THE COUNCIL OF THE EUROPEAN COMMUNITIES,

ze dne 26. června 1990

Having regard to the Treaty establishing the European Economic Community, and in particular Article 43 thereof,

o zootechnických a genealogických podmínkách pro obchod s koňovitými uvnitř Společenství

Having regard to the proposal from the Commission (1),

Having regard to the opinion of the European Parliament (2),

RADA EVROPSKÝCH SPOLEČENSTVÍ,

Having regard to the opinion of the Economic and Social Committee (3),

s ohledem na Smlouvu o založení Evropského společenství, a zejména na článek 43 této smlouvy,

Whereas equidae, being live animals, are included in the list of products in Annex II to the Treaty;

s ohledem na návrh Komise [1],

Whereas in order to ensure the rational development of equidae production, thereby increasing productivity in that sector, rules governing the marketing of equidae in intra-Community trade must be laid down at Community level;

s ohledem na stanovisko Evropského parlamentu [2],

Whereas the breeding and rearing of equidae and in particular of horses is generally included in the farming sector; whereas it constitutes a source of income for part of the farming population and should therefore be encouraged;

s ohledem na stanovisko Hospodářského a sociálního výboru [3],

Whereas satisfactory results in that respect depend largely on the use of equidae registered in stud books maintained by officially approved organizations or associations;

vzhledem k tomu, že koňovití jsou jako živá zvířata uvedeni na seznamu produktů vyjmenovaných v příloze II Smlouvy;

Whereas disparities exist as regards entry in studbooks; whereas those disparities constitute a barrier to trade within the Community; whereas complete liberalization of trade calls for further harmonization, particularly regarding entry in studbooks;

vzhledem k tomu, že je důležité, aby byla v rámci Společenství stanovena pravidla uvádění koňovitých na trh, a tím i zajištěn racionální rozvoj produkce koňovitých a zvýšena produktivita tohoto odvětví;

Whereas intra-Community trade in registered equidae should be progressively liberalized; whereas complete liberalization of trade requires further additional harmonization, in particular as regards approval for the purpose of off-farm mating and the use of semen and ova in accordance with the characteristics of each studbook;

vzhledem k tomu, že chov koňovitých, a to především koní, je obecně součástí odvětví zemědělství; dále pak, že pro část zemědělské populace představuje zdroj příjmů a že by měl být propříště podporován;

vzhledem k tomu, že uspokojivé výsledky v této oblasti velice úzce souvisejí s používáním koňovitých zapsaných v plemenných knihách, které vedou úředně schválené organizace nebo sdružení;

Whereas it is necessary to draw up, in accordance with a Community procedure, a harmonized model zootechnical origin and identification certificate;

vzhledem k tomu, že v oblasti zápisu do plemenných knih existují rozdíly; že tyto rozdíly představují překážku pro obchod uvnitř Společenství; dále pak, že úplná liberalizace obchodu je podmíněna následnou harmonizací, především pokud jde o zápisy do plemenných knih;

Whereas the name of an animal is an essential factor in identifying equidae; whereas it is often impossible to trace an animal's descent and monitor its progress if its name is changed at a new owner's request; whereas the rules regarding the naming of equidae should be harmonized, in particular in order to prevent unfair practices;

vzhledem k tomu, že je nutno postupně liberalizovat obchod s evidovanými koňovitými uvnitř Společenství; že úplná liberalizace tohoto obchodu je podmíněna pozdější doplňkovou harmonizací, především pokud jde o přijetí k veřejné plemenitbě a o používání spermatu a vajíček za zohlednění zvláštností jednotlivých plemenných knih;

