEC(4), as last amended by Decision 1999/252/EC(5);

(2) vzhledem k tomu, že po druhé veterinární kontrole ve Spojených arabských emirátech se jeví, že veterinární situace je pod uspokojivou kontrolou veterinárních útvarů, a zejména přesuny koňovitých a jejich nákazový status jsou dostatečně kontrolovány;

(2) Whereas following a second Commission veterinary inspection mission to the United Arab Emirates the animal health situation appears to be under the satisfactory control of the veterinary services and in particular the movement of equidae and their health status are sufficiently controlled;

(3) vzhledem k tomu, že ve Spojených arabských emirátech nikdy nebyl zaznamenán mor koní a očkování proti této chorobě je již více než jeden rok zakázáno; že na celém území země byla navíc prováděna řada sérologických šetření a uspokojivé výsledky byly sděleny členským státům a Komisi;

(3) Whereas African horse sickness has never been reported in the United Arab Emirates and vaccination against this disease is prohibited for more than one year; whereas moreover a series of serological surveys have been carried out over the entire territory of the country and the satisfactory results have been communicated to the Member States and the Commission;

(4) vzhledem k tomu, že předpisy pro dovoz koňovitých do dotyčné země jsou nejméně tak přísné jako předpisy pro dovoz koňovitých do Společenství; že uvedená země by proto měla být považována za málo rizikovou, pokud jde o zavlečení moru koní z jiných území;

(4) Whereas the conditions for imports of equidae into the country concerned are at least as strict as the conditions for imports of equidae into the Community; whereas therefore the country should be considered at low risk of incursion of African horse sickness from outside;

(5) vzhledem k tomu, že veterinární podmínky a veterinární osvědčení musejí odpovídat veterinární situaci dotyčné třetí země; že tento případ se týká pouze evidovaných koní, kteří mají být dočasně nebo trvale dovezeni ze Spojených arabských emirátů;

(5) Whereas the animal health conditions and veterinary certification must be adopted according to the animal health situation of the third country concerned; whereas the present case relates only to registered horses to be temporarily or permanently imported from the United Arab Emirates;

(6) vzhledem k tomu, že je třeba odpovídajícím způsobem pozměnit rozhodnutí Komise 92/260/EHS a 93/197/EHS;

(6) Whereas Commission Decisions 92/260/EEC and 93/197/EEC must be amended accordingly;

(7) vzhledem k tomu, že opatření tohoto rozhodnutí jsou v souladu se stanoviskem Stálého veterinárního výboru,

(7) Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Veterinary Committee,

PŘIJALA TOTO ROZHODNUTÍ:

HAS ADOPTED THIS DECISION:

Článek 1

Rozhodnutí Komise 92/260/EHS se mění takto:

Article 1

1. V příloze II veterinárním osvědčení typu E oddílu III písmenu d) se první odrážka nahrazuje tímto:

Commission Decision 92/260/EEC is amended as follows:

"— buď

1. The first indent in paragraph (d) of Chapter III of the animal health certificate E in Annex II is replaced as follows: "- either

- v zemi odeslání v karanténní stanici (3),

- the country of dispatch, in an isolation centre (3)

nebo

or

- ve Spojených arabských emirátech (AE), v určených místech pod veterinírním dohledem (3)".

- the United Arab Emirates (AE), in designated premises under official veterinary supervision (3)".

2. V příloze II veterinárním osvědčení typu E oddílu III písmenu i) se čtvrtá odrážka nahrazuje tímto:

2. The fourth indent in paragraph (i) of Chapter III of the animal health certificate E in Annex II is replaced by the following: "- a test for African horse sickness as described in Annex D to Council Directive 90/426/EEC either

"— testu na mor koní podle přílohy D směrnice Rady 90/426/EHS, buď

- on two occasions, carried out on samples of blood taken with an interval of between 21 and 30 days on ... (5) and on ... (5), the second of which must have been taken within 10 days of export (3), either with negative reactions, if it has not been vaccinated (3) (4), or without increase in antibody count, if it has been vaccinated (3) (4)

- dvakrát, ze vzorků krve odebraných v intervalu mezi 21 a 30 dny, a to dne … (5) a … (5), přičemž druhý vzorek musí být odebrán do 10 dní před vývozem (3), a to buď s negativními výsledky, pokud nebylo očkováno (3) (4), nebo bez zvýšení hladiny protilátek, pokud bylo očkováno (3) (4),

or

nebo

- on one occasion, carried out on a sample of blood taken within 10 days of export on ... (5) with negative reaction, if it is to be dispatched from the United Arab Emirates (AE) (3) (4);".

- jednou, provedené ze vzorku krve odebraného do 10 dní před vývozem dne … (5) s negativním výsledkem, jestliže má být odeslán ze Spojených arabských emirátů (AE) (3) (4)".

3. "United Arab Emirates (AE)" is added in the order of the ISO country code to the list of third countries in the last indent of paragraph (d) of Chapter III of the animal health certificates A, B, C, D and E in Annex II.

3. V příloze III ve veterinárních osvědčeních typu A, B, C, D a E v oddílu III písmenu d) se v poslední odrážce vkládá v seznamu zemí na místo v pořadí podle kódu ISO země výraz "Spojené arabské emiráty (AE)".

V příloze II rozhodnutí 93/197/EHS veterinárním osvědčení typu E se oddíl III mění takto:

Chapter III of the animal health certificate E in Annex II of Decision 93/197/EEC is amended as follows:

1. Odstavec d) se nahrazuje tímto:

1. Paragraph (d) is replaced by the following: "(d) during the three months immediately preceding the exportation (or since birth, if the animal is less than three months old, or since entry, if it was imported directly from the European Community during the previous three months) it has been resident on holdings under veterinary supervision in the country of dispatch and it has been kept in an approved isolation centre, protected from vector insects, either

"d) během tří měsíců bezprostředně předcházejících vývozu (nebo od narození u zvířat mladších tří měsíců, nebo od vstupu, jestliže bylo dovezeno přímo z Evropského společenství během předcházejících tří měsíců) pobývalo v hospodářstvích pod veterinárním dohledem v zemi odeslání a bylo drženo ve schválených karanténních stanicích chráněných před hmyzími vektory, buď

- during the 40 days prior to dispatch (3),

- 40 dní před odesláním (3),

or

nebo

- during 30 days prior to dispatch from the United Arab Emirates (AE) (3);".

2. Paragraph (k) is replaced by the following: "(k) it was subjected to a test for African horse sickness as described in Annex D to Council Directive 90/426/EEC either
