COUNCIL DIRECTIVE 94/31/EC of 27 June 1994 amending Directive 91/689/EEC on hazardous waste

THE COUNCIL OF THE EUROPEAN UNION,

ze dne 27. června 1994,

Having regard to the Treaty establishing the European Community, and in particular Article 130s (1) thereof,

kterou se mění směrnice 91/689/EHS o nebezpečných odpadech

Having regard to the proposal from the Commission (1),

RADA EVROPSKÉ UNIE,

Having regard to the opinion of the Economic and Social Committee (2),

s ohledem na Smlouvu o založení Evropského společenství, a zejména na čl. 130s odst. 1 této smlouvy,

Acting in accordance with the procedure laid down in Article 189 c of the Treaty,

s ohledem na návrh Komise [1],

Whereas it has become apparent, through the work of the committee provided for in Article 18 of Council Directive 75/442/EEC (3) that it has not been possible, within the time limits fixed by Directive 91/689/EEC (4), to draw up a binding list of hazardous waste, but whereas the implementation of Directive 91/689/EEC depends on the Commission's establishing such a list;

s ohledem na stanovisko Hospodářského a sociálního výboru [2],

Whereas it is necessary to ensure the implementation of Directive 91/689/EEC within the shortest possible time;

v souladu s postupem stanoveným v článku 189c Smlouvy,

Whereas a Community list of hazardous waste must still be established in accordance with Article 1 (4) of Directive 91/689/EEC;

vzhledem k tomu, že podle práce výboru stanoveného v článku 18 směrnice Rady 75/442/EHS [3] je zřejmé, že v rámci lhůt stanovených směrnicí 91/689/EHS [4] nebylo možné vypracovat závazný seznam nebezpečných odpadů, ale že provádění směrnice 91/689/EHS závisí na vytvoření takového seznamu Komisí;

Whereas the repeal of Council Directive 78/319/EEC of 20 March 1978 on toxic and dangerous waste (5) must therefore be postponed,

vzhledem k tomu, že je nezbytné zajistit provádění směrnice 91/689/EHS v nejkratší možné době;

HAS ADOPTED THIS DIRECTIVE:

vzhledem k tomu, že seznam nebezpečných odpadů Společenství musí být stále ještě vytvořen v souladu s čl. 1 odst. 4 směrnice 91/689/EHS;

vzhledem k tomu, že zrušení směrnice Rady 78/319/EHS ze dne 20. března 1978 o toxických a nebezpečných odpadech [5] musí být odloženo,

Article 1

PŘIJALA TUTO SMĚRNICI:

Directive 91/689/EEC is hereby amended as follows:

Článek 1

1. The following shall be substituted for Article 10 (1):

Směrnice 91/689/EHS se mění takto:

'Article 10

1. Čl. 10 odst. 1 se nahrazuje tímto:

1. Member States shall bring into force the laws, regulations and administrative provisions necessary for them to comply with this Directive by 27 June 1995. They shall immediately inform the Commission thereof.'

"Článek 10

2. The following shall be substituted for Article 11:

1. Členské státy uvedou v účinnost právní a správní předpisy nezbytné pro dosažení souladu s touto směrnicí do 27. června 1995. Neprodleně o nich uvědomí Komisi."

'Annex 11

2. Článek 11 se nahrazuje tímto:

Directive 78/319/EEC shall be repealed with effect from 27 June 1995.'

"Článek 11

Směrnice 78/319/EHS se zrušuje s účinkem ode dne 27. června 1995."

This Directive is addressed to the Member States.

Tato směrnice je určena členským státům.