Whereas provisions should be introduced preventing equidae from third countries from being imported on terms which

vzhledem k tomu, že je nezbytné, aby byl v souladu s postupem Společenství vytvořen jednotný typ zootechnického osvědčení o původu a identifikaci;

are less stringent than those applicable within the Community;

vzhledem k tomu, že jméno zvířete je důležitou podstatnou skutečností pro jeho identifikaci; že změna jména provedená na žádost nového majitele velmi často znemožní vyhledání původu zvířete a sledování jeho vývoje; a dále pak že je nutno harmonizovat ustanovení týkající se přidělování jmen koňovitým a zabránit tak nekalým praktikám;

Whereas it is advisable to adopt implementing measures regarding certain technical aspects; whereas, for the purposes of the measures envisaged, provision should be made for close and effective cooperation between Member States and the Commission within the Standing Committee on Zootechnics,

vzhledem k tomu, že je nutno stanovit, aby dovoz koňovitých ze třetích zemí nebyl prováděn za méně přísných podmínek než jsou podmínky stanovené pro dovoz uvnitř Společenství;

HAS ADOPTED THIS DIRECTIVE:

vzhledem k tomu, že je nutno v některých oblastech technického rázu přijmout prováděcí opatření; dále pak že za účelem zavedení plánovaných opatření je nutno stanovit postup, který by vymezil úzkou a účinnou spolupráci mezi členskými státy a Komisí v rámci Stálého zootechnického výboru,

CHAPTER I

KAPITOLA I

General provisions

Obecná ustanovení

Článek 1

Article 1

Tato směrnice definuje zootechnické a genealogické podmínky pro obchod s koňovitými, jejich spermatem, vajíčky a embryi uvnitř Společenství.

This Directive lays down the zootechnical and genealogical conditions governing intra-Community trade in equidae, their semen, ova and embryos.

Článek 2

Pro účely této směrnice se rozumí:

Article 2

a) "koňovitým" domestikovaný kůň nebo osel nebo zvíře vzniklé jejich křížením;

For the purposes of this Directive:

b) "evidovaným koňovitým" koňovitý zapsaný nebo zaevidovaný nebo který je způsobilý k zapsání do plemenné knihy podle pravidel přijatých na základě čl. 4 odst. 2 písm. b) a určený prostřednictvím identifikačního dokladu podle článku 8 písm. 1;

(a) 'equidae' means domestic animals of the equine or asinine species or crossbreeds thereof;

c) "plemennou knihou" každá kniha, registr, soubor nebo počítačový nosič dat:

- které jsou vedeny buď organizací, nebo sdružením úředně schváleným nebo uznaným členským státem, nebo správním úřadem daného členského státu a

'registered equidae' means equidae which are entered or registered and eligible for entry in a studbook, in accordance with the rules laid down pursuant to Article 4 (2) (b) and identified by means of the identification document provided for in Article 8 (1);

- do kterých jsou zapsáni nebo zaevidováni koňovití s uvedením jejich známého původu.

(c)

Článek 3

'studbook' means any book, register, file or data medium:

Obchod s koňovitými, jejich spermatem, vajíčky a embryi nelze zakázat či omezit ze zootechnických nebo genealogických příčin, pokud ovšem tyto nevyvstanou v důsledku použití této směrnice.

- which is maintained either by an organization or an association officially approved or recognized by a Member State or by an official agency of the Member State concerned, and

Obchod s evidovanými koňovitými, jejich spermatem, vajíčky a embryi uvnitř Společenství nadále upravují, ovšem za dodržování obecných ustanovení Smlouvy, vnitrostátní předpisy jednotlivých členských států až do doby, než vstoupí v platnost příslušná rozhodnutí Společenství uvedená v článcích 4 a 8.

- in which equidae are entered or registered with mention of all their known ascendants.

KAPITOLA II

Genealogická pravidla pro evidované koňovité

Article 3

Článek 4

Intra-Community trade in equidae and their semen, ova and embryos may not be prohibited or restricted on zootechnical or genealogical grounds other than those resulting from application of this Directive.

