COMMISSION DECISION of 11 June 1992 laying down certain rules to ensure coordination between organizations and associations which maintain or establish stud-books for registered equidae (92/354/EEC)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Directive 90/427/EEC of 26 June 1990 on the zootechnical and genealogical conditions governing intra-Community trade in equidae (1), and in particular Article 4 (2) (e) thereof,

Whereas Decision 92/353/EEC (2) lays down the criteria for the approval or recognition of organizations and associations which maintain or establish stud-books for registered equidae; whereas that Decision provides that the authorities of the Member State concerned are responsible for approving or recognizing organizations or associations which maintain or establish stud-books;

KOMISE EVROPSKÝCH SPOLEČENSTVÍ,

Whereas in this context, therefore, rules should be laid down to govern the relations between the organization or association which maintains the stud-book of the origin of the breed and an organization or association which maintains or establishes a stud-book or a section of a stud-book for that breed;

s ohledem na Smlouvu o založení Evropského hospodářského společenství,

Whereas provisions should be made for a procedure enabling the competent authorities concerned to ensure, in special circumstances, coordination between two organizations or associations; whereas it is also important that all the information required for the adoption of the specific coordination rules pursuant to Article 4 (2) (e) of Directive 90/427/EEC be made available to the Commission;

s ohledem na směrnici Rady 90/427/EHS ze dne 26. června 1990 o zootechnických a genealogických podmínkách pro obchod s koňovitými uvnitř Společenství [1], a zejména na čl. 4 odst. 2 písm. e) uvedené směrnice,

Whereas the measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Zootechnics,

vzhledem k tomu, že rozhodnutí 92/353/EHS [2] stanoví kritéria pro schvalování nebo uznávání organizací a spolky, které vedou nebo zakládají plemenné knihy evidovaných koňovitých; že toto rozhodnutí stanoví, že orgány dotyčných členských států jsou příslušné pro schvalování nebo uznávání organizací nebo spolků, které vedou nebo zakládají plemenné knihy;

HAS ADOPTED THIS DECISION:

vzhledem k tomu, že v této souvislosti by proto měla být stanovena pravidla, která by upravovala vztahy mezi organizací nebo spolky, které vede plemennou knihu o původu plemene, a organizací nebo spolkem, který vede nebo zakládá plemennou knihu nebo oddíl plemenné knihy daného plemene;

Article 1

vzhledem k tomu, že je třeba stanovit postup, který by umožňoval dotyčným příslušným orgánům zajistit za zvláštních okolností koordinaci mezi dvěma organizacemi nebo spolky; že je rovněž důležité, aby veškeré informace nezbytné pro přijetí zvláštních koordinačních pravidel na základě čl. 4 odst. 2 písm. e) směrnice 90/427/EHS byly zpřístupněny Komisi;

The organization or association which maintains the stud-book of the origin of the breed must ensure close collaboration with the organization and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute.

vzhledem k tomu, že opatření tohoto rozhodnutí jsou v souladu se stanoviskem Stálého zootechnického výboru,

Article 2

PŘIJALA TOTO ROZHODNUTÍ:

1. Where the competent authority of a Member State considers that an approved or recognized organization or association in another Member State is not complying with the rules laid down in the relevant Community legislation, and particularly with the principles laid down by the organization or association which maintains the stud-book of the origin of the breed, it shall contact the competent authority of the other Member State concerned forthwith.

Článek 1

The latter shall take all the necessary measures and inform the competent authority of the first Member State of the type of checks carried out, the decisions taken and the reasons for those decisions.

Organizace nebo spolky, které vedou plemennou knihu o původu plemene, musí zajistit úzkou spolupráci s organizacemi nebo spolky, které vedou plemenné knihy nebo oddíly plemenné knihy téhož plemene, zvláště s ohledem na předcházení jakýmkoli sporům.

2. If the competent authorities of the first Member State considers these measures likely to be insufficient, it shall explore with the authority of the other Member State ways of remedying the situation, if necessary by visiting that Member State.

Článek 2

3. The competent authorities of the Member States shall inform the Commission of the solutions decided upon.

1. Pokud se příslušný orgán členského státu domnívá, že organizace nebo spolky schválené nebo uznané v jiném členském státě nedodržují pravidla stanovená v odpovídajících právních předpisech Společenství, a zejména zásady stanovené organizací nebo spolkem, který vede plemennou knihu o původu plemene, neprodleně se spojí s dotyčným příslušným orgánem tohoto jiného členského státu.

4. In the event that no solution is found within six months, at the request of one of the authorities of the Member States concerned or on its own initiative, the Commission may, in particular, send an inspection team in collaboration with the competent national authorities.

Příslušný orgán druhého členského státu učiní veškerá nezbytná opatření a uvědomí příslušný orgán prvního členského státu o druhu provedených kontrol, učiněných rozhodnutích a jejich důvodech.

Article 3

2. Pokud se příslušný orgán prvního členského státu domnívá, že by tato opatření mohla být nedostatečná, měl by společně s orgánem druhého členského státu hledat možnosti nápravy dané situace, a to v případě nutnosti vykonáním návštěvy na místě.

3. Příslušné orgány členských států uvědomí Komisi o přijatých řešeních.

4. Pokud se do šesti měsíců nenajde žádné řešení, může Komise na žádost jednoho z orgánů dotyčných členských států nebo z vlastního podnětu vyslat na místo inspekční skupinu, která spolupracuje s příslušnými vnitrostátními orgány.