1. Při přijímání rozhodnutí uvedených v odstavci 2 se zohledňují tyto zásady:

However, in the case of intra-Community trade in registered equidae, their semen, ova and embryos, national provisions which comply with the general rules of the Treaty shall be maintained pending the entry into force of the relevant Community decisions referred to in Articles 4 and 8.

a) uznání nebo schválení organizací a sdružení, které vedou nebo zavádějí plemenné knihy, je podmíněno dodržováním zásad stanovených organizací nebo sdružením, které vedou plemennou knihu dokládající původ daného plemene;

CHAPTER II

b) kritéria pro zápis a zaevidování do plemenných knih se určují podle specifik daného plemene a především u některých čistokrevných plemen podle potřeby upravit předpisy zápis a evidenci koňovitých vzniklých metodami umělé reprodukce.

Genealogical rules relating to registered equidae

2. Komise stanoví postupem podle článku 10 a v souladu se zásadami uvedenými v odstavci 1:

a) kritéria pro schvalování nebo uznání organizací nebo sdružení, které vedou nebo zavádějí plemenné knihy;

b) kritéria pro zápis nebo zaevidování do plemenných knih;

1. The following principles shall be taken into account when the decisions referred to in paragraph 2 are adopted:

c) je-li nutno, kritéria a metody pro identifikaci zaevidovaných koňovitých;

(a) the recognition or approval of organizations and associations which maintain or establish studbooks shall be subject to compliance with the principles laid down by the organization or association which maintains the studbook of the origin of the breed;

d) kritéria pro vystavení osvědčení o původu a pro vystavení identifikačního dokladu uvedených v článku 8;

(b) the criteria for entry and registration in studbooks shall be laid down on the basis of the characteristics of the breed and in particular for certain pure breeds of the need to regulate the entry and registration of equidae produced using artificial reproduction methods.

e) je-li nutno, pravidla pro koordinaci činnosti jednotlivých organizací a sdružení uvedených v článku 5.

2. The Commission shall establish under the procedure laid down in Article 10 and in accordance with the principles set out in paragraph 1:

(a) the criteria for the approval or recognition of organizations and associations which maintain or establish studbooks;

Seznam organizací a sdružení, které vedou nebo zavádějí plemenné knihy a které byly uznány na základě kritérií stanovených podle čl. 4 odst. 2 písm. a), a jeho pozdější aktualizované podoby se sdělují Komisi a ostatním členským státům v rámci Stálého zootechnického výboru.

(b)

the criteria for entry and registration in studbooks;

1. V rámci obchodu uvnitř Společenství musejí být koňovití zaevidovaní ve státě, který provádí odeslání, pokud se ovšem obě zúčastněné organizace nebo sdružení společně nedohodly jinak, zaevidováni nebo zapsáni do příslušné plemenné knihy ve členském státě určení pod svým původním jménem s uvedením mezinárodně uznávané zkratky země narození.

2. Pokud to stanovy organizací nebo sdružení umožňují:

if necessary, the criteria and methods used to identify registered equidae;

- před původním jménem zvířete nebo za ním může být uvedeno jiné, třebaže dočasné jméno, ovšem pouze za podmínky, že původní jméno bude za života daného zvířete zachováno v závorce a že u něj bude uvedena i země narození ve formě mezinárodně uznávané zkratky;

(d)

- postupy, které stanoví Komise postupem podle článku 10, lze přijmout alternativní opatření, jež zaručí zachování návaznosti totožnosti zvířete.

if necessary, rules to ensure coordination between the organizations or associations referred to in Article 5.

Článek 7

Komise může, pokud je to nezbytné k jednotnému používání této směrnice a za dodržení zásad uvedených v čl. 4 odst. 1, stanovit postupem podle článku 10:

a) metody pro kontrolu užitkovosti a stanovení genetické hodnoty plemenných zvířat;

The list of organizations and associations maintaining or establishing studbooks, which are recognized on the basis of the criteria to be determined in accordance with Article 4 (2) (a) and subsequent updatings, shall be communicated to the Commission and the other Member States within the Standing Committee on Zootechnics.

b) podle metod uvedených v písmeni a) obecná kritéria, podle kterých se plemenný hřebec nebo, je-li to nezbytné, plemenná klisna mohou použít k plemenitbě, a obecná kritéria pro užívání jejich spermatu, vajíček a embryí.

Článek 8

Article 6

Členské státy zajistí:

1. In intra-Community trade, equidae which are registered in the Member State of dispatch must, except where a derogation has been agreed by common accord between the two organizations or associations concerned, be registered or entered in the appropriate studbook of the Member State of destination under the same name, with an indication, in accordance with international agreements, of the initial(s) of the country of foaling.

1. aby byli evidovaní koňovití pro převoz vybaveni jednotným identifikačním dokladem Komise postupem podle článku 10, vystaveným organizacemi nebo sdruženími uvedenými v článku 5 této směrnice a v čl. 2 písm. c) směrnice Rady 90/426/EHS ze dne 26. června 1990 o veterinárních předpisech pro přesun koňovitých a jejich dovoz ze třetích zemí [4].

2. Where the constitution of the organizations or associations so permits:

Evidovaní koně jsou vybaveni identifikačním dokladem, psaným v některém z jazyků Společenství, který musí obsahovat přinejmenším položky uvedené v příloze s tím, že mohou být doplněny nebo pozměněny postupem podle článku 10;

- the original name of the animal may be preceded or followed by another name on a provisional or permanent basis, provided that throughout the animal's life the original name is retained in brackets and that the country of birth is indicated by means of the initial(s) recognized by international agreements,

2. aby byly sperma, vajíčka a embrya evidovaných koňovitých vybaveny pro účely uvádění na trh zootechnickým osvědčením o původu a identifikaci, vydaným příslušným orgánem a psaným alespoň v jazyce země určení, které bude odpovídat vzoru vytvořenému Komisí postupem podle článku 10.

- alternative measures may be taken to safeguard the continued identity of the animal in accordance with procedures to be determined by the Commission under the procedure laid down in Article 10.

CHAPTER III

Článek 9

Zootechnical rules relating to registered equidae

Do doby, než se začne používat právní úprava Společenství v této oblasti, zootechnické podmínky pro dovoz koňovitých, jejich spermatu, vajíček a embryí ze třetích zemí nesmějí být výhodnější než podmínky stanovené pro obchod uvnitř Společenství.

Article 7

Má-li být zahájen postup podle tohoto článku, Stálý zootechnický výbor zřízený rozhodnutím 77/505/EHS [5] rozhoduje podle pravidel stanovených v článku 11 Směrnice 88/661/EHS [6].

Article 8

Member States shall ensure that:

1. in their movements, registered equidae are accompanied by an identification document drawn up by the Commission in accordance with the procedure laid down in Article 10 and issued by the organizations or associations referred to in Article 5 of this Directive and Article 2 (c) of Directive 90/426/EEC of 26 June 1990, on animal health conditions governing the movement between Member States and import from third countries of equidae (4).

The identification document, to be drawn up in the Community languages, for registered horses must include at least the information indicated in the Annex; that information may be supplemented or amended in accordance with the procedure laid down in

2. When they are marketed, the semen, ova and embryos of registered equidae are accompanied by a zootechnical certificate of origin and identification issued by the competent authority at least in the language of the country of destination and conforming to a model to be drawn up by the Commission in accordance with the procedure laid down in Article 10.

Pending implementation of relevant Community rules, the conditions applicable to imports of equidae and their semen, ova and embryos from third countries must not be more favourable than those governing intra-Community trade.

Where the procedure laid down in this Article is to be used, the Standing Committee on Zootechnics set up by Decision 77/505/EEC (5), shall act in accordance with the rules set out in Article 11 of Directive 88/661/EEC (6).

Article 11

The Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 1 January 1991 at the latest. They shall forthwith inform the Commission thereof.

Article 12

This Directive is addressed to the Member States.
